To the Honorable Board of County Commissioners of Weld County, Colorado: Gentlemen: We, the undersigned, Citizens and Freeholders of your County, residing within two (2) miles of the road herein sought to be laid out, respectfully represent that the necessities of the public require a County wagon road to be laid out as follows, to-wit: Commencing at a point on public highway on the sou' line of section twenty-nine , township six, north, range 65 west of 6th p.m. , where the center line north and south of said section section 29 inter- sects the same. Thence extending north on said center line to the intersection with the south line of right of way of the Union Pacific Railroad -Company (known as the line east from Greeley) . Said point being 80 feet south of center of said section; thence west 30 feet ; thence south parallel with and 30 ft west of said section to the south line thereof; said road to be 30 ft.in width and to consist of 30 feet off the east side of southwest quarter of said section 29, as shown in red ink on annexed map or plat. The undersigned, citizens and freeholders of said county residing within 2 miles of the road above described and sought to be laid out and also the hereinafter described road sought to be vacated,respectfully re- present that the necessities of the public require that the following road heretofore used as a public highway should be vacated by reason of the fact that the construction said Union Pacific Railroad along and adjacent thereto will render the same undesirable as a public highway and the necessity therefor as a highway will no longer exist; which road sought to be vacated is shown on annexed slat in black ink and is described as follows, to-wit: Commencing at the north -and south road on east line of section 29 ,town- ship 6 north, range 65 west , at a point where the east and west center line of said section 29, intersects the same, thence west along said center line of said section 29 to west line of said section 29 intersecting with north and south road along the west line of said section 29 ; said road being 40 feet in width as shown on map filed by Union Colony of Color. ado,but otherwie not designated on records of Weld county, Colorado. The undersigned, Charles F.Deffke, owner of east half of southwest quarto of said section 29, township 6 north, range 65, and upon whose land the whole of said new road petitioned is located, in consideration of the vacating of said old road and opening of said new road does hereby agree to grant right of way for said new road and. has made and executed and herewith tenders to Weld county, a deed of right of way for said new road; it being understood that Union Pacific Railroad Company in consideration of the premises will be at all expense of opening and grading of said new road. .
