Dear Kim Ogle:
We have reviewed the information received on February 23, 2024 related to a minor subdivision
("MINK") of 77 acres into 4 industrial lots within 1-2 Medium Industrial Zone District.
Water Supply Demand
A Water Supply Information Summary Sheet was not provided, therefore the estimated water
requirements for the subdivision were not provided.
Source of Water Supply
The proposed water source is the Central Weld County Water (District). A letter for water service
from the District dated December 28, 2023 ("Letter") was provided in the referral material. The
Letter noted that the water is currently available to the property through tap 1683 and that other
taps can be made available. Water service for new taps can be made available provided all
requirements of the District, Northern Colorado Water Conservancy District and the Bureau of
Reclamation are satisfied. We do not know if the applicant has met these other requirements.
The District provided updated information about their water supplies in a letter dated July 29, 2021.
The District primarily relies on Colorado -Big Thompson (C -BT) water to supply retail water to
customers. Currently the District has 2,297 acre-feet of C -BT water left for additional projects.
The yield of C -BT units varies from year to year based on conditions and storage. In addition, the
District continues to develop additional water supplies, including participating in the Northern
Integrated Supply Project (NISP). The District's current share of the NISP is 3,500 acre feet. Water
demands for the District's retail consumers have been around 5,276 acre-feet for 2019-2020.
State Engineer's Office Opinion
Based upon the above and pursuant to sections 30-28-136(1)(h)(I) and 30-28-136(1)(h)(II), C.R.S., it
is our opinion that the proposed water supply is adequate and can be provided without causing
injury to decreed water rights so long as the District is committed to serving the lots.

Additional Comments
The application materials indicate that a stormwater detention structure will be constructed as a
part of this project. The applicant should be aware that unless the structure can meet the
requirements of a "storm water detention and infiltration facility" as defined in section 37-92-
602(8), C.R.S., the structure may be subject to administration by this office. The applicant should
review DWR's Administrative Statement Regarding the Management of Storm Water Detention
Facilities and Post-Wildland Fire Facilities in Colorado, attached, to ensure that the notification,
construction and operation of the proposed structure meets statutory and administrative
requirements. The Applicant is encouraged to use Colorado Stormwater Detention and Infiltration
Facility Notification Portal to meet the notification requirements, located at

Hi Maxwell,
MINF24-0001 appears to be the same development as MINK24-0001. Since the water supply
information submitted is the same and taps have been purchased for all 5 lots (an increase since
when we first commented), this office has no comments in addition to those provided March 5,
2024 (attached).
