PASS -AROUND REVIEW
PASS -AROUND TITLE: Mid -Year Fee changes in County Code (Appendix 5)
DEPARTMENT: Finance DATE: 05/14/2025
PERSON REQUESTING: Jennifer Oftelie, on behalf of Esther Gesick, Carly Koppes and David Eisenbraun
Brief description of the problem/issue: Due to legislative changes, the Clerk and Recorder needed to enact
fee changes to take place July 1, 2025 per state statute. Because of the timing of other changes within Planning,
there are two additional fee changes the department would like to include at this same time. The ordinance
changes will be read the same days as the fee changes being requested, to ensure county code aligns with the
fee schedule. These changes were brought up in April at a work session regarding code changes for 1041s.
The affected appendixes are attached, but in short include:
General Recording at $43.00 per document, instead of an initial fee and additional page fees.
Planning to add a $100 fee for Ag Field Leveling and Reservoir Dredging permits
With the separation of the 1041 from the USR process, Planning would like to add the option of filing a 1041
Amendment for $2,500, instead of requiring a new 1041 application to be submitted at the cost of $10,000.
What options exist for the Board?
Consequences: To not approve a mid -year adjustment, Weld County Code will not be aligned with State
Statute or other changes within county code and could cause potential liability and inconsistency with the
ordinance changes being approved at the same time.
Impacts: To delay first reading would put us behind schedule to get approval before the requirements
are effective at the state level on July, 1, 2025.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): Could potentially bring in more
revenue and will create clarity and consistency in the process for residents.
Recommendation:
Please allow for the mid -year fee changes to be presented and accepted on first reading on Monday, May 19.
to meet the July 1, 2025 requirements in statute, as well as other code changes to address these issues within
county code.

Re: Time Sensitive - Code ORD #2025-06 (mid -year fee changes)
All:
didn't realize we were doing an ord for a fee for the topsoil mining permits. We're starting our fee study now,
which will be done in time for the fall fee ordinance. Do we need to do this fee in code now or could it possibly
wait till the end of the year?
If we are doing it now, I'd suggest we add the 1041 Amendment fee also ($2,500).
Esther, I won't be in Monday, but will look at this closer first thing Tuesday (assuming we're moving
forward with it now).
Thanks,
Jim

Hi Jim,
I've drafted the Mid -year Fee Ordinance #2025-06, but I need your assistance to get the placement of the fee and
wording correct. I took at stab at where I thought it made sense following regular grading permits, but please let
me know if you have a different preference.
First Reading is scheduled to go before the Board on Monday, May 19th, so I will need your edits finalized no later
than 5/14 so we can get the document read to audio and listed on the Agenda.
Thank you!

Hi Carly - Thanks for the confirmation on the dates. I don't want to make any assumptions, so can you please
clarify which line item in Appendix 5-I (attached for your convenience) is proposed for the increase?
On a separate call, Rudy indicated there is also an approval from $1.25 to $2.50 for the election fee for entities that
are coordinating on the election. I'm not able to locate the referenced former 2015 Resolution, but I'm wondering if
that should perhaps be part of this Fee appendix, rather than a Resolution.
Thoughts?

Hi Carly. Hope you all are doing well over there. We had talked last year about perhaps having a midyear fee
change for Clerk and Recorder based on legislation changes. Esther was saying Planning also has a change that
needs to happen, so I wanted to verify — are we ready to move forward with that? Please keep Esther in the loop on
what we need to do, as she is the brains behind everything that happens.
Thanks so much, and have a good weekend everyone!

RE: mid -year fee changes
Yes, all I want to include in the mid -year is the $100 fee for the new Ag Field Leveling and Reservoir Dredging
permit.
Everything else can wait until we complete the fee study and provide recommendations from that.
Thanks all,
David

Hi David,
As a friendly reminder, the fee I was referring to is proposed $100.00 for the DRMS Ag Mining Permits. I'm thinking it
could be added somewhere in Appendix 5-J.
Thoughts?

I forgot to ask you both about this yesterday. We typically review fee changes to go through the three reading
process and become effective on January 1 of the following year. Clerk and Recorder has to do a midyear change
due to legislation, and Esther had mentioned you may have some as well? Is that the case, or are we going to wait
until the request to everyone is made after budgets are submitted?
I attached last year's request here, and the timeline below is what we are planning for the Clerk and Recorder. Did
you want to jump in on that, or hold off? I copied Esther so she is also aware, and because she makes the magic
actually happen.
