WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land, being the
property of Joel G. Anderson, Esther E. Nelson, and Helen M. Williams
of Weld County, Colorado, and more particularly described as follows, to-wit:
The West Half (W4) of the Southwest Quarter (SW3) of Section
28, Township 6 North, Range 66 West of the 6th P. M. , Weld
County, Colorado, being more particularly described as
follows:
Beginning at the Southwest Corner (SW Cor) of said Section 28,
and considering the West line of said Section 28, as bearing
North 00°00'00" East, with all other bearings contained herein
relative thereto;
Thence North 00°00'00" East, along the West line of said
Section 28, 2631. 94 feet;
Thence North 88°52'54" East, 1325. 10 feet;
Thence South 00°02'22" East, 2635. 82 feet to a point on the
South line of said Section 28;
Thence South 89°03'02" West, along the South line of said Section
28, 1326. 85 feet to the Southwest Corner (SW Cor) of said Section
28, said point being the Point of Beginning;
Said described parcel of land contains 80. 163 acres, more or less,
including a strip of ground 30 feet in width along the West and South
lines of said Section 28, reserved for County Road Right-of-Way
purposes and is subject to any rights-of-way or other easements
as recorded by instruments of record or as now existing on said
parcel of land,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, desires to exempt this particular division of land upon the
recommendation of the Weld County Zoning Administrator for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described
tract of land owned by Joel G. Anderson, Esther E. Nelson, and Helen M.
Williams be exempt from the definition of the terms "subdivision" and "sub-
divided lands" as provided for in the new Weld County Subdivision Regulations
at Section 2-1A. , (3), adopted August 30, 1972, as amended.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 27 day of November, A. D. ,
1974.

Dear Sirs:
The attached plat and other items are in reference to an application by Joel
G. Anderson, Esther E. Nelson, and Helen M. Williams for a Recorded Exemption.
The parcel in question has a total of 80.163 irrigated acres. This parcel
will be split into lots of 10 acres and 70 acres.

Based upon the information submitted and the Weld County Regulations, the
Planning Staff recommends approval for the following reasons:
1 . The proposed land split is in compliance with the Weld County
Comprehensive Plan in that it promotes agricultural usage of
the land.
2. The proposed land split complies with the intent clause, Section 9-2,
of the Weld County Subdivision Regulations in that non-productive
agricultural lands are being utilized.
3. All requirements for Recorded Exemption have been met.

The attached plat and other items are in reference to an application by Joel
G. Anderson, Esther E. Nelson, and Helen M. Williams for a Recorded Exemption.
The parcel in question has a total of 80.163 irrigated acres. This parcel
will be split into lots of 10 acres and 70 acres.
Based upon the information submitted and the Weld County Regulations, the
Planning Staff recommends approval for the following reasons:
1 . The proposed land split is in compliance with the Weld County
Comprehensive Plan in that it promotes agricultural usage of
the land.
2. The proposed land split complies with the intent clause, Section 9-2,
of the Weld County Subdivision Regulations in that non-productive
