separate sheet. If a question does not pertain to your proposal, please respond with an

1. Describe the purpose of the proposed Change of Zone.
We propose to change the zoning for this 409 -acre property from A (Agricultural) Zone District to I-1
(Light Industrial) Zone District.
2. Describe the current and previous use of the land.
The current and previous use of the land consisted of farming/grazing and oil and gas development.
3. Describe the proximity of the proposed use to residences.
The Property borders four parcels that have rural residences not owned or controlled by the
applicant. In addition, there are three residences across County Road 21 and four other residences
across County Road 2 in Adams County.
4. Explain how the proposed rezoning will correct what the applicant perceives as faulty
zoning, or how the proposed rezoning will fit with what the applicant perceives as the
changing conditions in the area.
We believe the following factors support this property being rezoned:
• The subject Property is in an area of southwestern Weld County designated as Urban/Non-
Urban Mix in the Comprehensive Plan Map, including being only 1/2 mile east of a Weld
County Opportunity Zone.
• County Road 2 and County Road 6 both provide excellent transportation connections to both
1-25 and Highway 85.
• There are limited residences in the area.
• The farm ground is not high producing.
• There are several industrial developments nearby including Xcel energy's gas facility, an
industrial painting shop, an RV storage facility, an indoor storage facility, several industrial
storage yards, and extensive oil and gas production facilities.
• Just across County Road 2 to the south of the Property, 1,800 residential units are currently
under review in Adams County
• Two rezonings were recently approved by Weld County just west of the Property. A 60 -acre
rezone from A (Agricultural) Zone District to C-3 (Business Commercial) Zone District located
a 1/4 of a mile away from the Property and a 35 -acre parcel A (Agricultural) Zone District to C-
3 (Business Commercial) Zone District located a 3/4 of a mile away from the Property.
5. Explain how the uses allowed by the proposed rezoning will be compatible with the
surrounding land uses. Include a description of existing land uses for all properties adjacent
to the subject property.
As mentioned above, the overall area is well developed with various industrial uses. The adjoining
properties have the following uses:
• East — Farming and oil and gas development.
• West — Across County Road 21 there is farming, oil and gas development, and three rural
residences.
• North — Four separate rural residences on 5 to 36 -acre properties.
• South -Across County Road 2 in Adams County there are four separate residences on 1 -acre
lots.
6. Does the soil report indicate the existence of moderate or severe soil limitations? If so,
detail the methods to be employed to mitigate the limitations for the uses proposed.
The NRCS Web Soil Survey does not indicate the existence of moderate or several soil limitations.
7. Explain how this proposal is consistent with the Weld County Comprehensive Plan per
Chapter 22 of the Weld County Code.
I-1 uses are consistent with Chapter 22 in all respects. First, it adheres to each of the four guiding
principles in the following ways:
The I-1 zone district will respect the agricultural heritage within the County by not inhibiting
agricultural uses. This is because the aspects/effects of agriculture that might otherwise be
considered a "nuisance" for other types of development (residential development, for example) have
n o bearing on the uses allowed under the I-1 zone district. Additionally, consider that most I-1 uses
are typically closed facilities insulated from the exterior environment. This means no complaints or
concerns based on dust, noise, odor, light or any other emissions that might come from agricultural
u ses, nor any complaints about the time of day at which the agricultural activity may occur.
-1 uses are the flag bearer for private property rights because of its "good neighbor" qualities, simply
existing next door without interfering with or infringing upon the rights of others. The uses listed under
I-1 are unobtrusive based on dust, noise, odor and light.
The I-1 zoning promotes economic growth and stability in a few ways. First, I-1 uses provides fees,
u se taxes and property taxes to local government by virtue of the investment required to construct
facilities and equipment, but also by the assessed valuation of the facility after its
construction. Second, the I-1 zoning promotes growth by providing uses that can promote
e mployment in Weld County. Finally, I-1 zoning promotes stability by generally requiring fewer Weld
County services when compared to many other zoning districts.
The I-1 zoning protects and enhances the health, safety and general welfare of the citizens of Weld
County in a few ways. First, the I-1 zoning contributes to the vitality of the County by helping to create
a balanced economy rooted in the potential for new and diverse business sectors; one which is
compatible with existing agriculture. Second, I-1 investments represent an extraordinary investment
which is anchored in reliability and longevity, key qualities for a stable future. Finally, the fees and
taxes generated by I-1 development exceed the scant level of services which I-1 requires thus
generating a surplus of Weld County resources which can promote the needs and goals of the
citizens in other ways.
8. Explain how this proposal will be compatible with future development of the surrounding
area or adopted master plans of affected municipalities.
The subject Property is in an area of southwestern Weld County designated as Urban/Non-Urban Mix
in the Comprehensive Plan Map, including being only 1/2 mile east of a Weld County Opportunity
Zone. The I-1 zoning fits nicely within this category as it is an urban type of use which is also highly
compatible with existing non -urban (agricultural) uses. The nearest unincorporated communities
are Todd Creek (directly south) and Wattenberg (east H/- 1 mile). The nearest municipalities are
Brighton (southeast +/- 2 miles), Fort Lupton (northeast +/- 2.25 miles), Thornton (southwest +/- 1.5
miles), and Dacono (northwest H/- 2.75 miles). The location of the subject Property, therefore, is the
geographic midpoint amongst the three municipalities but too far from each for incorporation today.
9. Explain how this proposal impacts the protection of the health, safety and welfare of the
inhabitants of the neighborhood and the County.
The nearest Weld County inhabitants are rural farmhouses on agriculture lands surrounding the
subject Property. As previously discussed, the I-1 uses are compatible with agriculture and will not
inhibit or conflict with surrounding farms. As previously discussed, the reasons for the compatibility
are many. The primary reason is that I-1 uses are generally self-contained facility carefully insulated
from the exterior and thus unsusceptible to dust, noise, odors, lights and other potential hazards or
"nuisances" that might be otherwise associated with agricultural activity. For this and other reasons,
I-1 will not displace any existing Weld County inhabitants or agriculture.
Finally, I-1 uses can generate a surplus of Weld County resources that may be used to provide other
services for the health, safety and welfare of the County. This will occur because I-1 uses can
generate significant fees, use taxes and property taxes while requiring few County services.
10. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal
is located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites
Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by
the County.
The Property is not located within an Overlay Zoning District or a Special Flood Hazard Area.

The Property currently has five separate access points along County Road 21. Two of these provide access
to agricultural structures and substantial portions of the Property (150' north of CR 2 & 4,900' north of CR 2),
one provides access to former oil and gas operations (1,975' north of CR 2), and two provide access to
homes on the Property (3,775' north of CR 2 and 5,900' north of CR 2). Future access points will be
determined during the Site Plan process.
2. Describe any anticipated change(s) to an existing access, if applicable.

There are access gates at each of the existing access points. Future access gates will be determined during
the Site Plan process.

On the opposite side of CR 21, there are 11 access points. Seven of these are for oil and gas operations
(650' from CR 2, 1,250' from CR 2, 1,790' from CR 2, 2,650' from CR 2, 3,225' from CR 2, 4,865' from CR 2,
6,395' from CR 2) three are for homesteads (140' from CR 2, 435' from CR 2, 6,195' from CR 2), and one is
for CR 4 (5,280' from CR 2).
On the opposite side of CR 2, there are two access points, Havana Street, 420' from CR 2, and an oil and
gas road 1,035' from CR 2.
5. Describe any difficulties seeing oncoming traffic from an existing access and any anticipated
difficulties seeing oncoming traffic from a proposed access.
There are no site issues with the existing access points and future access points will be designed to avoid
any issues.
6. Describe any horizontal curve (using terms like mild curve, sharp curve, reverse curve, etc.) in the
vicinity of an existing or proposed access.
There are no horizontal curves nearby.
7. Describe the topography (using terms like flat, slight hills, steep hills, etc.) of the road in the vicinity
of an existing or proposed access.
The road is flat at the existing access points and the lack of topography on the Property will make any future
access points flat as well.

