Home My WebLink About720328.tiff cX%/Yt 74 i -1 J RESOLUTION WHEREAS, a public hearing was held on Monday, May 22, 1972, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of R, H. Amen, Route 1, Box 204, Loveland, Colorado, requesting permission permission for expansion of an existing cattle feed lot operation on the following described property, to-wit: Southwest Quarter of the Northeast Quarter (SW*NEI) of Section 19, Township 5 North, Range 67 West of the 6th P. M. , Weld County, Colorado, containing 40 acres, more or less, and WHEREAS, the petitioner was present and represented by counsel, William E. Shade, and WHEREAS, the said requested expansion of an existing cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board-of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, .by the Board of.County Commissioners, that the application of R. H. Amen, Route 1, Box 204, Loveland, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the con- • ditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot is completed, same shall not contain more than 2850 head at any one time. 4. That petitioner shall construct a sealed retention pond as designed by the soil conservation engineer. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dept . of Highways APPEARANCE : Al Chotvacs tape 423 DISCUSSION : Mr. Chotvacs presented a map showing the proposed 34 By-Pass going east. On the northern alternate which was chosen to be constructed , just east of the Kersey bridge , the county road which is between sections 14 and 15 , T5N„ R65W, they have two alternatives . The ultimate is to close that roadway, however they could leave it open temporarily to some future. date when they have completed the diamond inter- change . There will be complete access control from Greeley to Kersey on the By-Pass . They don ' t want people building in the area thinking they will have access to the Highway. Mr. Bowles asked what justification would the County Commissioners have for closing the road at this time .when the road is not under con- struction . Mr. Chotvacs stated they will draw up a three-way agreement with the County that certain county roads will have access and others will not. They just want it understood if someone develops there' they will have to connect up with the frontage road . RESOLUTION : Be it therefore resolved to recommend the closing of County Road #45 access to Highway 34 at a suitable date . Motion by Mr. Weigand , §econd by Mr . Nix . APPEARANCE : Mr. Amen DISCUSSION : Mr. Amen stated he has approximately 1600 head at this time and would like to add 1200 head . The Soil Conservation Service has designed a holding pond which he will construct. The Health Dept. has given their approval and has been reviewed by the County Agent. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations by the staff for a maximum ob 2850 head , construction of the holding pond and construction to begin within one year of the approval by the County Commissioners . Robert Barthold DISCUSSION ; Mr. Lorenson explained there were no staff recommend- ations as they had been informed in the morning that Mr. Barthold was unable to obtain a clear title to the property in question and has located another site for the dog kennel , approximately two miles north . Mr, Lorenson informed Mr. Barthold the new application would have to be processed in the normal way and be placed on the next agenda . This cannot be heard before the County Commissioners earlier than June 12 , 1972 . Mr. Paul would like to review the application before it is approved . Mr. Bowles stated there would be no action taken on the application at this time until the site can be inspected and be heard by the Planning Commission on May 16 , 1972. Mr. Barthold stated he planned to have 40 adult and from 75 to 100 puppies . SUBJECT : Dacono Fire Protection District DISCUSSION : Mr. Lorenson stated Dacono is trying to form a fire protection district but elected not to appear at this time . SUBJECT: Fire and Water Districts DISCUSSION : Mr. Lorenson reported on a meeting held with the Fire Protection District and the Water Districts to review the section of the Subdivision Regulations that are proposed on fire protection . They were of the opinion the regulations should stick to the Fire Underwriters Code . Those present would be will - ing to adhere to those codes and recommend them.. SUBJECT : Next agenda DISCUSSION : Mr. Deyoe reported on some of the items that will be on the next agenda. SUBJECT : Airport zoning DISCUSSION : A proposed zoning map for the airport has been submitted which relates to heighth restrictions for the airport, The in- tention is to have these written in the regulations . 765 • An executive meeting was held at 6 : 00 P. PRESENTATION : Mr. Bowles presented a plaque . to Leonard Bartels in behalf of the Planning Commission for serving on the Commission for seven years . SUBJECT : Housing Inventory DISCUSSION : Susan Shermac of Allan M. Voorhees and Associates 'pre- sented inventory and analysis of housing in the Larimer-Weld Regional Planning area . This includes a summary of all of the data gathered plus suggestions and recommendations and a report on each town . Each town will receive a summary and a copy of the analysis made for their individual town . A mock up of what will be the comprehensive plan package for individual communities was presented. Mr. Lorenson stated there will also be model zoning , model subdivisions , and model annexations that will accompany this . Jim Ohi and Gary Eastman have contacted the towns and are working with them to develop their comprehensive plans and how to implement them. Mr. Bowles reported on the impact Jim Ohi has had on the town board of Keenesburg and the planning people. SUBJECT : Information on over-lay system DISCUSSION : Mr. Lorenson explained Gary Fortner is an intern student hired to determine what land should remain agricultural . Felt that the information he is developing is the best decision making tool we have. He has been working closely with the Ag .Council . Gary explained the information and evaluations that will be gained by the over -lay system in an effort to protect the agricultural land. Mr. Lorenson stated he would like to retain Gary for the remainder of the year so he can continue with the work he has been doing . This can be done without any increase to the budget because of some other circumstances . 