A public hearing was conducted on August 20, 2025, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated July 16, 2025, and duly published July 18,
2025, in the Greeley Tribune, a public hearing was conducted to consider the request of
Bias Reyna Diaz, for COZ25-0003, from the A (Agricultural) Zone District to the
C-3 (Business Commercial) Zone District. Karin McDougal, Deputy County Attorney,
made this a matter of record.
Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal, described the sign posting, and shared the applicant was encouraged to annex
to the City of Greeley; however, the applicant was not interested in annexing and the City
of Greeley had no concerns. She reviewed the approval criteria and indicated staff
believes the request is consistent with the Comprehensive Plan, based on a review of
existing uses in the area, as well as uses allowed in the proposed zone district. She
reviewed the water and sewer provisions, sharing the site is currently served by the North
Weld County Water District and utilizing an unpermitted septic system, thus an Onsite
Wastewater Treatment System will be required for a commercial business. Ms. Snyder
stated the site will be accessed from East 16th Street, which is a paved local road, and it
is located in Airport Overlay District and Historic Townsites Overlay District. Ms. Snyder
also confirmed the size is not conducive for mining, and the soils are suitable for
commercial development. She entered the favorable recommendation of the Planning
Commission into the record, as written, and displayed images of the site and surrounding
views.

Mike McRoberts, Department of Planning Services, Development Review, stated access
is on East 16th Street, which is a paved local road, meets the criteria for a COZ, and
meets the minimum width requirements.
Mark Taylor, Alles, Taylor, and Duke, represented the applicant, and in response to Chair
Buck, indicated they had not had contact with any of the Commissioners regarding this
case. Mr. Taylor stated he has nothing to add. In response to Commissioner James,
Mr. Taylor stated he has completed about 90% of the design of the sewer system.
No public testimony was offered concerning this matter.
In response to Chair Buck, Mr. Taylor indicated they have reviewed the Conditions of
Approval, as presented and have no requested changes.
The Board reviewed the Conditions of Approval and no changes or corrections were
made.
Commissioner Maxey moved to approve the request of Blas Reyna Diaz for COZ25-0003,
from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval, as presented. The motion was seconded by Commissioner Ross,
and it carried unanimously. There being no further discussion, the hearing was completed
at 10:12 a.m. (Clerk's Note: Teams recording start timestamp 4:53)
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 3rd day of September, A.D., 2025:
