A public hearing was conducted on May 21, 2025, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated April 16, 2025, and duly published
April 18, 2025, in the Greeley Tribune, a public hearing was conducted to consider the
request of the Central Colorado Water Conservancy District, for Use by Special Review
Permit, USR25-0002, for Open Mining and Processing of Minerals (sand and gravel
mining, known as the Sweet Valley Pit) in the A (Agricultural) Zone District.
Karin McDougal, Deputy County Attorney, made this a matter of record.
Chair Pro-Tem James reviewed for the applicant and the public, the procedures to
follow should this case result in a tie vote due to four (4) Commissioners being present
and Commissioner Buck being excused. J.C. York, J & T Consulting, Inc., represented
the applicant, and indicated he had not had contact with any of the Commissioners
regarding this case.
El Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal, the general location of the site, which is in the middle of the Towns of Milliken,
Gilcrest and Platteville, none of which wish to pursue annexation. She stated the applicant
has received an approved Division of Reclamation, Mining, and Safety (DRMS) permit,
to mine 650,000 tons of material, over 12 years, in two (2) phases. She relayed the site
will be reclaimed as water storage reservoirs, provided the number of employees, and

noted all traffic from the site will originate from State Highway 60, then turn west on
County Road (CR) 40, then turn north on a leased roadway through the Meining Cattle
Company. She outlined the hours of operation and shared, per the Department of Public
Health and Environment staff, that open mining is considered a temporary use, therefore,
portabletoilets and bottled water are acceptable. She stated the existing on -site
residence is served by the Central Weld County Water District and an On -site Wastewater
Treatment System. She reviewed the findings of the Noise Modeling Plan, described the
proposed dust control, and mentioned an Air Pollutant Emission's Notice (APEN) had
been obtained. She explained how the application meets the criteria outlined in the Weld
County Code, and relayed notice had been sent to 21 surrounding property owners
(SPOs), with two (2) SPOs responding with concerns of light, dust, noise and truck traffic.
Ms. Snyder discussed correspondence from the surrounding municipalities, displayed
images of the site and surrounding views, and entered the favorable recommendation of
the Planning Commission into the record, as written.
El Mike McRoberts, Department of Planning Services — Development Review, stated
access for the site will be on CR 40, provided the daily traffic counts in the area, and the
anticipated traffic associated with the site, once operational. He relayed Development
Review is requesting an Improvements and Road Maintenance Agreement, as well as
permanent tracking control. In response to Commissioner Maxey, regarding access
through a private property, Mr. McRoberts deferred to the applicant.
Mr. York explained the access was determined after discussions with the Colorado
Department of Transportation (CDOT) and SPOs. He clarified that traffic going to the mine
site, versus traffic going to the existing residence, which will serve as the Central Colorado
Water Conservancy District (CCWCD) office, will use different access points, and the
access going to the mine site will be eliminated when mining is complete. He shared a
PowerPoint presentation (Exhibit D), described CCWCD as a company, relayed the
benefits of the use and stated they received their DRMS permit in December 2024. He
displayed a site plan and reclaimed reservoir map, and described the mining plan and
storage capacity of each cell. He discussed the screening, which will consist of berms,
dust control, traffic details, Noise Analysis, Lighting Plan, and groundwater impacts. He
highlighted the neighborhood outreach they had done, and in response to Commissioner
Maxey, described how they will mitigate the plugged and abandoned wells on the site,
and confirmed they will meet the Residential noise limit at the property line. Responding
to Commissioner Peppier, Mr. York described the purpose and function of the dewatering
well.
El No public testimony was offered concerning this matter.
The Board discussed the Conditions of Approval and Development Standards (DS)
and agreed to strike DS #38 (Sources of light), as lighting is covered in DS #8 (Lighting
Plan).

El No public testimony was offered regarding changes made to the Conditions of
Approval and Development Standards.
Commissioner Ross moved to approve the request of the Central Colorado Water
Conservancy District for Use by Special Review Permit, USR25-0002, for Open Mining
and Processing of Minerals (sand and gravel mining, known as the Sweet Valley Pit) in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and
the Planning Commission, with the Conditions of Approval and Development Standards,
as amended. The motion was seconded by Commissioner Maxey, who applauded the
applicant for their community outreach efforts. The motion carried unanimously, and there
being no further discussion, the hearing was completed at 11:48 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 11th day of June, A.D., 2025:
