Show Cause Hearing, PCSC23-0011, to Determine Whether Good Cause Exists for
Revocation of Second Amended Use by Special Review Permit, 2MUSR19-95-1075,
and 3MUSR21-95-1075, for Open Pit Mining and Materials Processing (sand, gravel
and stone), an Asphalt and Concrete Batch Plant, for an Oil Field Business, more
specifically defined as an Oil and Gas Support and Service Facility — Pipeline and
Roust-a-bout; and a private commercial recreational facility (water skiing lake and
primitive campsite for water skiing members) — R M Hiner Construction Co, Inc.
A public hearing was conducted on October 1, 2025, at 9:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated January 30, 2025, and duly published
February 1, 2025, in the Greeley Tribune, a public Show Cause hearing was conducted
on February 12, 2025 to determine whether good cause exists for the revocation of
Second Amended Use by Special Review Permit, 2MUSR19-95-1075, for Open Pit
Mining and Materials Processing (sand, gravel and stone), an Asphalt and Concrete
Batch Plant, for an Oil Field Business, more specifically defined as an Oil and Gas
Support and Service Facility — Pipeline and Roust-a-bout; and a private commercial
recreational facility (water skiing lake and primitive campsite for water skiing members) in
the A (Agricultural) Zone District, held by R M Hiner Construction Co, Inc. At said hearing,
the Board continued the matter to April 2, 2025, out of respect for the family, to grieve the
passing of Rex Hiner, permittee. On April 2, 2025, the Board continued the matter to
October 1, 2025, to allow the permittee additional time to work with staff to complete the
outstanding items. Bruce Barker, County Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, presented a brief summary of the USR,
mentioned the Third Amended Use by Special Review Permit, 3MUSR21-95-1075,

provided the general location of the site, and relayed the hearing had previously been
continued from April 2, 2025. She stated progress has been made, such as certain items
having been moved in order to comply with the Municipal Separate Storm Sewer Systems
(MS4) regulations, and the appearance that the hydrovac (hydro-excavation) business is
no longer operating on the site. She explained the permittee submitted an application to
vacate the Recorded Exemption, which was conditionally approved by the Board of
County Commissioners on September 24, 2025, and is pending recordation of the plat.
She outlined the major items that still need to be completed, including finishing the
Recorded Exemption vacation, dividing up the land, creating two (2) new USRs, and
finishing the permits related to said USRs. She displayed images of the site that were
taken last week.
Whitney Borunda, granddaughter, represented the applicant and stated they have been
working with their engineer to get all of the required items completed. Commissioner Ross
asserted the permittee had made a sincere effort and made substantial progress. In
response to Commissioner Ross regarding a reasonable timeframe to come into
compliance, Ms. Borunda stated she was not sure but she was happy to come before the
Board again in six (6) months to provide an update.
No public testimony was offered concerning this matter.
Commissioner James moved to continue the matter to April 1, 2026, at 9:00 a.m., to allow
the permittee additional time to work with staff to complete the outstanding items. The
motion was seconded by Commissioner Ross, and it carried unanimously. There being
no further discussion, the hearing was completed at 9:46 a.m. (Clerk's Note: Teams

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 15th day of October, A.D., 2025:
