Crary Ann Feuesteln, Recorder a-I RESOLUTION WHEREAS, a public hearing was held on April 30, 1973, in the chambers of the Board of County Commissioners, Weld County 'L.D Courthouse, Greeley, Colorado, for the purpose of hearing the petition of Wass Investments, c/o Doug Sears, 818 12th Street, Greeley, Colorado, requesting approval of site for a sewage treatment facility on ~ the following described property, to-wit: Colony Park, Phase One and Two, being a portion of Section 25, Township 5 North, Range 66 West of the -, 6th P. M. , Weld County, Colorado, more particularly described as follows: Considering the East line of said Section 25 as bearing South and with all bearings contained herein relative thereto. -' Beginning at the Northeast Corner of said Section 25; thence along the East line of said Section 25 South 2200. 00 feet; thence West 470. 00 feet to the true point of beginning; thence South 1000. 00 feet; thence West 700. 00 feet; thence North 400. 00 feet; thence North 35° 37' 40" East 738. 17 feet; thence East 270. 00 feet to the true point of beginning, containing 13. 11 acres, more or less, and, WHEREAS, the petitioner was present and represented by counsel, Mr. Walker Miller, and WHEREAS, there was some opposition to the request of petitioner, and, WHEREAS, the said requested sewage treatment facility is to be located in an agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Re solution of Weld County a sewage treatment facility is permitted upon approval of site by the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County Planning Commission, and WHEREAS, the said Board has carefully considered the petition, evidence, testimony, petitions and remonstrances and given the same such weight as it, in its discretion, deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Wass Investments, c/o Doug Sears, 818 12th Street, Greeley, Colorado, for site approval to locate a sewage treatment facility on the premises indicated above, be, and it hereby is granted under the conditions following: 730015 a. `785 17'6816 2- 1. That any and all sewage treatment facilities to be installed shall be approved by the State Health Department. 2, That petitioner shall proceed with due diligence to construct said sewage treatment facility and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dated this J day of May, A. A letter from the Poudre Valley Rural Electric Association requesting easements between the lots was discussed , whether they should be a total of 15 ' or 30 ' . There was discussion regarding the percolation tests . Mr. Paul stated they complied with the Health Department ' s tables . Mr . Lorenson stated the sub- division is about one-half to one mile outside of the re- charge area . Mr . Bigbee stated this has been approved by the State Water Pollution Committee . There was discussion re- garding fire hydrants . Mr. Bigbee stated according to the regulations , it wasn ' t required for this number of lots . Mr. Lorenson suggested one in the middle on the back lot lines and access for emergency vehicles across •the back be made available . Mr. Bigbee stated he didn ' t object ,to that . The • 'water line is already installed . Mr. Ewing stated he had not ' checked the drainage report as yet . Mr . Mauldin requested the 30 ' easement across the front be labeled utility ease- ment. McLain presented the proposed sewage facility to serve Space City and future development . Mr. Paul stated it has been approved by the State and County Health Depart- ments and the State Water Pollution Commission . They will need to get a permit from the Corp of Engineers once a year . The design will take care of Space City where they are hav- • ing many problems with their septic systems and an addition- al population of 5000. Sec 25 T5 R66 APPEARANCE : Doug Sears DISCUSSION : Mr. Lorenson stated the Planning Commission and County Commissioners approved the Planned Unit Development. of Colony Park several years ago subject to sanitation ser- vices for the area . Evans Sanitation District and Hill ' N Park have denied services to this area . Mr. Sears is pro- posing a Home Owner' s Association to develop a sewage treat- ment facility for the area . Mr. Sears stated they would tie into a Regional treatment facility if it ever comes about . • Mr . Sears stated the system has been approved by the State -an,d the County Health Department . Mr . Paul stated the oper- ator of the plant will have to be certified . • MOTION : By Mr. Mauldin to accept the proposal . Second by Mr. Fouts . A vote of "AYE" by all present except Mr . Kelly who abstained . Motion carried . On further discussion , Mr . Mauldin stated Colony Park had not been approved by the Utility Board as it was tabled when it was presented . Mr . Lorenson further stated , although it had been approved by the Planning Commis- sion and the County Commissioners , it had not been recorded as the Commissioners required signed water and sewer con- tracts . Also if this proposal is approved , the Planned Unit Development will have to be altered. as this facility does not comply with the plat that has