FOREST SERVICE PAYMENT ALLOCATION COMMITTEE (Bankhead Jones Committee Mintues) July 23, 2024 Members present: Commissioner Mike Freeman, Chair Commissioner Scott James Commissioner Kevin James Superintendent Robert Ring (Teams) Superintendent Bret Robinson (Teams) Superintendent Scott Nielson (Teams) Members Absent: None Others Present: Cheryl Pattelli, CFO Jennifer Oftelie, Budget Manager Kerilyn Barstow, Fiscal/Budget Analyst Troy Dannon (Teams, will be replacing Robert Ring) CALL TO ORDER: Mike Freeman, Chair, called the meeting to order at 11:32 a.m. Commissioner Freeman asked for a motion to approve the minutes of the July 11, 2023, Forest Service Payment Allocation Committee. Commissioner James moved to approve the July 11, 2023, minutes. Commissioner Ross seconded that motion. Being no further discussion, the motion was approved unanimously by the committee members. Cheryl Pattelli explained that, in accordance with Title III of Bankhead-Jones Farm Tenant Act, the USDA Forest Service is required to make payments to counties for receipts from USDA Forest Service land from grazing fees and mineral receipts. Weld County will be receiving funds from oil and gas extraction payments from the Pawnee Grasslands located in Weld County. House Bill 09-1250 was passed in 2009 creating methodology to allocate funds which is 25% to education, 25% to county roads and bridges, and 50% split between the two uses as determined by this Board. In 2016 the Board decided to split 50% total to education, 25% school districts and 25% Bright Futures Program, and 50% to roads and bridges. Weld County recently received notification that we will be receiving $12,625,171 in Bankhead- Jones funds. This is down from $18,327,761 last year (2022 funds paid in 2023) and up from $10,069,711 the year before (2021 funds paid in 2022). It was noted by Cheryl Pattelli that there is a lien of approximately $16K against these funds. Staff have made several attempts to contact the Department of Treasury to get detail about this lien and have not been able to get an answer. Cheryl Pattelli further explained that the purpose of this meeting is to review the formula and the allocation amount each year. She referred to the attached 2024 allocation and noted the following: School district portion is allocated based on pupil counts of students residing in Weld County. There is a hold harmless amount for those school districts physically located in the Pawnee Grassland (highlighted on the allocation spreadsheet). Before the legislation was changed only these districts received the school portion of the allocation. The Board did not want to hurt these districts when all remaining Weld County districts were added to the allocation. The hold harmless amounts hadn't changed for years until the Board decided last year to include a CPI increase in the calculation based on the Denver, Aurora, Lakewood CPI. Cheryl Pattelli stated that she attempted to get enrollment numbers from Brighton District 27J on three occasions and has not had any luck. She, therefore, used last year's enrollment figure in the calculation. After a brief discussion Superintendent Ring moved to approve the 2024 allocation formula worksheet showing the amounts to be allocation to the respective Weld County school districts for 2024. Superintendent Robinson seconded the motion. Being no further discussion, the motion was approved unanimously by the committee members. Cheryl Pattelli presented a proposed letter that will be sent to all school districts. Commissioner Ross moved to approve the 2024 letter and Commissioner James seconded the motion. Being no further discussion, the motion was approved unanimously by the committee members. The committee members approved the letter to be sent. Cheryl Pattelli informed the committee per state law the funds are to be distributed no later than September of each year. She indicated the county would plan on distributing the funds to the school districts by the end of July or early August. There was no other business.
