Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Memorandum of Understanding for the 19th Judicial District Specialty Court Program Roles and Responsibilities Concerning Driving Under the Influence (DUI) Offenders among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Justice Services and the 19th Judicial District Attorney's Office, the Colorado Judicial Department, by and through the 19th Judicial District Courts, the Colorado State Public Defender's Office, Creative Counseling Services, Geo Group, Law Enforcement, and Monitored Sobriety, commencing upon full execution of signatures, with further terms and conditions being as stated in said memorandum of understanding, and Whereas, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. Thank you. 2025-2248 5A I 0608 • BOARD OF COUNTY COMMISSIONERS PASS-AROUND REVIEW PASS-AROUND TITLE: Consider 19.Judicial District Weld County DUI Court Memorandum of Understanding for State Fiscal Years 2025-2030 DEPARTMENT: Justice Services DATE: July 31,2025 PERSON REQUESTING: Doug ErlerW Brief description of the problem/issue: The 19th Judicial District operates a DUI Specialty Court involving multiple participating agencies.Our department is involved through our Work Release program,which serves many of this program's clients.The Court is seeking to update the MOU for another 5-year term,and the enclosed document reflects their new version.I've made no edits except only to insert our department's name under the"Work Release"section and added my name as the primary signatory for our portion.There are no costs associated with our continued participation,and as noted,we represent just one component of the overall agreement. What options exist for the Board? Consequences:When participants successfully complete the program,often their charges are reduced or dismissed,they avoid jail time,it can serve as a mechanism toward reinstatement of a driver's license,they receive structured treatment,there is true judicial oversight and the peer support and accountability by other participants helps the program to succeed.The negative side?Costs to the participants for treatment and testing, time commitments,and sadly,not everyone succeeds. Impacts:Participants who complete the program are less likely to reoffend,and while a DUI may remain on one's record,completion of the program often helps in future legal and employment situations,and overall,it helps participants improve their lives.Financially,it serves as a cost avoidance to an expensive jail bed. Costs(Current Fiscal Year/Ongoing or Subsequent Fiscal Years):No costs to the County,at least within the MOU. Recommendation: The DUI Specialty Court program is designed to enhance public safety by reducing recidivism of DUI offenders by breaking the cycle of addiction through a combination of individualized treatment,personal accountability and intensive court supervision to promote individual responsibility and citizenship and return a productive member back to the community. Option 1.Authorize placement of the MOU on a future Consent Agenda and allow me to serve as the signatory. Once the MOU is fully executed,I will file with the CTB. Option 2.Authorize placement on a future Hearing agenda for review by the Board and signature by the Chair. Option 3.Work Session. I requested a review of the proposed MOU from the County Attorney's Office,and they approve.They also concur with recommending Option 1.The purpose of the MOU is simply to secure agreement among all participating entities and does not seek the BOCC Chair's signature.Option 1 is the recommended approach. Our department is a consistent contributor to this program,and we fully support its important work.Thank you for your consideration. PARTIES.This Memorandum of Understanding("MOU")is entered into among the following entities(each a"Party"and collectively referred to hereinafter as the"Parties"): a. The Colorado Judicial Department,by and through the 19 Judicial District("District"); b. Office of the District Attorney for the 19 Judicial District c. Office of the Colorado State Public Defender d. Creative Counseling Services e. Weld County Work Release f. B.I.Incorporated,a GEO Group Company g. Law Enforcement h. Monitored Sobriety The Parties agree as follows: 2. RECITALS&PURPOSE.The purpose of this MOU is to clarify the respective roles and expectations of the Parties in District's Weld County DUI Court(hereinafter referred to as the "Program").The Parties are expected to adhere to the Key Components,as issued in January 1997 by the National Association of Drug Court Professionals.Adhering to the Key Components,best practices,and evidence-based strategies have shown to provide reduction in recidivism and increase cost savings for problem-solving courts.In addition,the Parties agree that sharing confidential information concerning participants(hereinafter"Program Participants")is essential for the Program's operation and success,and such sharing of information must be done in a manner as to protect the privacy rights of all persons concerned, as set forth herein. 