HomeMy WebLinkAbout20252739.tiffResolution Findings and Order: Abatement of Nuisance Condition on Property Located at 4223 Grand Teton Road, Greeley, Colorado 80634 - Steven Wood Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, pursuant to the Weld County Code and in accordance with the provisions of C.R.S. §25-1-518, which states, "Removal of Nuisances - The county or district board of health shall examine all nuisances, sources of filth, and causes of sickness, which, in its opinion, may be injurious to the health of the inhabitants, within its town, city, county, city and county, or district, and it shall destroy, remove, or prevent the nuisance, source of filth, or cause of sickness, as the case may require," the Board of Weld County Commissioners has established standards and procedures for the abatement of nuisance condition by reclamation or removal, and Whereas, Parcel #095926304012 located at 4223 Grand Teton Road, Greeley, Colorado 80634; being further described as Lot 28, Block Five (5), Hill -N -Park, a subdivision located in Section 26, Township 5 North, Range 66 West of the 6th P.M., County of Weld, State of Colorado ("the Property"), and Whereas, on the Property is a source of filth that may be injurious to the health of the inhabitants and surrounding properties due to extreme amounts of trash and debris on the property, there being no visible means of human excrement management, multiple individuals residing in makeshift housing on the property, and offensive odors from said waste and filth, thereby constituting a nuisance in need of abatement, and Whereas, on the 11th day of August, 2025, a Weld County Sheriff Civil Process Server posted notification on the Property to the owner, Steven Wood, for the removal of nuisances, and Whereas, despite efforts by staff to resolve said matter, the nuisance has not been abated, and Whereas, the Board of Weld County Commissioners held a public meeting on October 6, 2025, for the purpose of hearing the testimony regarding this matter, at which time property owner Steven Wood was not present, and Whereas, based on the testimony and photographs provided by the Weld the Weld County Attorney's Office at said meeting, and the recommendation of staff, the Board deems it advisable to Order property owner Steven Wood, to abate the nuisance condition on the Property created by the trash within ten (10) days of said meeting, or no later than October 16, 2025, pursuant to C.R.S. §25-1-518, and 5058225 Pages: 1 of 2 10/08/2025 02:18 PM R Fee:$0.00 Carly Koppes, Clerk and Recorder, Weld County , CO 111111inif il141L'ill 'IVACJ1/4+itiGlrNAD Mi*a 111111 cc.. CA(ALL) PLCDE/MN/DA) 2025-2739 HL(sc/Ds/DS), C-r$(E6) HL0058 I o /g/25 Findings and Order: Abatement of Nuisance Condition on Property Located at 4223 Grand Teton Road, Greeley, Colorado 80634 - Steven Wood Page 2 Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that an Order of Abatement be, and hereby is, issued to Steven Wood, pursuant to C.R.S. §25-1-518, whereby the following actions are ordered to abate the nuisance condition on the Property: 1. That Steven Wood shall remedy the public nuisance conditions on the property by removing all trash and debris from the outside of the property, and therefore, abate the nuisance condition by October 16, 2025. Be it further resolved that due to the health hazard posed by the property, the Weld County Attorney's Office is directed to take any and all legal action in the Weld County District Court to abate the nuisance conditions on the property if Steven Wood fails to abate the nuisance conditions by October 16, 2025. Be it further resolved that any final costs for abatement work performed by the County shall become a lien on the property pursuant to C.R.S. §25-1-518. Be it further resolved by the Board that the Clerk to the Board be, and hereby is, directed to record this Resolution in the records of the Weld County Clerk and Recorder. Representing WCDPHE for the inspection was EH Specialist Miguel Garcia and representing Weld County Code Enforcement was Code Compliance Officer Cynthia Villanueva. According to the Weld County Assessor records, the property is owned by Steven R. Woods. As a result of the inspection, it is the opinion of WCDPHE that the property located at 4223 Grand Teton Rd Greeley, Colorado 80634, is in violation of Colorado Revised Statute Section 25-1-518 "Nuisances" (CRS 25-1-518). CRS 25-1-518 states: "Removal of Nuisances - The county or district board of health shall examine all nuisances, sources of filth, and causes of sickness, which, in its opinion, may be injurious to the health of the inhabitants, within its town, city, county, city and county, or district, and it shall destroy, remove, or prevent the nuisance, source of filth, or cause of sickness, as the case may require." The following were found to be sources of a nuisance(s): • Multiple piles of trash and discarded/unusable materials that are excessive and provide harborage conditions for pest. • No visible means of human excrement management which is a source of filth. • Multiple individuals living outside in makeshift housing on the property, with no apparent use of the house located on the property. • Offensive odors resulting from waste and sources of filth. Attached are photos from the inspection, along with submitted photos from the complainant. Maps will be attached showing where the photos were taken.
