' 3/16/71 521 - -�. -, the government is going to force the issue and say there will have to be a plan where there will be facilities that will serve both areas. The State has to produce an interim plan for the abatement of all water pollution within the state by October 1971. Weld County will have to produce their portion of the plan by July 1971. It is being attempted to arrange a meeting in January to call all Of the towns together to discuss what the procedure will be. There will have to be a joint effort in order to obtain Federal funds. There has to be a basin plan, a regional plan and a state plan. Mr. Lorenson felt it is being taken out their hands if they are asking for Federal funds. Mr. Moculeski stated they would like .to have an alternative: This would be adjacent to the present facility. MOTION: By Mr. Bowles to take the matter under advisement. Second by Mr. Heitman. DISCUSSION: Mr. John Shocker, developer for Etheo Company, stated they are ready to start on their second phase and needs, to know if sewage facilities are going to be available to serve the area. RESOLUTION: Be it therefore resolved to recommend denial to the Board of County Com— missioners, suggesting they cooperate with the Tri—area. Motion by Ni. Heitman, second by Mr. Watson. APPLICANT: Robert Marx CASE NUMBER: S-74 — tape 318' SUBJECT: Revision of preliminary plat and site approval for sewage lagoon LOCATION: Wfr Sec 24 T4 R68 APPEARANCE: Robert Marx, Dale Olhausen DISCUSSION: Mr. Olhausen presented the revised preliminary plat showing an increased density and lagoon for sewage treatment facilities. The first filing has been approved, filed and recorded. Mr. Lorenson stated that after a soil investi— gation, some of the area is not suitable for individual septic systems. This and the necessity of paving the streets, is the reason for the increased density. Mr. Paul has recommended approval of the lagoon site. There are no changes in the first filing. Mr; Olhausen stated the lagoon will be built to the specifi— cations of the Health Department. RESOLUTION:. Be it therefore resolved to recommend approval of the preliminary plat and i ' \ the sewage lagoon site to the Board of County Commissioners. Motion 'by Mr.Anderson, second by Mr. Heitman. Swans° -CAS ER: SUP - tape 318 SUBJECT: Feed lot expansion LOCATION: NWI Sec 7 T6 R66 APPEARANCE: Mr. .Swanson DISCUSSION: Mr. Lorenson stated Ni. Swanson has requested the expansion of his feed lots and the total capicity will be 500 head. A letter from the Health Depart— ment was read which recommended a professional engineer be contacted to study the condition of the feed lot in reference to any possible ground water"pollution resulting from the drainage of the stock pens. Gene Inloes of the Extension office has recommended approval. Mr. Lorenson. stated they would wish to alter the legal description to the NWW NWT NW,e Sec 7 T6 R66. Mr. Doke stated in his field report that more drainage is needed. Mr. Lorenson stated they have a. report from CSU which says that feedlots adjacent to lakes deposit nitrates in the lake and when the lakes are used for irrigation purposes, it is a supplement to the land. Mr. Swanson stated the lake is really a seep hole. Mr. Paul stated the Health Department is concerned about underground water pollution. 491 a -is- 7o The lake will be pumped out periodically. Mr. Paul stated he will be glad to work with Mr. Swanson and the Soil Conservation office. RESOLUTION: Be it therefore resolved to recommend approval to the Board of' Cou''ty Commissioners subject to approval of the Health Department in cooperation with the Soil Conservation office, Motion by Mr. Watson, second by Mr. Heitman. A unanimous vote of "Aye". Motion carried. APPLICANTS: Clyde Davis and Dr. Richard Perchlik DISCUSSION: Dr. Perchlik presented 'some exhibits for a possible recreation and begin— ners ski area. Proposed° location is an area along the Poudre river about 1 mile north of 'Highway 34 north on County Rd #27. They had to consider the availabilty of water and produce artifical snow. . The water is available. The areaslopes to the north. They have developed a lease on the land with an option to buy, which contains 20 acres. Dr. Perchlik stated he felt there is a need for this type of area in the community and the potential is great enough to warrant the expend— iture. They hope to operate this so the average child can afford to use it. They have plans to install a tow. Total construction will consist of a warming house, the tow system and the snow making machine. Tow would be about 550'. Mr. Lorenson recommended they apply for a zone change under Business—Unit Dev— elopment. • • APPLICANT: Leo Green SUBJECT: Discussion on subdividing lot in