HomeMy WebLinkAbout20251367.tiffBOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: Mid -Year Fee changes in County Code (Appendix 5) DEPARTMENT: Finance DATE: 05/14/2025 PERSON REQUESTING: Jennifer Oftelie, on behalf of Esther Gesick, Carly Koppes and David Eisenbraun Brief description of the problem/issue: Due to legislative changes, the Clerk and Recorder needed to enact fee changes to take place July 1, 2025 per state statute. Because of the timing of other changes within Planning, there are two additional fee changes the department would like to include at this same time. The ordinance changes will be read the same days as the fee changes being requested, to ensure county code aligns with the fee schedule. These changes were brought up in April at a work session regarding code changes for 1041s. The affected appendixes are attached, but in short include: General Recording at $43.00 per document, instead of an initial fee and additional page fees. Planning to add a $100 fee for Ag Field Leveling and Reservoir Dredging permits With the separation of the 1041 from the USR process, Planning would like to add the option of filing a 1041 Amendment for $2,500, instead of requiring a new 1041 application to be submitted at the cost of $10,000. What options exist for the Board? Consequences: To not approve a mid -year adjustment, Weld County Code will not be aligned with State Statute or other changes within county code and could cause potential liability and inconsistency with the ordinance changes being approved at the same time. Impacts: To delay first reading would put us behind schedule to get approval before the requirements are effective at the state level on July, 1, 2025. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): Could potentially bring in more revenue and will create clarity and consistency in the process for residents. We're starting our fee study now, which will be done in time for the fall fee ordinance. Do we need to do this fee in code now or could it possibly wait till the end of the year? If we are doing it now, I'd suggest we add the 1041 Amendment fee also ($2,500). Esther, I won't be in Monday, but will look at this closer first thing Tuesday (assuming we're moving forward with it now). I don't want to make any assumptions, so can you please clarify which line item in Appendix 5-I (attached for your convenience) is proposed for the increase? On a separate call, Rudy indicated there is also an approval from $1.25 to $2.50 for the election fee for entities that are coordinating on the election. We typically review fee changes to go through the three reading process and become effective on January 1 of the following year. Clerk and Recorder has to do a midyear change due to legislation, and Esther had mentioned you may have some as well?
