722 WARRANTY DEED
THIS DEED made this 20th day of August, 1974, between the City
of Greeley, Colorado, a Municipal corporation duly organized and existing
under and by virtue of the laws of the State of Colorado, of the first part,
and Weld County, Colorado, of the second part:
WITNESSETH:

That the said party of the first part, for and in consideration of the
sum of One Hundred and Sixty-five Thousand Dollars ($165, 000. 00) to it in
hand paid by the said party of the second part, the receipt whereof is hereby

confessed and acknowledged, has granted, bargained, sold and conveyed
and by these presents does grant, bargain, sell, convey and confirm unto
the said party of the second part, its assigns and successors, all of the fol-
lowing described lots or parcels of land, situate, lying and being in the City
of Greeley, County of Weld and State of Colorado, to wit:
Lots Seventeen (17) and Eighteen (18), in Block
Sixty-five (65) in the City of Greeley, according
to the recorded map or plat thereof.
TOGETHER with all and singular the hereditaments and appurtenances
thereunto belonging, or in anywise appertaining, and the reversion and rever-
sions, remainder and remainders, rents, issues and profits thereof; and all
the estate, right, title, interest, claim and remand whatsoever of the said
party of the first part, either in law or equity of, in and to the above bargained
premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and
described, with the appurtenances, unto the party of the second part, its
assigns and successors, forever. And the said party of the first part, for
itself, its successors and assigns, does covenant, grant, bargain and agree
to and with the said party of the second part, its assigns and successors,
that at the time of the ensealing and delivery of these presents, it is well
seized of the premises above conveyed, as of good, sure, perfect, absolute
and indefeasible estate of inheritance, in law, in fee simple, and has good

right, full power and lawful authority to grant, bargain, sell and convey the
same in manner and form aforesaid, and that the same are free and clear
from all fozmer and other grants, bargains, sales, liens, taxes, assess-
ments and encumbrances of whatever kind or nature soever, except for any
reservations, restrictions, covenants, conditions, easements and rights-of-
way established by recorded instrument; and the above bargained premises,
in the quiet and peaceable possession of the party of the second part, its
assigns and successors, against all and every person or persons lawfully
claiming or to claim the whole or any part thereof, the said party of the
first part shall and will warrant and forever defend.
IN WITNESS WHEREOF the said party of the first part has caused
its name to be hereunto subscribed by its Mayor, with attestation by the
City Clerk, the day and year first above written.

Gentlemen:
The following is an examination and opinion of two abstracts of title
covering the following described property located in Greeley, Weld
County, Colorado, to-wit:
Lots 17 and 18, in Block 65, in the City of Greeley,
Weld County, Colorado.
From such examination, I find as follows:
Fee simple title to the above-described real property is vested in
KARL EDWARD BLISS, JR. , subject to and except the following:
1. Exceptions and reservations as contained in United States
Patent recorded April 29, 1876 in Book 20, Page 75, Weld County
records and located at Page 5 in the abstract.
2. Subject to the intoxicating liquor restrictions and limitations
as contained in Union Colony deeds, except that there now exists no right
of forfeiture for violation thereof.
3. The property is entitled to the benefits and subject to the bur-
dens by reason of its inclusion within the boundaries of the Northern Colo-
rado Water Conservancy District,
4. The property is entitled to the benefits and subject to the
burdens by reason of its inclusion within the boundaries of the Greeley
General Improvement District No, 1, Greeley, Colorado.

5. Master road and highway plan of the City of Greeley which
gives notice to the owners of all property within the City and within a
radius of three miles of the City of proposed primary and secondary
highways.
6. Lease, agreement and option by and between KARL EDWARD
BLISS, JR. , and THE CITY OF GREELEY, Weld County, Colorado, A
MUNICIPAL CORPORATION OF COLORADO recorded January 13, 1960
at Book 1548, Page 547 of the Weld County records and found at Page 136
of the abstract. Any provision of said lease which applies to the main-
tenance or operation of a public parking lot terminates upon the exercise
of the option contained in said lease and purchase of the property from
KARL EDWARD BLISS, JR,
7. Abstract does not certify as to the payment of 1973 taxes, how-
ever investigation shows same as having been paid. 1974 taxes are now a
lien.
8. Rights of persons in possession, potential liens by reason of
recent improvements to the premises, if any, and unrecorded easements
or right of way, if any, may be ascertained by physical inspection of the
property.
In my opinion, the title as set out above and subject to the foregoing, is
good and merchantable.
