Approve Request for Waiver of Annexation Impact Report Requirement for Sanger
Annexation and authorize Chair to sign — City of Evans
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, Pursuant to C.R.S. §31-12-108.5(1), the City of Evans has presented a
Request for Waiver of the Annexation Impact Report Requirement for the Sanger
Annexation to the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, for a parcel of land described as follows:
Lot A of Recorded Exemption, RE -3996, and
Lots A and B of Recorded Exemption, RE -3997;
being part of the NW1/4 of Section 26,
Township 5 North, Range 66 West of the
6th P.M., Weld County, Colorado
Whereas, after review, the Board deems it advisable to approve said waiver, a copy of
which is attached hereto and incorporated herein by reference.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the Request for Waiver of the Annexation Impact Report Requirement for
the Sanger Annexation to the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, from the City of Evans for the
aforementioned property described above, be, and hereby is, approved.
Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign
said waiver.

The attached will be on the Board's agenda for approval on Monday, 1/27. All 3 lots combined total 19.3 acres. The
statute allows for a waiver of the requirement when the municipality and the BOCC agree one is not needed. There is
little, if any, impact on County services created by the annexation. More importantly, however, this request opens the
door for further discussion with Evans for the annexation of 4 lots lying on the east side of Hill -n -Park where loud and
disruptive activity occurs. One of those lots is owned by Weld County and 3 are owned by Evans. Evans PD is better
equipped to deal with that issue than Weld County. Those lots are south of these 3 for the Sanger annexation.
I recommend the Board approve the waiver and authorize the Chair's signature.

Please see the attached Annexation Impact Report Waiver for the pending Sanger Annexation. The City of Evans
requests that the waiver be signed by the BOCC chair and returned to me at your earliest convenience.
For reference, the Evans City Council accepted the annexation petition on November 19, 2024. The annexation
hearing is schedule for February 18, 2025.

REQUEST FOR WAIVER OF ANNEXATION IMPACT REPORT REQUIREMENT
January 6, 2025

Weld County, Colorado
Dear Members of the Board:
Pursuant to Section 31-12-108.5(1), C.R.S., the City of Evans hereby requests that the requirement
of an annexation impact report under that section be waived for the following proposed real
property (the "Property"), which is located: approximately 0.17 miles east of Kiowa Drive and
approximately 200 feet north of Mesa Verde Drive. The Property to be annexed (Sanger
Annexation) consists of three legal lots totaling 19.51 acres and is legally described in Exhibit A
attached hereto and incorporated by reference. It is anticipated that the property will be zoned as
follows: R-lE (Estate). In the event you agree to this waiver request, please so indicate below or
in separate correspondence.