766 MOTION : By Mr. Watson to hire Gary Eastman for the remainder of this year. Second by Mr. Nix. Amen has received no complaints but when he contacted the Weld County Planning Commission to secure a permit to enlarge hie opera- tions. they asked him to submit a design for an animal waste disposal system. . - The lots are well graded and the waste collects at the south side of . • the confinement areas. , 1.11 Solution to Problems • , Foreign waters cannot enter the existing feed lots from the west or from the north; however., the roadway along the north end of the proposed new feedlot will be raised approximately one foot above ground level .to divert an estimated 8 cfs of runoff away from the • area. The bunks to be installed along the east side of the new lot - will keep an estimated 13 cfs from entering that side. • The feedlot is divided into 5 long pen sections. The runoff will be • collected at the lower end of each section and piped under the road into the pickup ditch. There will be five 8-inch culverts installed, one at the southeast corner of each pen section. To keep foreign waters from mixing with the flow of waste materials, • a diversion ditch designed for a•capacity of 60 cfs will be constructed along the north or upper side of the pickup ditch east of the con- finement lots. This diversion will have a 10 foot bottom width, 421 sideslopes, 2.0 foot water depth and 0.5' freeboard. The pickup ditch along the lower side of the feed lot will have a minimum grade of 0.2 ft./100 ft., bottom width of 10 feet and flow depth of 1.5 feet. It will be designed to carry 4.5 cfs. There are three existing 18 inch culverts'that will allow the waste material to pass under the railroad tracks. The first culvert will empty into another pickup ditch south of the railroad. This ditch begins approx- imately 550 feet northwest of the proposed holding pond and will deliver the waste material to its inlet; The second culvert empties . directly into the inlet structure at the pond. A concrete division structure. will be installed approximately 80 feet west of the second culvert and the waste from the feed lot may be diverted around this , . culvert that empties directly into the pond inlet and carried..to- the - 3 - - " third culvert whore it can-be used to irrigate and fertilize-a 25 - : acre grass pasture that lies east of the proposed holding pond. - Theholding capacity will be 7.44 acre feet. Amen , Deceased , and Katherine Nell Dewalt , formerly Katherine Nell Amen, -hereinafter called "Grantor" (whether grammatically sing lar or plural) , and Harry Meyer, hereinafter called "Gra tee" . RECITALS Grantee has purchased or is purchasing a certain feedlot know as the "Ray Amen Feed Lot" located in the West half of the NEV4 of Section 19 , Township 5 North, Range 67 West of the 6th P.M . , Weld County , Colorado. 2 . Grantee desires to continue to provide drainage from said feedlot to a certain existing lagoon located in the NWl/4 of the SE]/41 of said Section 19 . Said existing lagoon is presently receiving drainage from said feedlot and additional properties , and is capable of accom- mods ing drainage from said feedlot together with other proper- ties presently draining therein. HEREFORE, for good and valuable consideration, the receipt and ufficiency of which is hereby acknowledge , Grantor hereby gran s , sells , conveys and transfers to the Grantee, Grantee' s heir , personal representatives , successors and assigns, the non- excl sive and permanent easement and right to deposit surface drai age from the Ray Amen Feed Lot into that certain existing abov'e described lagoon, which lagoon is more particularly described on Appendix "A" attached hereto and incorporated herein by this reference , together with the non-exclusive and permanent right to enter and re-enter said lagoon property for the purpose of constructing , maintaining and repairing said lagoon. Grantee shall have all other rights necessary and reasonably inci ent to the full and complete use and enjoyment of the ease- ment and right to enter for the purposes hereinabove granted. . Neither Grantor nor Grantee shall erect or place any per- mane t building , structure or improvements , other than fences and repa ' rs or replacement of lagoon structures, on the described ease ent. ▪ The easement is a non-exclusive easement and right of way and ill be available to the use and benefit of Grantor and Gran or' s personal representatives , heirs , successors and assi ns , non exclusively with Grantee, for the same uses and bene its herein granted by Grantor to Grantee. ▪ All costs of construction, reconstruction, upgrading , open ting , repair, maintenance or replacement of the lagoon stru tures and fixtures shall be paid to the extent of one-half ther of by Grantor and to the extent of one-half thereof by Gran ee. In the event costs are- reasonably incurred by a party here o for those specified purposes and the other party fails to IA cont ibute and pay one-half thereof with thirty ( 30) days after rece pt of written notice of the work accomplished and the costs incu red , then said sum not so contributed and paid shall ther after accrue interest at the rate of 18% per annum and the payi g party shall have the right to pursue all legal and 2 U._/ j equi able remedies for the collection of said costs so reasonably incu red together with accrued interest thereon and together with cost and attorney ' s fees incurred by such collecting party in the remises. • Grantor shall constitute the sole owner of the waters drai ed into or stored in said lagoon from the said Ray Amen Feed Lot r from any other properties. The use of said waters shall , be a complished in the manner and for the purposes , and to the bene it of such lands or otherwise in the sole discretion from time to time , of Grantor. Grantee shall be liable, to the extent allowed by law for loss and damage which shall be caused by any wrongful exercise of the ights herein granted , or by wrongful or negligent act or omis6ion of Grantee or Grantee' s agents, invitees or employees. . Grantor reserves all oil , gas and other minerals in, on or uhder the above described lands subjected to the above described easement. I0 .
