WHEREAS, Robert Pierce, Route 1, Box 101, Greeley, Colorado,
has requested permission to locate a dairy farm operation on the
following described property, to-wit:
The North Half of the Southwest Quarter of the Northeast
Quarter of the Northwest Quarter (NZSWk-NE4NWI) of
Section 25, Township 6 North, Range 65 West of the 6th
P. M. , Weld County, Colorado, containing five acres,
more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the location of this dairy
farm operation on the above-described premises, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the said requested dairy farm operation is located
in an agricultural zone as set forth by the Weld County Zoning Resolution,
and
WHEREAS, according to Section 3. 3 (3)(c) of the Zoning Resolution
of Weld County, said dairy farm operation may be authorized upon the
approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Weld County Planning Commission, by resolution,
has recommended that this dairy farm operation be approved.
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Robert Pierce, to locate a dairy farm operation on the following described
property, to-wit:
The North Half of the Southwest Quarter of the Northeast
Quarter of the Northwest Quarter (NZSW4NE4NW.) of
Section 25, Township 6 North, Range 65 West of the 6th
P. M. , Weld County, Colorado, containing five acres,
more or less,
as provided by Section 3. 3(3)(c) of the Zoning Resolution of Weld County,
Colorado, is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall proceed with due diligence to con-
struct said dairy farm operation and that he shall have
up to one year from date hereof to begin construction
of said dairy farm operation.
3. That said dairy farm operation shall not contain more
100 head of milk cows at any one time.

regulations shall be followed and complied with in
accordance with the Toning Resolutions of Weld
County, Colorado.

The Weld County Planning Commission held a regular meeting
Tuesday , January 18 , 1972 at 3 : 30 P . M. in the 4th Floor Hearing
Room of the Court House .

MOTION : By Mr . Nix for Dick Deyoe to aid in the Subdivisions
and Zoning and employ a chief building inspector. Second
by Mr . Anderson . A unanimous vote of "Aye" Motion carried .

MOTION : By Mr . Clark to approve the minutes of the last regular

DISCUSSION : Mr. Pierce stated his son-in-law , Mr . Perry, will be
operating the dairy . Mr . Lorenson ' s recommendation is for
approval . The proposed use is compatible with surrounding
land use and zoning . It has been approved by the Health Depart-
ment and the Extension office . There are no soil or water pol -
lution problems . Should be subject to a maximum of 100 head of
milk cows as per the application and construction to begin with-
in one year of approval by the County Commissioners .

SUBJECT : Sign permits
DISCUSSION : There was discussion regarding the date renewals for
sign permits are due and it might be more advantageous to have
it coincide with the State Highway permit. The County permit
must be renewed in June and issued prior to the State permit.
Mr. Connell stated he will do some checking and thought it might
not require a resolution when the regulation isn ' t being changed .

RESOLUTION :
Be it therefore resolved to recommend to the Board of County
Commissioners to amend Section IV , paragrph 5 General Sign
Requirements (3 ) to read : "An annual permit for all permitted
signs shall be obtained in the Weld County Planning Office
during the month of December to coincide with the State permit. "
Motion by John Watson , second by Glen Anderson . A vote of "Aye"
by Anderson , Bowles , Clark , Nix and Anderson . Motion carried .
APPLICANT : Frank Cerovski
DISCUSSION : Mr . Cerovski stated he has a 640 acre . tract approximately
three miles east of Greeley and would like to divide it into 20
acre plots . There are county roads on three sides . Sites would
be 333 ' wide and 1 /2 mile deep . There is Central Weld water
available . He did not intend to put any roads in . Mr . Bowles
informed Mr . Cerovski there is a 3 to 1 ratio on lot sizes .
Mr. Lorenson stated the County Commissioners are not in favor of
16 cuts on a county road . Mr . Cerovski was informed the plat
doesn ' t meet the Subdivision regulations and there isn ' t sufficient
information . Only 4 parcels can be legally sold by metes and
bounds . Mr. Connell stated if he sold more than four parcels with-
out subdividing , he would be subject to Federal prosecution .

DISCUSSION : Mr, Lorenson stated the staff recommends denial as it is
not consistent with the development policy of the Planning Com-
mission . Commercial zoning has been previously denied on this
parcel for the following reasons : applicant failed to prove a
need for the zone change , present zone is complimentary to the
surrounding area and inhabitants of immediate area are opposed
to the rezoning . Petition now supports applicants request and
the R. E. A . also supports the application . A tree nursery is
located on a site near the location . Mr . Deisch stated the appl ; •
cant ' s proposed use would be to house and repair transformers .
The location is at the Washington mine site . Mr . Clark statea
the area wi11 ' be fenced . A warehouse will be built and there will
be very little outside stora ,e . He will use the existing builCing
for an office at this time . There is an existing well on this
5 acres . Mr . Paul stated he would have to see a percolation test
in the area before he could approve it .

by Jr . Anderson . A vote of "Aye" by Anderson ,Bowles , Clark , Nix ,
Watson and Weigand . Motion carried .

DISCUSSION : Mr . Lorenson stated the proposed plat meets the P. U . D .
requirements , it has been approved by the Utility Board . The
PUD doesn ' t show an access onto 47th Avenue . The zoning is aroner
and has been recorded with a stipulation there shall be no access
onto 47th Avenue. Mr . Keenan stated the roads will be private .
The proposal shows the cut onto 47th Ave . because 16th Street
is undeveloped . Mr . Connell stated this could be made a part of
the application to the County Commissioners . It will have to be
a determination by them where it has already been passed and a
resolution drawn showing this specific exclusion .

by Mr. Watson . A vote of "Aye " by Anderson , Bowles , Clark, Nix

DISCUSSION : A new preliminary plat has been submitted. Mr. Glen Paul
stated he has approved this plat as far as percolation tests are
concerned and the water table level is good . Mr . Barrell stated
they have 100 water taps from Central Weld Water under contract .
Plat has been approved by the Utility Board . There was discussion
regarding the size of the water mains . Mr. Lorenson stated they
could submit an application for a variance . Mr. Barrell stated
several of the lots have been sold .