1. Discuss the existing and proposed potable water source. If utilizing a drinking water well, include
either the well permit or well permit application that was submitted to the State Division of Water
Resources. If utilizing a public water tap, include a will serve letter from the Water District, a tap or
meter number, or a copy of the water bill.
We are located within the Todd Creek Village Metro District water & sewer service area. A will -serve letter from
them is included in the submittal package. In the past potable water came from a small onsite well that is no
longer operational and it will be removed with development.
2. Discuss the existing and proposed sewage disposal system is on the property. If utilizing an existing
on -site wastewater treatment system (OWTS), provide the OWTS permit number. If there is no permit
due to the age of the existing system, apply for a permit through the Department of Public Health and
Environment prior to submitting this application. If a new OWTS system will be installed, please state
"a new on -site wastewater treatment system is proposed." Only propose portable toilets if the use is
consistent with the Department of Public Health and Environment's potable toilet policy.

Dear Mr. Hengel;
At your request, Western Environment and Ecology, Inc. (Western Environment) performed
an assessment of the economic mineral potential of 408.59 acres within Sections 26 and 35,
Township 1 North, Range 67 West in Weld County, Colorado (Figure 1 & 2). This assessment was
performed by review of the files maintained at the Colorado Geological Survey (CGS), Colorado
Division of Reclamation, Mining and Safety (DRMS), Colorado Energy and Carbon Management
Commission (ECMC), the United States Geological Survey (USGS) and a site inspection performed
by Western Environment on May 16th, 2024.
The purpose of the assessment was to provide the Weld County Planning Commission and
the Board of County Commissioners with information needed to "determine whether a
commercial mineral deposit is contained on or under the subject properties".
The subject site occurs in the extreme southern portion of the County, and is located
approximately 2 miles west of the City of Brighton and about 5 miles south of Fort Lupton (Figure
1). The South Platte River is present approximately 2 miles east of the subject site.
Geological Overview of Weld County, Colorado
Weld County is located in the northern Denver-Julesburg Basin, an asymmetrical structural
feature that consists of two sub -basins, the Cheyenne and Denver. The surface geology is primarily
of Quaternary "eolium", including wind-blown silt (loess) and wind drifted stabilized sand dunes and
gravels. In the western part of the County, the Paleocene and Upper Cretaceous Denver and Upper
Cretaceous Arapahoe Formations the Upper Cretaceous Laramie Formation and Fox Hills Sandstone
and a transition member of the Pierre Shale out crop along the major rivers and streams. Alluvium
underlies the flood plains of the rivers and perennial streams and adjacent terraces. The eastern half
of Weld County consists of the Pierre Shale and alluvial deposits associated with the flood plains of
the rivers.
Oil and Gas Resources
Weld County has several oil and gas fields and has experienced exponential increases in
petroleum production in the last 20 years. In 2023, the County produced 990,047,638 million cubic
feet of gas and 133,682,706 barrels of oil (ECMC). This placed the county first in annual gas and oil
production among Colorado's 35 gas and 29 oil producing counties.
There are eight producing horizons in Weld County; the Sussex (Terry) Sandstone in the
Pierre Shale, the Shannon (Hygiene) Sandstone in the Pierre Shale, the Smokey Hill and Fort Hays
members of the Niobrara, the Codell Sandstone, the Upper Cretaceous D sandstone, the Muddy (J)
sandstone, and Permian Lyons and upper Fountain Formations. The two primary plays in Weld

