HomeMy WebLinkAbout730017.tiff FINDINGS AND RESOLUTION CONCERNING CHANGE OF ZONE PETITION OF JERRY BIGBEE The petition of Jerry Bigbee, 412 N. 71st Avenue, Greeley, Colorado, requesting a change of zone from "A" Agricultural District to Mobile Home District, "MH-UD" - UNIT DEVELOPMENT of a parcel of land more particularly described as follows, to-wit: A tract of land in the Northeast Quarter (NE4) of Section Eight (8), Township Five (5) North, Range Sixty-seven (67) West of the 6th P. M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast corner of Section 8, Township 5 North, Range 67, then 90° 00' 00" W 320. 32 feet, then along the South right-of-way of the Great Western Railroad 1, 489. 16 feet, then S 30° 14' 44" E 850. 16 feet, then N 89° 54' 17" E 1, 180 feet, then 0° 00' 00" E 1, 401 feet to the true point of beginning, came on for hearing on November 13, 1972, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a change of zone or that the present zone is erroneous or that circumstances warrant a change of zone at that time. 2. The evidence shows that the inhabitants of the immediate vicinity of the area sought to be rezoned are unanimously opposed to the change of zone. 3. The evidence discloses that the present zoning is complementary to the surrounding area, and that rezoning of subject land would not be compatible with the surrounding land use. 4. Rezoning of subject land would constitute spot zoning and would not be consistent with the Weld County Development policy. 5. The evidence and investigation shows that there is a need for a study and development of a comprehensive plan for the greater Greeley and Windsor areas, which would include the area sought to be rezoned, and therefore, any rezoning of subject property at this time would be premature and not in the interest of good planning. 6. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of the change of zone. 730017 RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Jerry Bigbee, 412 N. 71st Avenue, Greeley, Colorado, for a change of zone from "A" Agricultural District to Mobile Home District, "MH-UD" - UNIT DEVELOPMENT of a parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission and has given the same such weight as it in its discretion deems proper, and is now fully advised in the premises. NOW, THEREFORE, BE IT RESOLVED, that the petition of Jerry Bigbee, 412 N. 71st Avenue, Greeley, Colorado, requesting a change of zone from "A" Agricultural District to Mobile Home District, "MH-UD" - UNIT DEVELOPMENT of a parcel of land indicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. They are as follows : 1 . It is questionable whether agricultural water is avail - able to perform the proposed uses . I feel the use of tap water will prohibit an economic return for the owners . 2 . The people buying trailers or modular units meeting tPi2 eht trailer code but not the Uniform Building l Code has a tendency to draw potential buyers that will be Economically boarderline in nature and even though a com- mittment is made initially , that the project would not be continued . The County would end up with pure trailer units , not of an agricultural nature . 3 . If the proposal did succeed initially , Cimarron Hills which has a total of 2 . 2 acres per unit and that includes all of the common open spaces „Gutd allows little possi - bility of expansion for a successful agricultural pro- ject . 4 . A comparison could be made with the Ranch Eggs Subdiv- ision where 5 acres is the minimum lot size and water has been a real problem there . Successful egg operations have expanded to 10 acre sites and there has been a general tendency to acquire more acreage . Therefore in conclusion , it is my opinion that the projects would die bQcause of money limitations due to the nature of the buyers and space limitations in case of successful opera- tion . Mr. Bigbee intends to use the land for mobil homesite-s with -septic tank filter fields for on-site sewage disposal. i The area is mapped (see attached sketch) as 40-B and 4D-C, Colby loam, 1-3 and 3-5/, slope; 41_B, Weld loam, 1-3% slope; X5_3-1), Kim loam, 5-9% slope -and 84-DE, _Tassel sandy loam, -5-20% slope. The Colby, Weld and Kim soils are -all deep, well drained soils with i moderate to moderately slow permeability. The Colby and Weld soils are somewhat finer textured than the Kim soils and -have moderate limitations for septic tank filter fields, ;whereas the Kim soils h-ave only slight limitations. The Weld _soil has a heavy clay loam horizon at 8 to 10 inches which extends to about 18 to 20 inches, and -has a moderate shrink-swell potential. The Tass-el soils are shallow soils with sandstone between 12 and 20 inches. This soil usually has some outcroppings of sandstone. _The Tassel soils have severe limitations for septic tank filter fields. The area is not subject ' to flooding end any excess surface water is carried away by two large draws which drain..- to the north. The soil survey is made on the basis of 4D inch borings, although in most cases the borings are made to depths of 50 to -60 inches . The district is prepared to serve the children in the Windsor schools. The only suggestion that the Board of Education is making is that a shelter be provided, at the developer's expense, for children waiting to hoard school busses at the perimeter of the development and that the bus stop or loading point be provided just off the main traveled roads hut not located within the interior of the development. Lorenson stated Jefferson County has put their regulations in a loose leaf binder and they charge an initial fee of $10. 00 and keep a list . Any changes that occur are mailed to the purchaser and instructed which pages to remove and where to insert the new ones . Mr. Lorenson suggested charging $15 . 00 for this service . MOTION : By Mr .
