HomeMy WebLinkAbout20251207.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, May 7, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 7, 2025, at the hour of 9:00 a.m. PA Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli e. Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 1. Minutes from April 23, 2025 Certification of Hearings: Commissioner Ross moved to approve the below listed Hearing Certificates. Commissioner James seconded the motion, which carried unanimously. 1. USR24-0028 — David and Kayleen Hunt 2. USR25-0001 — Wells Ranch, LLLP, c/o Colorado Sand Company II, LLC 3. USR24-0026 — CAW Equities, LLC, c/o Ready Mixed Concrete, LLC IR Amendments to Agenda: There were no amendments to the Agenda. 2025-1207 BC0016 Page 2 Wednesday, May 7, 2025 www.weld.gov le Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. Presentations and Proclamations: 1. 1E1 National Child Care Provider Day — May 9, 2025: Chair Buck read the proclamation, celebrating childcare providers throughout Weld County, for the record. Lisa Sadar, Executive Director of United Way of Weld County and the Early Childhood Council that sits within United Way, introduced various community partners who were present, thanked the Board for their support and recognition of childcare providers, and stated National Child Care Provider Day is celebrated annually on the Friday before Mother's Day, which highlights all childcare professionals in all types of settings. She took the opportunity to highlight the dedication, commitment, and compassion provided by early childhood educators through family, childcare homes, childcare centers, and preschools. Ms. Sadar provided statistics regarding Weld County's local economy and workforce as it relates to the capacity to serve the community with licensed childcare providers. Each Commissioner, in turn, shared their gratitude to the childcare providers in Weld County and thanked them for their impact in a rapidly growing County, stating the legacy being created for young children is priceless. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1. a General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner Peppier seconded the motion and it carried unanimously. Bids: 1. lE1 Approve Bid #62500060, Custodial Supplies — Facilities Department: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications for each listed item identified on the spreadsheet on record. Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner Maxey and it carried unanimously. 2. Present Bid #B2500048, Tandem Axle Flatbed Multi -Purpose Truck with Flow and Hydraulic (Qty 1) — Departments of Fleet Services and Public Works: Mr. Taylor stated three (3) bids were received and staff will make a recommendation on May 21, 2025. 3. a Present Bid #B2500062, Tandem Axle Dump Truck, Regular Cab, Dual Axles with Sander and Plow (Qty 2) — Departments of Fleet Services and Public Works: Mr. Taylor stated three (3) bids were received and staff will make a recommendation on May 21, 2025. 2025-1207 BC0016 Page 3 Wednesday, May 7, 2025 www.we Id .g ov 4. IR Present Bid #B2500067, Infoblox Maintenance and Support— Department of Information Technology: Mr. Taylor stated five (5) bids were received and staff will make a recommendation on May 21, 2025. New Business — General: 1. IRConsider High Visibility Impaired Driving Enforcement Application for Funding and Authorize Chair to Sign: Captain Matt Turner, Weld County Sheriff's Office, introduced Thuan Matthews as the new Budget Manager for the Sheriff's Office and requested submittal of the application to offset overtime coverage of sixteen (16) law enforcement periods from July 1, 2025, through June 30, 2026, to provide extra patrol services during holidays and special events in an effort to reduce traffic accidents and fatalities related to driving under the influence (DUI). Commissioner Maxey welcomed Ms. Matthews to Weld County and thanked staff for their efforts in finding grant funds. Commissioner Ross moved to approve said application and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 2. Consider Contract ID #9299 Memorandum of Understanding for Service Delivery Pursuant to Workforce Innovation and Opportunity Act (WIOA) Program for Adult Education and Literacy Services, and Authorize Chair and Workforce Development Board to Sign —Aurora Comprehensive Community Mental Health Center, Inc., dba Aurora Mental Health and Recovery: Jamie Ulrich, Director of the Department of Human Services, stated the memorandum of understanding (MOU) is pursuant to a mandate of the Workforce Innovation and Opportunity Act (WIOA) to enter into an agreement with each mandated partner to provide services. Commissioner Maxey moved to approve said MOU and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 3. E-�-' Consider Contract ID #9373 Memorandum of Understanding Annual Reaffirmation for Colorado Works Program and Temporary Assistance for Needy Families (TANF), and Authorize Chair to Sign: Ms. Ulrich stated this is the annual reaffirmation of the MOU for the Colorado Works Program, which identifies the responsibilities of both parties for the program that is implemented in Weld County. Commissioner James moved to approve said MOU annual reaffirmation and authorize the Chair to sign. The motion, which was seconded by Commissioner Ross, carried unanimously. 