been approved . Mr. Sears tated this will be done with the First Filing . APPLICANT : Panhandle Western Pipelines CASE NUMBER : Z-183 SUBJECT : Pipeline eas—fients LOCATION : APPEARANCE : George Minturn DISCUSSION : Mr . Minturn stated they have proposed a 4" gas pipe- line to gather gas from .a well , which will be delivered from • • ' WCUCB - 106 (— • • about 3 miles east of Ft . Lupton below the 52 highway to to an existing pipeline north which is east of Ione corner. • Gas from this well will be delivered to Western Slope Gas through this sy$tem. They are acquiring private ROW all ' the way through , th@9v& permit from the State Highway for cross- • ing and from the County. A heater-treater and a launcher type of thing to clean the pipeline out will be located .at the well . MOTION : By Mr. Fouts to' accept the proposal. . Second by Mr . Mauldin . Planning Commission held an executive meeting Tuesday noon , March 20 , 1973 at the Farm Fare in Lucerne . Mr . Anderson introduced Dean Severin and welcomed him as a new member to the Planning Commission . SUBJECT : Left Hand Water District DISCUSSIA : Mr . Lorenson reported they had met with sgwq of the members and directors of - the Left Hand Water Board 14equested a letter of commitment for water for any building permit in their district before the permit is issued . Permits have been issued and they were not able to serve them. This happened with the new Ramada Inn at DelCamino. Mr . Paul stated they plan to put in a well . Mr. Lorenson stated in all other areas the proof of water is required . Mr. Connell stated this would require an amendment to the regulations . Mr . Lorenson stated these districts are asking for the cooperation of the Planning Commission . Mr . Weigand stated this would have to b,e a joint effort with the adjoining counties where these districts serve more than just Weld County . MOTION : By Mr . Weigand to recommend to the Board of County Commis- sions to require proof of water from the water districts be- fore a building permit can be issued and to coordinate this with the adjacent counties . Second by Mr. Nix. A vote of "Aye" by Anderson , Clark , Elliott , Heitman , Nix , Rothe . Severin and Weigand . Motion carried . DISCUSSION : On further discussion , Mr . Billings stated he will be sending some letters to the water districts . _ SUBJECT : Proposed Comprehensive Plan DISCUSSION : Mr. Lorenson reported on a letter received from the Colorado Division of Planning commending Weld County and its Planning staff on the development of the Plan. Members of the Commission received letters from John Haley regarding the Plan and Mr. Lorenson stated he will respond, to the letter. ANNOUNCEMENT : A tour of the Nuclear Plant at Platteville will be 868 conducted fbr• the Planning Commission_ and. County Commissioners on Tuesday , March 27 , 1973 at 2 :00 P . M. Lorenson stated a recommendation or approval of these developments should not be made until the Commissioners have made a decision on Cimarron Hills . With assumed design values, 90% BOD removal would not quite meet 1978 effluent standards of 20 mg/1 of BOD5. 2. The aerated lagoon is designed on an average water temperature of 10° C, but what happens during at least five months of the year when the aerated portion,is below 10° C; The •lagoon temperature will probably be less than 4° CGduring two to three months of the. year. Even with the. extra 30-day pond, the holding time needed for proper treatment during winter will be borderline. 3. , The proposed lagoon site would only be about one mile from the Hill-N-Park Sanitation District lagoons and 2.5 miles from the Evans Sanitation Districtlagoons.._ Distances to tie into either system would be much shorter. In the area of Colony Park, various sewage treatment facilities have been cropping up'on a private basis as well as public basis. Past experience has shown that irrespective of whether the facility is public or private, the end result is marginal management and effectiveness resulting in obnoxious odors. My clients are unable to afford the professional engineering assistance which would allow them to adequately contest the pro- posed plans of Wass Investments. We can simply note that the past county facilities have not been effectively operated and this leads my clients to believe that the present facilities will not be effectively run. In light of the potential odor source amid the proposed dwelling units at Colony Park, the creation of an excessive number of sanitation districts and the lack of a present regional sewage disposable facility plan, my clients have put Colony Park on notice that their future operations will be closely scrutinized. It appears as though progress is finally being made, and an engineer is being retained this week for a complete feasibility study as will be required for funding participation on sewage lagoon and trunk line facilities in this project. Such diversion shall be strictly temporary in nature, and if said diversion is desired beyond July 1, 1972, a new agreement between Wass Investments and Weld County will be reached at that time. 2.
