Buck, Chair Commissioner Scott K. James, Pro-Tem — Excused Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Angela Snyder Development Review Representative, Aaron Maurice The following business was transacted: I hereby certify that pursuant to a Notice dated May 15, 2025, and duly published May 17, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Josue Alegria Camacho, for Change of Zone, COZ25-0001, from the R-1 (Low -Density Residential) Zone District to the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. ti Angela Snyder, Department of Planning Services, presented a brief summary of the proposal, described the sign posting and location of the site, and explained the Code criteria for the Change of Zone (COZ) request. She stated the site is located within the Coordinated Planning Agreement (CPA) boundary of the Town of Kersey and the City of Evans, and within the three (3) -mile referral area of the Cities of Evans and Greeley and the Town of Kersey. She shared the site is also located within the Airport Overlay District, MS4 area, and Historic Townsites Overlay District. Ms. Snyder entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. Aaron Maurice, Department of Planning Services - Development Review, shared the applicant proposes utilizing the two (2) existing accesses onto Cherry Avenue, which is a paved, local road. He stated the roadway network is adequate; however, the property is located in an MS4 area, which could trigger water quality issues. In response to GC: PL (PE/KW /DA/As /KR) °$/12/25 2025-1596 PL2959 Hearing Certification (COZ25-0001) — Josue Alegria Camacho Page 2 Commissioner Maxey, Mr. Maurice confirmed there are two accesses; including one agricultural permit and one residential permit. In response to Chair Buck, Josue Alegria Camacho, applicant, indicated he had not had contact with any of the Commissioners regarding this case, and agreed to proceed, with only four (4) Commissioners present and Commissioner James being excused. Mr. Camacho explained their farm supports their kids' involvement in 4-H, and they believe in "you grow, you eat". Commissioner Ross expressed his thanks to the applicant for submitting this COZ request. No public testimony was offered concerning this matter. In response to Chair Buck, Mr. Camacho indicated he had reviewed, and agreed to abide by, the Conditions of Approval, as presented Ei The Board reviewed the Conditions of Approval, and no changes or corrections were made. Commissioner Ross moved to approve the request of Josue Alegria Camacho for Change of Zone, COZ25-0001, from the R-1 (Low -Density Residential) Zone District to the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Maxey and it carried unanimously. There being no further discussion, the hearing was completed at 10:12 a.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 2nd day of July, A.D., 2025: Perry L.