4. El Consider Contract ID #9391 Notice of Funding Reallocation (NFA) Work Plan for Workforce Innovation and Opportunity Act (WIOA) Adult and Dislocated Worker Programs, and Authorize Chair, Department of Human Services, and Workforce Development Board to Sign: Ms. Ulrich stated the Colorado Department of Labor and Employment has determined to reallocate $100,000.00 from the Dislocated Workers Program to the Adult Program to 2025-1207 BC0016 Page 4 Wednesday, May 7, 2025 www.weld.gov accommodate the higher need and maximize resources to satisfy the service needs of the program. Commissioner Peppler moved to approve said NFA reallocation and authorize the Chair to sign. The motion, which was seconded by Commissioner Maxey, carried unanimously. 5. e Consider Contract ID #9412 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Mary Solano: Ms. Ulrich stated the contract is for a provisional kinship foster care home located in Ault, Colorado. Commissioner Ross moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 6. IR Consider Contract ID #9411 Modification #1 to Participating Agreement for Noxious Weed Treatment and Authorize Chair to Sign: Tina Booton, Department of Public Works, stated the modification concerns a five (5) -year agreement that was approved last year and explained it does not include any additional funds; therefore, the work will be minimal due to there being approximately $5,000.00 in residual funds from last year. Commissioner Maxey moved to approve said modification #1 and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 7. E Consider Contract ID #9405 Agreement for Sale and Purchase of Wetland Mitigation Credits from Big Thompson Confluence Mitigation Bank for Bridge 19/46.5A Replacement Project, and Authorize Chair to Sign — Westervelt Ecological Services, LLC: Mike Bedell, Department of Public Works, stated the agreement allows for the County to address regulations and meet environmental requirements concerning 0.04 acres of mapped wetlands that will be impacted by the project to replace Bridge 19/46.5A. He explained purchasing wetland mitigation credits, in the amount of $7,000.00, will allow the County to work with Westervelt Ecological Services, LLC, which is a licensed with the Army Corps of Engineers who will monitor and mitigate anticipated damages on behalf of the County to remain in compliance with said regulations. In response to Commissioner Maxey, Mr. Bedell confirmed the acreage and further stated it costs approximately $200,000.00 for every acre affected. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 8. a Consider Community Development Block Grant Advisory Committee (CDBGAC) Recommended 2025 Projects and Funding Allocations Through Community Development Block Grant (CDBG) Program: Cynthia Martin, CDBG Analyst, stated the Community Development Block Grant Advisory Committee (CDBGAC) has reviewed submittals from municipalities throughout Weld County, and recommends approval of various projects identified for the record. Commissioner Ross moved to approve said Resolution. The motion was seconded by Commissioner James and it carried unanimously. 2025-1207 BC0016 Page 5 Wednesday, May 7, 2025 www.weld.gov 9. F21 Consider Biennial Renewal Application for Optional Premises (County) Liquor License and Authorize Chair to Sign — Fritzler Farms, Inc., dba Fritzler Farm Park: Matthew Conroy, Assistant County Attorney, gave a brief overview of the establishment's history and location, stated there are no concerns from referral agencies, and indicated staff recommends approval. Commissioner James moved to approve said biennial renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — Planning: 1. RA Consider Partial Vacation, VAC24-0029, of Use by Special Review Permit, USR16-0031 — Rocky Mountain Midstream, LLC, a Subsidiary of Williams Companies, Inc.: Lindsey Oliver, Department of Planning Services, provided an overview of Use by Special Review Permit, USR16-0031, which has been divided into Lots A and B through Recorded Exemption, RECX17-0168. She stated Lot A, being 30 -acre parcel with a cryogenic natural gas processing facility and Lot B being 210 -acre parcel for an oil and gas support and service facility. She explained the applicant has requested a partial vacation of USR16-0031, to remove Lot B and remain entirely on Lot A to resolve overlapping permits between the two uses. Janice Kinnin, Permitting Supervisor for Williams Companies, Inc., shared the request is a step that was missed when the USR was approved and just needs to be cleaned up. Commissioner James moved to approve said partial vacation. The motion was seconded by Commissioner Peppler and it carried unanimously. El Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