County are the Upper Cretaceous D and J sandstone of the Dakota Group and what was the source of
the recent increase in production, the Cretaceous Niobrara Formation. Sections 26 and 35 lie within
the Wattenburg and Spindle fields that produce from the Lower Cretaceous Dakota D & J Sand and
the Codell Sands, the Niobrara, Codell, and Sussex Formations.
Metallic Mineral Resources
No significant metal mining districts are located in Weld County. However, in the 1970s
several uranium occurrences were discovered in north central portions of the County near the Town
of Grover. There is no information on the grade or potential tonnage of these occurrences. These
occurrences were explored as solution mining operations; however, none of which were
economically successful. The DRMS lists these occurrences in the Lance Formation, which is
stratigraphically equivalent to the Laramie Formation -Fox Hills Sandstone.
Industrial Mineral Resources and Construction Materials
No industrial mineral operations occur in Weld, County. However, construction materials
consisting of alluvial sand and gravel adjacent to the South Platte River are major resources.
Coal Resources
Weld County contains two major coal producing basins, the Denver and the Cheyenne. Coal
in these two basins occur in the lower 50 to 275 feet of the Cretaceous Laramie Formation. The
highest quality and most productive coals occur in the western part of the Denver Basin in the
Boulder/Weld Field. Here the Laramie Formation coal beds have heat values of between 8,500 and
10,000 Btu's in seams 5 to 10 feet thick. Almost all of the production in the Boulder/Weld Field was
from underground mines. The last mine to close in this field was the Lincoln Mine in 1979. This
mine was extracting coal from a depth of 450 feet.
Aerial Geology, Section 26 & 35
The geology of Sections 26 and 35 consists primarily of Pleistocene Loess and Upper
Cretaceous Denver Formation (Figure 3). The Piney Creek Alluvium adjacent to the South Platte
River, approximately 1 mile to the east of the subject site, is a major source of sand and gravel in
Weld County. The aggregate mining operation closest to the subject property, the Parker-Dersham
Resource pit, located 1.25 miles to the east.
According to the Geologic Map of the Fort Lupton Quadrangle, Weld and Adams County
(USGS GQ-397) approximately 11 acres of Quaternary Alluvium is shown to be present on the
western portion of the subject site (Figure 3). During the site inspection this area was evaluated for
potential sand and gravel resources and identified no indication of economic sand and gravel
resources on the subject property (see attached photos).
Probability of Extraction of Minerals by Surface Mining
Western Environment reviewed the geologic information available on the 408.59 acre Todd
Creek property to evaluate the potential for mineral occurrence. The potential for metallic minerals
was eliminated due to lack of occurrence in Weld County. Uranium, although present in the extreme
north central portion of the County was eliminated because of dissimilar geology. The coal -bearing
Laramie Formation is located beneath the subject property. However, the economic coal seams
occur approximately 1,000 feet below the surface. This depth and the reduced reliance for coal
eliminate it as an viable resource. No construction materials, including sand and gravel, occur on the
Todd Creek project.
The records of the Colorado Energy & Carbon Commission indicate that twenty six wells are
currently producing or have produced from the area on and adjacent to the subject property. These
wells are part of the Spindle and Wattenburg Fields and are extracting from the Cretaceous Sussex,
Niobrara, Codell and Dakota D & J Sands at depths ranging from 4,170 to 17,685 feet.
It is the opinion of Western Environment that, other than petroleum resources, no
commercial mineral deposits are present on the 408.59 acre Todd Creek site.

