FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF EARL MACKEY
The petition of Earl Mackey, Route 1, Box 183, LaSalle, Colorado,
requesting a change of zone from "A" Agricultural District to "E" Es-
tates District of a parcel of land more particularly described as follows,
to-wit:
A parcel of land located in the Southeast Quarter of the North-
east Quarter (SE-INE4) of Section Thirty-two (32), Township
Five (5) North, Range Sixty-five (65) West of the Sixth P. M. ,
Weld County, Colorado, more particularly described as
follows:
Beginning at a point on the east line of said Section 32, a dis-
tance of 430 feet north of the southeast corner of the North-
east Quarter (NED of said section; thence west and parallel
to the north line of said Section 32 a distance of 960 feet,
more or less, to a point; thence south and parallel to the east
line of said section 32 a distance of 430 feet, more or less, to
a point on the south line of the Southeast Quarter of the North-
east Quarter (SEINED of said section; thence east along the
south line of said Southeast Quarter of the Northeast Quarter
(SE4NE4) of said Section 32 to its point of intersection with
the U. P. R. R. right of way; thence northeasterly along said
U. P. R. R. right of way to a point on the east line of said
section 32; thence north along the east line of said Section 32
to the point of beginning; excepting therefrom a 30 foot road
easement along the south line of the Southeast Quarter of the
Northeast Quarter (SE-,'NE-,1) of said section, and along the
northeasterly railroad right of way line of the U. P. R. R. ,
and along the east line of the Southeast Quarter of the Northeast
Quarter (SE4NE4) of said Section 32,
came on for hearing on August 13, 1973, and the Board of County Com-
missioners of the County of Weld, State of Colorado, having heard the
testimony and evidence adduced upon said hearing and having considered
the testimony, evidence and recommendations of the Weld County Planning
Commission filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. The evidence discloses that the applicant failed to sustain the
burden of proof as to the need for a change of zone or that the present
zone is erroneous or that circumstances warrant a change of zone at
this time.
2. The evidence and investigation show that the inhabitants of the
immediate vicinity of the area sought to be rezoned are unanimously
opposed to the change of zone.
3. The evidence discloses that the present zoning is complementary
to the surrounding area, and that rezoning of subject land would not be
compatible with the surrounding land use.
4. Rezoning of subject land would constitute spot zoning and it would
not be consistent with the Weld County Development policy and the Town

of LaSalle's proposed future land use plan.
5. The evidence and investigation show that there is a need for
further study and development of a comprehensive plan for the greater
LaSalle area, which would include the area sought to be rezoned, and
therefore, any rezoning of subject property at this time would be pre-
mature and not in the interest of good planning.
6. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground
for denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has heard the application of Earl Mackey,
Route 1, Box 183, LaSalle, Colorado, for a change of zone from "A"
Agricultural District to "E" Estates District of a parcel of land as
hereinabove recited and made a part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and
by reference are incorporated herein and made a part hereof, and
WHEREAS, the said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission and has given the same such weight as it in its
discretion deems proper, and is now fully advised in the premises.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Earl
Mackey, Route 1, Box 183, LaSalle, Colorado, requesting a change
of zone from "A" Agricultural District to "E" Estates District of a
parcel of land indicated above be, and it hereby is denied on each of
the grounds set forth in the Board's findings therein.
