Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel(s): 146725000020 The project proposes to: Change of Zone (COZ) from the A (Agricultural) Zone District to the 1-2 (Medium Industrial) Zone District. ACCESS Development Review has reviewed the application materials related to access and determined the subject parcel will use an existing access on County Road 11 located approximately 2,745 feet south of County Road 6. ROAD AND RIGHT-OF-WAY This portion of County Road 11 is under the jurisdiction of the City and County of Broomfield. The municipality has jurisdiction over access to the road. Please contact the City/County to verify the right-of- way and inquire about any requirements they may have with this COZ. DRAINAGE REQUIREMENTS No Drainage Narrative is required. TRAFFIC REQUIREMENTS No Traffic Narrative is required. CONDITIONS OF APPROVAL The plat shall be amended to delineate the following: 1. This portion of County Road 11 is under the jurisdiction of the City and County of Broomfield. Please contact the City/County to verify the right-of-way. Show and label the right-of-way. Show the approved access on the plat and label with the approved access permit number, if applicable. Include in the label all applicable access types (Agricultural, Commercial, Industrial, and/or Oil and Gas). (Development Review) 2. Show and label (including the reception number) any existing access and/or utility easement within the limits of the subject parcel. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the subject parcel shall be maintained to mitigate any impacts to County Road 11 including damages and/or offsite tracking. (Development Review) 3. The historical flow patterns and runoff amounts will be maintained on the lots created with this lot line adjustment. We recently received Weld County's request for comment regarding the proposed zoning change for 1492 CR 11 in Erie. Although this property lies outside Dacono's current growth boundary, the City is in the process of updating its Comprehensive Plan and is actively evaluating potential modifications of our future growth boundary to include this area. As such, the City respectfully requests continued notice of any development proposals occurring west of County Road 21 and south of County Road 8, extending to the County border. COZ25-0006 for a change of zone for the property known as 1492 County Road 11, Erie, Colorado from Agriculture (A) to Medium Industrial (1-2). The change of zone has been requested to eliminate the need for future modification to the existing approved Use By Special Review permit, and allow for a greater variety of outdoor storage on the parcel. The property is currently used primarily for RV and boat storage. Our office previously provided an email response with no comments on August 10, 2023 for an Amended Use By Special Review under case no. 3MJUSR23-88-588 to allow for a proposed wash station, office, dump station, and maintenance shop at the site. This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101 (10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. A review of our records show no permitted wells constructed on the subject property. The referral documents indicate the property will continue to be served by Central Weld County Water District ("District"). So long as the District is committed to continue serving the property, our office has no comments on the proposed change of zone. Best, Mike Matz, P.E.
