On September 29, 2025, the Colorado Air Pollution Control Division will begin a 30 -day
public comment period for Bayswater Exploration Et Production, LLC - Topaz Tank
battery. A copy of this public notice is enclosed.
Thank you for assisting the division by posting a copy of this notice in your office. A
public copy of this notice is required by Colorado Air Quality Control Commission
regulations. The notice must be available for public inspection for a period of thirty
(30) days from the beginning of the public comment period. Please reference the
public notice for instructions on submitting comments.

Notice of a Proposed Construction Permit Warranting Public Comment
Bayswater Exploration Et Production, LLC - Topaz Tank battery - Weld
Notice Period Begins: September 29, 2025
Notice is hereby given that an application for a proposed project or activity has been submitted to
the Colorado Air Pollution Control Division for the following source of air pollution:
Applicant: Bayswater Exploration Et Production, LLC
Facility: Topaz Tank battery
Well Production Facility
Lot 6 quadrant of Section 6, Township 7N, Range 65W
Weld County
The proposed project or activity is as follows:
The operator has submitted a request for initial construction permit(s) for the crude oil and
produced water storage tanks, as well as gas venting from the vapor recovery tower and
low-pressure separators. All sources are currently authorized under General Permit 10, and this
project will be designated as a new synthetic minor source of volatile organic compounds (VOCs),
in compliance with the Nonattainment New Source Review (NANSR). In addition, crude oil truck
loadout qualifies as APEN-exempt. While APEN-exempt activities do not require public notice, they
are included in this project for completeness.
Bayswater no longer owns or operates the Topaz tank battery, as it has been divested to Prairie
Operating Co., LLC. Through the streamlined transfer of ownership process, these permits will first
be issued under Bayswater and subsequently reissued to Prairie Operating.
The division has determined that this permitting action is subject to public comment requirements
under Colorado Air Quality Control Commission Regulation Number 3, Part B, Section III.C due to
the following reason(s):

• This source is requesting a federally -enforceable limit on the potential to emit to avoid
other requirements. (Regulation Number 3, Part B, Section III.C.1.d.)
The division has made a preliminary determination of approval of the application.
A copy of the application, the division's analysis, and a draft of construction permit number

The division hereby solicits submission of public comments from any interested person concerning
the ability of the proposed project or activity to comply with the applicable standards and
regulations of the commission. The division will receive and consider written public comments for
thirty (30) calendar days after the date of this notice. Comments may be submitted using the
