Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey — Excused Commissioner Lynette Peppier— Excused Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Chris Gathman Development Review Representative, Dan Campbell The following business was transacted: I hereby certify that pursuant to a Notice dated September 17, 2025, and duly published September 19, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Guttersen Ranches, LLC, c/o DCP Operating Company, LP, for Use by Special Review Permit, USR25-0010, for an Oil and Gas Support and Service facility (natural gas compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Patrick Groom, represented the applicant, and in response to Chair Buck, indicated they had not had contact with any of the Commissioners regarding this case. Chair Buck instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved today. Mr. Groom agreed to continue with the presentation. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, sharing it will be a ten (10)-acre natural gas compressor station, he described the location of the site, and listed the equipment being proposed, with a construction timeline of approximately nine (9 ) months for completion. He stated the site access will be approximately two (2) miles west of County Road (CR) 59. He stated traffic will increase during construction and will return to one (1) to two (2) vehicles per day during normal operations. He shared the applicant will obtain the required Federal, State, and local approvals. He stated the facility will be fully fenced, with spaced man gates around the perimeter, and explained no water or sewer services will be required; however, portable toilets and bottled water will be utilized during construction, and a Decommission Plan was submitted with the application. Mr. Gathman entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. Dan Campbell, Department of Planning Services, Development Review, shared access is two (2) miles west onto CR 59, and a small portion of CR 61 and CR 59 is under the jurisdiction of the Town of Keenesburg, who requires a Road Maintenance Agreement. He stated an accepted Colorado Drainage Report and a Weld County Grading Permit are required. In response to Commissioner James, Mr. Gathman confirmed residential standards for the light industrial zone are adequate, sharing Mr. Groom will elaborate on the noise study. Mr. Groom, expressed his thanks to Mr. Gathman and Mr. Nader for their assistance through the application process. He narrated a PowerPoint presentation, describing the location was chosen due to the surrounding uses being similar. He explained the strategic importance of the location, and described the site buildings, and the amount of gas compressed per day. He relayed there will be a Road Maintenance Agreement with the Town of Keenesburg and detailed the project timeline. He explained the light industrial noise standard, stating the appropriate standard would be industrial; however, the residential standard can be met. Commissioner James asked for confirmation of the results of the Noise Study. Commissioner Ross agreed, knowing the property owner's concern of the Noise Study Standards. Mr. Groom explained a discrepancy of the legal description of the parcel to be used, which has been updated, and described the Lighting Plan to be used. No public testimony was offered concerning this matter. The Board discussed the Conditions of Approval (COA) and Development Standards (DS), noting DS #22 shall be changed to reference Section 14-9-40 of the Weld County Code. Mr. Groom asked about defining the Noise Study parameters, and Ms. McDougal suggested keeping it listed as the Residential Standard for consistency sake. The Board agreed to the aforementioned change. 2025-2884 PL2971 Hearing Certification (USR25-0010) — Guttersen Ranches, LLC, do DCP Operating Company, LP Page 3 In response to Chair Buck, Mr. Groom indicated they have reviewed, and agreed to abide by the Conditions of Approval and Development Standards, as amended, sharing the name of the project be changed from Goldeneye to Cattlemen's, on the Resolution. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner Ross moved to approve the request of Guttersen Ranches, LLC, do DCP Operating Company, LP, for Use by Special Review Permit, USR25-0010, for an Oil and Gas Support and Service facility (natural gas compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner James and it carried unanimously. There being no further discussion, the hearing was completed at 10:25 a.m. (Clerk's Note: Teams recording start timestamp 5:40) The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 12th day of November, A.D., 2025: Perry L.