ridges. Derived by erosion of older gravels. Most
deposits may be correlative with Slocum Alluvium,
but some high deposits east of South Platte River may
be of Kansan or Nebraskan age. Thickness generally
2-8 feet
Verdos Alluvium
Sandy pebble -cobble gravel capping intermediate hills
west of South Platte River. Predominantly meta-
morphic and igneous rock types; many roundstones
are deeply 'weathered and crumbly. Almost entirely
cemented by white caliche below thin moderate brown
B soil horizon. About 10 feet thick
Rocky Flats Alluvium
Pebbles, cobbles, and a few small boulders capping
highest hills west of South Platte River. Rocks in-
clude sedimentary, igneous, and meta morphic types;
many are deeply weathered, crumbly, or broken.
Some deposits are thoroughly impregnated with white
caliche through a thickness of 6feet or more, indi-
cating these may be remnants of an Aftonian soil
profile. Thickness about 4-12 feet
Pre -Rocky Fiats Alluvium
Alluvial sandy gravel deposits capping highest hills on
main divide east of South Platte River. Rolm/sista/nes
are of many different rock types including sedimen-
tary as well as igneous and metamorphic rocks; many
are deeply weathered and crumbly or broken in place.
Mainly pebbles and cobbles with a few boulders as
much as 1.5 feet in diameter; includes some stratified
coarse arkosic sand and granule gravel. impregnated
with white caliche through thickness of several feet;
iron oxide and black manganese oxide in some de-
posits, especially at the base. Thickness about 5-15feet

Dawson Formation
Mostly dark -gray shale and clay with some yellowish -
gray siltstone and partly limonitic arkosic sandstone;
ironstone concretions as much as 4feet in diameter,
especially in lower part; rare lenticular coal beds
less than 3 feet thick. Some sandstone beds and iron-
stone concretions have grains ranging from coarse
sand to small pebble size; most sandstone is non -
calcareous except in concretions; beds commonly
lenticular and cut -and -fill structures are numerous,
generally with some intraformational conglomerate.
Contact with underlying Laramie Formation buried
by Quaternary deposits in northwest corner. Only
the lower part of the Dawson Formation is in this
quadrangle and it is equivalent to part of the upper
division of the Laramie Formation of Eldridge
(Emmons, Cross, and Eldridge, 1896) and the
Arapahoe Formation of Eldridge (1889). The Pale-
ocene part of the formation does not occur in this
quadrangle (Brown, 1943,1949). Thickness about
550-600 feet

ville quadrangle (Malde, 1955), the Littleton quad-
rangle (Scott, 1962), and the Kassler quadrangle
(Scott, 1963), A ground water report (Schneider,
(1962) and a map by Rex 0. Smith, Paul A. Schneider,
Jr., Lester R. Petri, and others (written communi-
cation, 1963) were useful in mapping the valley

We completed a neighborhood meeting regarding the proposed ACM rezoning on July 24th, 2024, at 2:30 PM at the
Anythink Library at 327 E. Bridge St., Brighton, CO 80601. I have attached the meeting notice letter, Eight people
attended the meeting, and the sign -in sheet is also attached. The meeting lasted approximately one hour.
We made a presentation discussing our proposed rezone from Agricultural (A) to Light Industrial (1-1). We focused the
meeting on introducing ourselves -and -our current and past projects, a discussion of the rezoning -process, a --discussion- of
I-1 zoning, and a discussion of next steps after the rezoning process.
The attendants were friendly, and they presented good questions. These questions included:
1. What will the traffic impacts be?
2. Will the proposed zoning impact their property values?
3. Where on the property -will -the -buildings -be constructed?
4. What types of uses will be on the property?
5. What will the heights of the buildings be?
6. Will this change the zoning on their property?
7. Where is water and sewer service coming from and do they have capacity?
We informed them that this is just a first step and many of the questions they presented including traffic, layout, and
building heights would be -analyzed-by Weld- County during the Site Plan processand it will also be dependent on the -
ultimate user(s).
In addition, to this meeting, we met with several adjoining property owners individually over the past several weeks to
discuss our proposal and -any concerns they may have, These meetings have also been friendly, and thoif glib§tiaras
consisted of questions similar to those that were presented at the community meeting. We individually met with Jeremy
R. Martin, Lisa & Forrest Colbeck, Michael & Meztli Garza, Dillon Reider, Cody Reider, and Joe & Allana Reider.
