WHEREAS, on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS , the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 1473-25-4-RE143 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County , Colorado .
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
A tract of land located in the Southeast Quarter (SEa) ,
Section 25, Township 1 North, Range 65 West of the 6th
P.M. , Weld County, Colorado and being more particularly
described as follows :
Beginning at the Southeast Corner (SECor) of said Section
25 and considering the East line of said Section 25 to
bear North 00°00 ' 00" East and with all other bearings
contained herein relative thereto:
Thence South 89°44 ' 28" West, along the South line of the
Southeast Quarter (SEa) of said Section 25, 2650 .05
feet to the Southwest Corner (SWCor) of the Southeast
Quarter (SEa) of said Section 25;
Thence North 00°00 ' 31" East along the West line of the
Southeast Quarter (SEa) of said Section 25, 2644 . 29 feet
to the Northwest Corner (NWCor) of the Southeast Quarter
(SEa) of said Section 25;
Thence North 89°41' 59" East along the North line of the
Southeast Quarter (SEa) of said Section 25 , 2649. 66 feet
to the Northeast Corner (NECor) of the Southeast Quarter
(SEa) of said Section 25;
Thence South 00°00 ' 00" West along the East line of the
Southeast Quarter (SEa) of said Section 25, 2646. 20 feet
to the point of beginning;
Said tract of land contains 160 .91 Acres which includes
3. 63 acres of County Road Right-of-way leaving a net acreage
of 157. 28 acres.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of Weld County, Colorado, that the
Chairman be and he is hereby authorized to sign the plat of a
division of land determined to be exempt from the definition
of Subdivision No . 1473-25-4-RE143 for recording.

SUBJECT: RECORDED EXEMPTION - LLOYD AND EILEEN LAND, PROJECT NO. 74 1 SUR 0195
In response to your request for a statement regarding the flooding to the
Lloyd and Eileen Land's recorded exemption, we have assembled the following
information:
On July 8, 1974, Mr. Bob Gibson of our firm interviewed a Mr. Ivan Andrews
who has farmed portions of Sections 24 and 25 of Township 1 North, Range
65 West and Section 30 of Township 1 North, Range 64 West for 51 years. Mr.
Andrews states that no flood from Box Elder Creek has ever come within five
feet of Lot "A" in Section 25. He did say that a sump hole near the north-
east corner of the southeast quarter of Section 25 creates minor flooding
immediately after a storm, but more than 40,000 square feet of Lot "A" is
five feet above this flooding.
