HomeMy WebLinkAbout20252295.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, August 13, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 13, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem — Excused Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Controller, Rusty Williams Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppier seconded the motion and it carried unanimously. Certification of Hearings: Commissioner Maxey moved to approve the below listed Hearing Certificate. Commissioner Ross seconded the motion, which carried unanimously. 1. Public Hearing of the Board of County Commissioners of Weld County, Colorado, to Consider Adoption of the Map Establishing Boundary Lines of Commissioner Districts in Weld County, Colorado — Weld County, Colorado Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 2025-2295 BC0016 Page 2 Wednesday, August 13, 2025 www.weld.gov Presentations and Proclamations: 1. Three (3) National Association of Counties (NACo) Achievement Awards for Various Weld County Department Programs: Commissioner Peppler read the certificate recognizing Crafting a Legislative Link for Foster Children and Families for the record. Jamie Ulrich, Director of the Department of Human Services, expressed her appreciation for the Board's recognition, and shared her pride on the staff -driven `grassroots' efforts stemming from their attendance at a national conference that led to working with lobbyists and testifying before the legislature to set the standard for not only Weld County, but the for the State of Colorado, regarding the ability to house children and youth in kinship foster care homes with family members who reside in different states. Ms. Ulrich stressed the importance of keeping children connected to their known relatives when parents are not a viable option. The Board extended their gratitude for staff and their willingness to serve with the some of the most vulnerable population in Weld County, congratulated the team for their national recognition, and shared their pride for the top -tier leadership and willingness of staff to step up and find a great solution. Commissioner Ross read the certificate recognizing the Heart of Weld program, which is the County's Diabetes outreach and prevention for Medicaid recipients who reside in Weld County. Kelly Martinez, Department of Public Health and Environment, thanked the Board for their recognition, stated the program is not only supported by the Center for Disease Control (CDC) but has been recognized for the improvements of community health metrics, which has great economic impacts. She shared statistics and the related costs being over $1 Million annually, stated the department trains and deploys community health care workers to educate and support citizens, provide workshops, and connect clients to clinics and other resources. Ms. Martinez expressed her gratitude toward Jason Chessher, Bob McDonald, and her team for their unwavering support. Olga Gonzales, Department of Public Health and Environment Health Specialist, extended her appreciation for the Board's support to allow for bi-lingual nutritional guidance and educational classes. Ms. Martinez introduced staff who were present for the record. In turn, each Commissioner extended their gratitude for staff's passion in educating the community and congratulated the team for their national recognition. (Clerk's Note: The group gathered for a photo opportunity.) Commissioner Maxey read the certificate recognizing Using Drones to Fight Noxious Weeds for the record. Curtis Hall, Director of the Department of Public Works, thanked the Board for their support and commended Tina Booton, Weed Division Supervisor, for her visionary foresight to use drones to locate and mitigate noxious weeds throughout Weld County. The Board congratulated the department for their national recognition, extended their appreciation for the department's ingenuity and willingness to utilize technology for the benefit of the citizens of Weld County to allow for increased accuracy with decreased use of pesticides. General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner Ross seconded the motion and it carried unanimously. New Business — General: 1. Consider Contract ID #9828 Memorandum of Agreement for Purchase of Property Interest for Acquisition of Right -of -Way for Design -Build Project of High Plains Boulevard (aka County Road 9.5) Between County Roads 32 and 34, and Authorize Chair to Sign — Martha Fischer: Cameron Parrott, Department of Public Works, stated the agreement with Martha Fischer allows the County to purchase right-of-way and four (4) permanent slope easements in the northeast corner of the intersection of County Roads 9.5 and 32, in the amount of $370,372.00. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Peppler, carried unanimously. 2. Consider Temporary Closure of County Road 53 Between County Road 66 and State Highway 392: Amy Mutchie, Department of Public Works, stated the temporary closure of County Road (CR) 53, between CR 66 and State Highway (SH) 392, will begin August 25, 2025, and go through September 19, 2025, for the re -deck of Bridge 53/66A. She stated water will be used, as needed, for dust control on the one (1) -mile gravel road portion of the detour route, local traffic will be accommodated, and message boards will be placed in advance of said closure to notify the public. Commissioner Maxey moved to approve said temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — Planning: 1. Consider Acceptance of Replacement Collateral for Use by Special Review Permit, USR22-0024 — Lytel Farms, LLC, c/o Sunshare, LLC, dba BecLee Solar, LLC: Diana Aungst, Department of Planning Services, stated the applicant previously submitted a Surety Bond from Atlantic Specialty Company Insurance Company that was accepted by the Board on October 16, 2024, related to Use by Special Review Permit, USR22-0024. She further stated the insurance company has now submitted a Rider that changed the Bond number from what is reflected on the currently held collateral. Commissioner Ross moved to approve and accept said replacement collateral. The motion was seconded by Commissioner Maxey and it carried unanimously.
