Approve Quit Claim Deed for Parcel Adjacent to Bull Seepage Ditch and authorize
Chair to sign — Town of Lochbuie
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board has been presented with a Quit Claim Deed for a Parcel Adjacent to
the Bull Seepage Ditch from the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, to the Town of Lochbuie, commencing upon full execution of signatures, with
further terms and conditions being as stated in said deed; said property beling located in:
NW1/4 of Section 30, Township 1 North,
Range 65 West of the 6th P. M., Weld County,
Colorado, and more particularly described in
said deed
Whereas, after review, the Board deems it advisable to approve said deed, a copy of
which is attached hereto and incorporated herein by reference.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the Quit Claim Deed for a parcel adjacent to the Bull Seepage Ditch from
the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, to the
Town of Lochbuie, be, and hereby is, approved.
Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign
said deed.

QUIT CLAIM DEED
THIS DEED is made this 27th day of January, 2025, from the County of Weld, a political
subdivision of the State of Colorado, by and through the Board of County Commissioners of the
County of Weld, whose address is 1150 O Street, P.O. Box 758, Greeley, Colorado 80632, of the
first part, and to the Town of Lochbuie, a municipal corporation of the state of Colorado, whose
address is 703 County Road 37, Lochbuie, Colorado 80603, of the second part.
WITNESSETH, that the said party of the first part, for and in consideration of the sum of
One Dollar and no/00's ($1.00), and other good and valuable consideration, to the said party of
the first part in hand paid by the said party of the second part, the receipt whereof is hereby
confessed and acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and
by these presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the
second part, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand
which the said party of the first part has in and to the following described lots or parcels of land
situate, lying and being in the County of Weld, State of Colorado, to wit:
A parcel of land in the Northeast Quarter (NE1/4) of Section 30, Township 1 North, Range 65 West
of the 6th P.M., Weld County, Colorado, more particularly described as follows;
Beginning at a point 475 feet north and 30 feet west of the quarter corner common to Sections 29
and 30, Township 1 North, Range 65 West of the 6th P. M., thence west 288.5 feet; thence north
33000 west 167 feet; thence north 38° 50' east 605 feet; thence south 611.5 feet to the point of
beginning, containing in all 3.13 acres, more or less; including the right-of-way of the Bull Seepage
Ditch, said ditch right-of-way containing approximately one-half acre;
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to the
only proper use, benefit and behoof of the said party of the second part, its heirs and assigns
forever.

seal the day and year first above written.

Greetings, Mr. Barker,
On October 1St, 2003, the Town of Lochbuie annexed portions of WCR 39, also adjacent to
our wastewater treatment plant. Due to a failure earlier this week, it is necessary for the Town
to undertake emergency repairs to the culvert that carries water in the Bull Seepage Ditch. We
are currently working with FRICO and adjacent property owners as we begin the urgent repair
project. We discovered that Weld County owns approximately three acres of property adjacent
to WCR 39 along the Bull Seepage Ditch. Please see the attached Lehl deed. If the County no
longer requires ownership of that parcel, the Town of Lochbuie will accept a deed to the
property for one dollar, contingent upon formal acceptance of a quitclaim deed.