3. EFFECTIVE DATE&TERM.This MOU will become effective on the date it is fully executed by tie Parties and it shall continue for five years,unless terminated earlier as set forth herein. 4. TERMINATION. a. Any Party other than the 19th Judicial District may terminate its participation in this MOU effective upon thirty days written notice to the other Parties.This MOU shall continue to be effective among the remaining Parties so long as Department determines the purposes of the MOU can still be accomplished. b. The 19th Judicial District may terminate this MOU at any time upon written notice to the other Parties. 5. MUTUAL ROLES AND RESPONSIBILITIES OF THE PARTIES.All Party representatives on the Program team shall adhere to the following requirements: a. Attend Program staffings and dockets; b. Assist in the development and implementation of the Program's policies and procedures; c. Attend training and develop knowledge of the Program's target population. d. Ensure adherence to the Program's policies and procedures,best practices,and the Key MOU 19th JD Problem Solving Courts Fiscal Year 2025-2030 Page 1 of 9 Components; e. Attend meetings,trainings,cross-trainings and conferences as available; f. Cooperate with the other Parties in creating and maintaining trust among the Parties, and offer positive feedback in resolving any conflicts; g. Promote cultural competency within the Parties; h. Ensure adherence to Program policies and procedures; i. Maintain a non-adversarial and constructive atmosphere; j. Recommend incentives for Program compliance and sanctions for Program noncompliance,as appropriate; k. Recommend graduation,dismissal,transfer or termination from the Program in accordance with established guidelines. 1. Protect the integrity of the Program by monitoring effectiveness of community supervision,therapeutic services,and adherence to the Program's policies and procedures. 6. UNIQUE ROLE AND RESPONSIBILITIES OF THE PARTIES.Party representatives on the Program team shall adhere to the following unique requirements: a. DEPARTMENT REPRESENTATIVES 1. Judicial Officer i. Preside over each Program docket and issue orders as appropriate. ii. Ensure a cooperative,non-adversarial atmosphere for the Program team and ensure every team member has an opportunity to share their point of view. iii. Provide formal leadership and support to the Program team. iv. Facilitate team discussion and work towards consensus while maintaining and exercising the final decision in Program matters. v. Deliver coordinated responses to Program participants during Program dockets. vi. Ensure Program participants are afforded Due Process during the Program. vii. Assume the primary role of motivating,coaching,and monitoring program participants. viii. Explain Program requirements and expectations to the program participants. ix. Implement current research regarding behavior modification techniques, motivational interviewing,and strength-based approaches. x. Act as the master of ceremonies at participant graduations. 2. Problem-Solving Court Coordinator i. Oversee the day-to-day operations of the Program. ii. Support and assist all PSC team members. iii. Coordinate and arrange training and team-building activities for the Program team. iv. Ensure referral processes are working and maintain current referral contact information. v. Refer pending participants to Creative Counseling for a Four Plus Assessment. vi. Provide team with screening information for each pending participant. vii. Ensure current and accurate data collection on all Program participants. viii. Manage and maintain systems of organization such as incentive tracking, participant performance,applications,wait lists,budget etc. MOU 19th JD Problem Solving Courts Fiscal Year 2025-2030 Page 2 of 9 ix. Monitor the effectiveness of the Program. x. Ensure consistency of incentives and sanctions while ensuring individual factors are taken into consideration. xi. Research,write,and submit grant applications.Build sustainability by creating long term funding solutions that are not dependent on grant funding. xii. Annually review this M O U with the P art i e s to ensure that each Party is meeting its responsibilities and to determine whether modifications of the MOU are needed. xiii. Collaborate with the treatment provider to ensure effective treatment modalities are being used to address the target population. xiv. Provide an administrative link among the Parties. xv. Forge community partnerships,and schedule and facilitate presentations to the local bar associations,key stakeholders,civic organizations,universities,etc. xvi. Create and regularly review all Program documents. xvii. Ensure all necessary information is presented in order for the Program team to make informed decisions. xviii. Stay current on research regarding behavior modification techniques, motivational interviewing,and the imposition of incentives and sanctions. 