Scott Acres LOCATION: NE- Sec 9 Tl R68 — tape 318 ' • APPEARANCE: Mr. Green, Herbert K. Linn DISCUSSION: Mr. Lorenson stated the subdivision is located on a mine site. Mr. Linn presented the proposal for subdividing Lot 10 which showed 4 parcels. Mr. Lorenson stated that some of the lots that he is proposing do not have existing public rightlof—way to them and there would need to be road dedication. Soil conditions would have to be submitted and that any road that would be put in would have to be paved. The,;way it is proposed, some of the lots would have, double frontage. Mr: Lorenson stated the division of these lots would be highly unfeasible in the form Mr. Green is suggesting. MOTION: By Mr. Heitman to table the matter and the applicant take it back to the Planning Department for further study and submit a soil survey. Second by Mr. Anderson. A unanimous vote of "Aye". The waste from the pit would leach into the soil and due to the closeness of Box Elder Creek, it would be a pollution source. The site has been approved by the County Agent and the Health Department. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to concrete holding tanks for all waste from the hog houses and the open pens shall satisfy the Health Department and are not a polluting problem. Mr. Telep: Thank you Mr. Chairman, Let the record show that this cause came on for a hearing this day March 8, 1971 at 10:30 o'clock A. M. on the application of Robert A. Swanson, Route 1 Box 78, Eaton, Colorado. for the expansion of a feedlot operation on a parcel of land located within the Northwest Quarter of the Northwest Quarter (NWjNW4) of Section Seven (7), Township Six (6) North, Range Sixty-six West (66) of the 6th P. M., Weld County, Colorado. Let the record further show that notice of this hearing today was published in the Greeley Booster on February 5 and February. 26th 1971 respectively as required by law. Let the record further show that there is in the file are receipts that notices were sent to adjacent landowners notifying them of this hearing today. Let the record further show that there is on file a resolution of the Weld County Planning Commission reporting favorably as to this expansion of an existing feeding operation subject to conditions and limitations as will be testified to in detail by our Planning Director. Let the record still further show that the applicant Robert A. Swanson is here in person. Mr. Chairman I think we are ready to proceed. Mr. Andeisont. At this time we will hear from the applicant I Mr. Swanson: My son-in-law - my son and/operate a half section farming and feeding operation and we want to expand this operation some so we have asked for a permit to build roughly 2 acres of feedlot with about 380 foot of concrete bunk. Is this adequate? Mr. Ashley: Is at your place Bob? -- - 2 Mr. Swanson: Yes, right there by the lake. It is just south of the existing pens. Mr. Anderson: Do you have any questions? Mr. Billings: I was just spoting the location. Mr. Swanson: Its a mile east and a mile south of Severance. Mr. Billings: Yes I know where it is at now. No I have no questions. You already have a feedlot there you are just expanding it. Mr. Anderson: Do you have anything to addMr. Lorensen? Mr. Loreasen: The Planning Commission recommended favorably for the following reasons: (1) that there is no conflict and the land uses in the area (2) it was approved by the Health Department and the Extension Office (3) the soil analysis indicated that there are no water pollution will occur (4) it was recommended to be subject to the capacity not to exceed 500 head. I believe this is the total feedlot. Mr. Swanson: No this is the expansion. Mr. Lorensen: All right 500 head expansion and that the development would occur within one year. There is one indication that we - there was quite a bit of dicussion on it at the Planning Commission and that was with regard to the lake that is adjacent to it and the Soil Conservation people told us that this is a closed basin and that the water is used primarily and apparently for irrigation and it was felt that even if it did drain into this lake that there could - because of its closed basin it would not be a water pollution source. So the Planning Commission recommended approval. Mr. Billings: That is the lake there where we have quite a jog in the road isn't it. Mr. Anderson: Is there anyone else in the room for the application, if there is let see the hands. Let the record show that there is one person here in favor of the request. Is there anyone in the room opposing the application? Mr. Telep do you have anything to add. Mr. Telep: In view of that last question I feel that the record should show that there is no one present in the room.