DISCUSSION : Mr. Southard stated he is appearing in behalf of Mr. and
Mr. Rutt regarding the storm drainage from the proposed subdivision

Mr. Bowles read a letter from Mr. C . ' C . Burch stating his
property joins the subdivision on the north and east . The
plat presented is in conflict with the established fence line
in existence . Any attempt to vary the fence boundary will re-
sult in court action . Urged the plat be disapproved . A report
from Byron Ewing , County Engineer was read stating the drainage
report answers the requirements of the County , the storm water
leaving the main collection area will be under far more control
if built according to the specifications in the drainage study
than ever before . The amount of storm water increase due ' to
proposed improvements is nominal and should not effect down
stream channels . Mr . Olhausen stated the disputed area is not
platted but is shown as a drainage easement. Mr. Burch stated
a meeting between him and Mr . Marx and Mr . Olhausen and Mr .
Burch ' s engineer to solve the problem of the property line . Mr .
Olhausen explained to Mr . Southard the development will not have
curb and gutters and will be retaining the water and there will
not be as much run-off as there is at this time.
MOTION : By Mr . Watson to table the matter until the problem of the
property line is resolved . Second by Mr. Nix . A vote of "Aye"
by Anderson , Bowles , Clark , Nix , Matson and Weigand . Motion

DISCUSSION : Mr . Lorenson stated a proposal from Hogan & Associates
has been submitted to the Greeley-Loveland Irrigation Company
stating the amount of runoff will be controlled both in quantity
and as to means of discharge into the Greeley-Loveland Irrigation
Canal . A flume or carrying structure will be installed at the
bridges to carry the additional runoff across the ditch . All
final plans would be submitted to you for approval prior to any
construction , if the project proceeds to construction. The
agreement was signed by Edward Boreson and approved subject to
installation of a flume over Greeley & Loveland Ditch at the
point where the drainage ^asement off of Comanche Court crosses
the ditch . A letter from the attorneys of the Farmers Irrigat-
ing Ditch and Reservoir Company had been received giving a list
of 7 items regarding the drainage which they felt could be worked
out . There was a note attached stating the subdivider is pre-
pared to meet the conditions . Mr . Lorenson stated a letter from
the County Engineer stating the revised drainage study answered
the County ' s requirements and there is a Question about the 50 '
on the east line of the development not being adequately dim-
ensioned . A letter from the Larimer County Planning Commission
recommending the development be denied because of the lack of
utilities . Mr . Lorenson stated the question of cul -de-sacs was
left unresolved . Before final platting a contract with Little
Thompson Water District be submitted . There was a letter from
the Johnstown School District expressing their concern of the
projected 175 students generated from this development. Mr. Paul
stated the area meets the percolation tests . Mr. Olhausen

stated there are adequate utilities .
MOTION : By Mr. Anderson that the matter be taken under advisement.
Second by Mr. Watson . A vote of "Aye" by Anderson , Bowles ,

MOTION : By Mr . Anderson , seconded by Mr . Watson that the Planning
Commission recommend to the Board of County Commissioners that
Indianhead Subdivision not be approved for the following reasons :
(a ) that the general plan for the County does not contemplate
the density proposed for this subdivision ; (b) that the area is
more needed to provide food supply than for residential develop-
ment ; (c ) that there will be inadequate fire and police pro-
tection to persons and property ; (d) that the density proposed
will overload the public schools serving the area ; (e) that
since no new industry or jobs have been created in the area ,
the residents must travel to other areas daily thus overloading
the road system or transportation system ; (f) that evidence of
adequate water supply and sewage disposal is doubtful . Tape 404

Mr. Bowles called the meeting to order.
SUBJECT : Progress report - Comprehensive Plans
DISCUSSION : Bob Leigh gave a report on the progress of the zoning
regulations including the administrative procedures and the
supplemental regulations . The section on mobile homes will
be completed soon . They are working on the subdivision resol -
ution and using the proposed regulations prepared by the State
Land Use Commission . The format will be the basis for the
regulations in Weld County.
SUBJECT : Denver Geologic map
DISCUSSION : Mr. Lorenson presented a preliminary map from the
director of the Front Range Urban Corridor Program showing
the general distribution of geologic units in the 1 ,500 square-
mile area surrounding Denver and will eventually include the
south-west area of Weld County.

SUBJECT : Boulder Thoroughfare Plan
DISCUSSION : Mr. Lorenson. stated Boulder has prepared a new thorough-
fare plan and requested that Weld County reply by 2/11 /72 on
any proposed roadways . He pointed out the roads that will
enter Weld County.
SUBJECT : Utility Board
DISCUSSION : Mr . Lorenson stated the Utility Board has requested an
additional requirement be added to the final plat of a sub-
division or a Planned Unit Development regarding additional
easements that may be necessary in addition to the ones shown
on the plat . This can be incorporated in the new subdivision
regulations .
SUBJECT : Regional Planning Commission
DISCUSSION : Mr. Cruce presented the proposed By-laws and the possib-
ility of combining the Policy Board and the -Advisory Board .
Also the procedure for reviewing A-95 requests .