3. Probation Officer i. Provide written compliance reports to the Program team at staffings. ii. Be prepared to report verbally at Program dockets. iii. Perform community supervision of Program participants via scheduled appointments,field visits,treatment visits,home visits,community visits,drug testing,etc. iv. Ensure Program participants have met their case plan goals and phase requirements for phase progressions. v. Monitor compliance with Program requirements such as treatment,drug testing, probation,employment,community service,payment of restitution/fees,etc. vi. Establish a strong rapport with each Program participant to encourage Program compliance. vii. Communicate and coordinate with treatment providers concerning each Program participant's treatment,level of care,progress in treatment and any obstacles that the Program participant may be facing that may influence his or her progress in treatment and/or compliance with the Program. viii. Oversee Program participants'drug testing and report all negative,positive, missed,and dilute results,including self-reported use,to the appropriate team members. ix. Monitor the effectiveness of community supervision and therapeutic services. x. Maintain records of Program participant performance. xi. Make ongoing referrals for Program participants that are consistent with both the treatment plan and case plan. xii. Ensure all proper release of information forms are signed and current. xiii. Utilize motivational interviewing techniques when interacting with the target population. xiv. Assist with data collection and data integrity. xvi. File probation revocation complaints as appropriate. b. OFFICE OF THE DISTRICT ATTORNEY 1. Promptly conduct legal screens on Program applicants. 2. Recommend and/or approve Program participants by determining participant eligibility within a reasonable time after having received a complete referral. 3. Obtain victim input regarding a Program plea/sentence as necessary under the Victim Rights Act. 4. Agree that the disclosure of positive drug screens by Program participants,either through admissions or testing results,shall not result in new controlled substances charges or indictments being directed against the Program participant. 5. When appropriate,remind Program participants of potential outcomes if they fail to successfully complete the Program. 6. Ensure Program participants are afforded Due Process during the Program. 7. Offer a Program appropriate plea agreement and sentence to accepted applicants. Prepare plea agreement and sentencing paperwork for the court. c. OFFICE OF THE COLORADO STATE PUBLIC DEFENDER 1. Evaluate the merits of each Program participant's case to make appropriate recommendations regarding admission to the Program,including identifying any legal issues and whether participation in the Program is in the prospective participant's best interests. 2. Assist the Problem-Solving Court Coordinator in the screening process with participants that cannot be contacted,located,or that fail to respond to a request for evaluation by communicating with the potential participant's attorney. 3. As a team member and not as the participants'attorney,encourage Program participants to comply with Program expectations where appropriate. 4. Ensure Program participants are afforded Due Process during the Program. 5. Recommend a sentence for all accepted applicants with the proper legal documents and Program forms. 6. Provide information and updates to other Public Defenders in the District about the Program,and act as a liaison between the Public Defenders in the District and the Program team. d. TREATMENT PROVIDERS 1. Participant in and complete Program orientation. 2. Provide treatment updates at Program staffings. 3. Understand and appreciate differences between traditional treatment and treatment within a problem-solving court program. 4. Design and implement treatment that is evidence-based and specific to the target population. 5. Make treatment recommendations to the Program team regarding Program participants. 6. Immediately notify the Probation Officer and Problem-Solving Court Coordinator of any major treatment violation or concerns. MOU 19th JD Problem Solving Courts Fiscal Year 2025-2030 Page 4 of 9 7. Provide information weekly regarding Program participants'progress to the probation officer to allow the Probation Officer to prepare for staffings. 8. Provide the Program team with insight into behavior change and treatment to allow the team to make informed decisions. 9. Remain abreast of and implement best practices for behavioral modification techniques, motivational interviewing, strength-based approaches, and National Association of Drug Court Professionals best practices,and perform evidence-based treatment. 