COMMISSIONERS
The undersigned Applicant certifies compliance with the provisions of C.R.S. § 24-65.5-103(1),
and in support thereof, states and certifies as follows:
1. That Applicant has provided notice, (a copy of which is attached hereto as Exhibit "A"),
containing the time and place of the initial public hearing on its application for Use by Special
Review with the County of Weld, State of Colorado, Case No. USR25-0010, the nature of the
initial public hearing, the legal description of the property which is the subject of the initial public
hearing, and the name of the applicant.
2. That said notice was provided on August 27, 2025 by certified mail, return receipt
requested, or by a nationally recognized overnight courier.
3. That said Exhibit A includes the list of the names and addresses of the surface owners,
mineral estate owners and lessees of mineral interests to whom the notice was sent, including those
persons who have requested receipt of such notices pursuant to C.R.S. § 24-65.5-103(3).

NOTICE OF SURFACE DEVELOPMENT
Pursuant to C.R.S. § 24-65.5.103
Pursuant to C.R.S. § 24-65.5-103, the following notice of surface development is provided for Case
No. USR25-0010. A hearing before the Weld County Planning Commission will be conducted on
October 7, 2025, Weld County Administration Building, 1150 O Street, Greeley, CO 80631, at 1:30
p.m.
1. Applicant: DCP Operating Company, LP, 2331 Citywest Blvd., Houston, TX 77042.
2. Owner: Guttersen Ranches LLC, a Colorado limited liability company
3. Case No.: USR25-0010
4. Time and Place of Initial Public Hearing: October 7, 2025, at 1:30 p.m., Hearing Room,
Weld County Administration Building, 1150 O St., Greeley, CO 80631.
5. Nature of Application and Hearing: The Weld County Planning Commission shall
consider a Use by Special Review permit for oil and gas support and service, including a
Natural Gas Compressor Station, outside of subdivision and historic townsites in the A
(Agricultural) Zone District.
6. Location and Legal Description of the Property: A parcel of land located in the SW 1/4 of
Section 28, Township 3 North, Range 63 West of the 6th P.M., County of Weld, State of
Colorado as more particularly described on Exhibit A.
7. The name and address of the mineral estate owners to whom notice is sent is attached
hereto as Exhibit B.

(Legal Description)
A proposed 35 -acre site in the West Half (W/2) of Section 28, Township 3 North, Range 63 West
of the Sixth Principal Meridian, County of Weld, and State of Colorado, being described by metes
and bounds as follows:
Commencing at Found 2.5" aluminum cap stamped "PLS 23501" at the Northwest corner of said
Section 28, from which point proceed S 00°37'28" E a distance of 4,203.95 feet to the Northwest
corner of proposed site and point of beginning stated hereon;
Thence N 89°22'32" E a distance of 1,319.93 feet to the Northeast Corner of said Tract; thence
S 00°37'28" E a Distance of 1,155.06 feet to the Southeast comer of said tract from which the
Southeast corner of said Section 28, a 3.25" alum. cap stamped "PLS 16847" bears S 89°57'33"
E a distance of 3,978.10 feet; thence S 89°22'32" W a Distance of 1,319.93 feet to the Southwest