10.Maintain up to date records of Program participant performance. 11.Conduct regular quality assurance of all treatment and ancillary services. e. WORK RELEASE 1. Provides information to the team about compliance of participants completing a Work Release sentence. 2. Collaborates with treatment provider and Probation Officer to ensure client is scheduled to attend all required program appointments. 3. Provide jail records to the team,when appropriate for a client. f. USEFUL PUBLIC SERVICE/ELECTRONIC HOME MONITORING REPRESENTATIVE 1. Provide written updates prior to court reviews about progress of Useful Public Service hours. 2. Provide level of compliance with all forms of electronic home monitoring. g. LAW ENFORCEMENT 1. Participant in and complete Program orientation. 2. Conduct tasks as necessary, such as systems checks to determine outstanding warrants for arrest and police calls to the residences of Program participants. 3. Provide arrest information on Program applicants to the Program team. 4. Monitor warrants and arrest records of all Program participants. 5. Contact the Probation Officer and Problem-Solving Court Coordinator whenever Program participant noncompliance is observed. 6. Provide bailiffs for the operation and safety of the Program and its participants. 7. Act as a liaison between the Program and any detention facility utilized for participant sanctions. h. MONITORED SOBRIETY REPRESENTATIVE 1. Observe all urinalyses for program participants. 2. Provide level of compliance with all forms of urinalyses. 7. CONFIDENTIALITY;EXCHANGE OF INFORMATION. a. The Parties agree to comply with all applicable federal and state laws and/or regulations regarding the security and confidentiality of information,including,but not limited to 42 C.F.R.Part 2,and to the extent that such regulations apply,45 C.F.R.Parts 160 and 164. b. Confidential information regarding Program participants who have signed proper releases of information may be exchanged only on a need to know basis MOU 19th JD Problem Solving Courts Fiscal Year 2025-2030 Page 5 of 9 between and among authorized persons of the Parties in accordance with the restrictions set forth in the releases.Such confidential information includes,but is not limited to,the following: 1. information that identifies participants; 2. records containing information about disabilities, medical and mental health diagnoses,evaluations or treatment; 3. drug or alcohol treatment informationincluding diagnosis,urinalysis and breath analysis results; 4. information regarding attendance or lack of attendance at treatment sessions; 5. cooperation with the treatment program and prognosis; 6. sex offender evaluation and treatment information; 7. work,school,and social reviews and histories; 8. education records; 9. services or benefits plans; 10.eligibility information,financial information;employment information; 11.placement history; 12.medical,psychological or psychiatric history; 13.information pertaining to drug or alcohol,or HIV/Hep C related care;and 14.Probation records. c. Exchange of confidential information among the Parties shall be limited to purposes that relate directly to the Program,such as:managing or providing services; coordinating service planning and delivery;program evaluation and assessment; developing appropriate treatment recommendations;and implementing incentives and sanctions as they relate to individuals'progress in the Program. d. The format and manner of sharing confidential information shall be governed by any release(s)of information executed by Program participants,but should optimally allow for sharing at scheduled planning and review meetings,in telephone conversations, and in secure email correspondence. e. The sharing of District information and records are subject to restrictions and requirements as set forth in Chief Justice Directive 05-01,available at www.courts.state.co.us 8. PUBLICITY RELEASES.A Party shall not to refer to this MOU or its relationship to any other Party pursuant to this MOU in a manner that states or implies that the Party is endorsed or preferred by any other Party. 9. NO AGENCY OR EMPLOYMENT RELATIONSHIP.The Parties to this MOU are cooperating entities.Nothing contained in this MOU shall be construed to create a legal agency or employment relationship between the Parties.No Party,nor any employee of any Party,shall be deemed to be an agent or employee of another Party.Each Party will be responsible for its acts and those of its employees,agents and subcontractors,if any,during the course of this MOU. 10.NO THIRD PARTY BENEFICIARY.It is expressly understood and agreed that nothing contained herein shall give or allow any claim or right of action by any other or third person not a party to this MOU.It is the express intent of the Parties that any person other than the Parties shall be deemed to be an incidental beneficiary only.
