HomeMy WebLinkAbout20252464.tiffResolution Approve Respite Grant Contract for 2025-2026 Colorado Respite Coalition (CRC) Concerning Colorado Adult Protective Services (CAPS) Background Checks for Home and Community Support Area Agency on Aging (AAA), and Authorize Chair to Sign — Easterseals Colorado Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Respite Grant Contract for the 2025-2026 Colorado Respite Coalition (CRC) Concerning Colorado Adult Protective Services (CAPS) Background Checks for the Home and Community Support Area Agency on Aging (AAA) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Easterseals Colorado, commencing upon full execution of signatures, and ending May 31, 2026, with further terms and conditions being as stated in said contract, and Whereas, after review, the Board deems it advisable to approve said contract, a copy of which is attached hereto and incorporated herein by reference. Gesick, Clerk to the Board 2025-2464 H R0097 Cari-hac-FI D BS$ BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: Respite Grant Contract with EasterSeals Colorado DEPARTMENT: Human Services DATE: August 26, 2025 PERSON REQUESTING: Jamie Ulrich, Director, Human Services Brief description of the problem/issue: On May 21, 2025, the Department received approval and applied for the Colorado Respite Coalition (CRC) FY 2025-26 State Respite Grant, known to the Board as Tyler# 2025-1393, and has since been awarded $12,000.00. The Department is now requesting approval of the Respite Grant Contract issued from EasterSeals Colorado and to expend the funds awarded which will be used to continue to offer respite options for Weld County family caregivers. The grant period starts August 1, 2025, and awarded funds must be expended no later than May 31, 2026. Legal (B. Howell) has reviewed and approved the Respite Grant Contract. What options exist for the Board? • Approval of the Respite Grant Contract between WCDHS and EasterSeals Colorado. • Deny approval of the Respite Grant Contract between WCDHS and EasterSeals Colorado. Consequences: The Home and Community Supports (HCS) Area Agency on Aging (AAA) division will not be able to accept the awarded funds. Impacts: The HCS AAA Division will not have the additional funding to continue to offer respite options to family caregivers in Weld County. Ross Pass -Around Memorandum; August 26, 2025 - CMS ID 9858 RESPITE GRANT CONTRACT Grantor: Grantee: Easterseals Colorado 393 South Harlan Street, Suite 250 Lakewood, CO 80226 303-233-1666 x 419 Weld County Area Agency on Aging 315 N. 11th Avenue, Building A Greeley, CO 80631 970-400-6200 Date: August 11, 2025 Program Name: Weld County Area Agency on Aging Grantee Lead: Meredith Skoglund, Executive Director Period (total grant period): August 1, 2025 - May 31, 2026 Grant Report and Documentation Due: June 5, 2026 Amount of Grant: $ 12,000.00 AN AGREEMENT between the Grantor, Easterseals Colorado (ESC), and the Grantee, Weld County Area Agency on Aging, to carry out specific activities under the Easterseals Colorado's Respite Grant funding program and establishing terms and conditions of operation. IT IS MUTUALLY AGREED AS FOLLOWS: Use of Funds: The awarded funds must be used specifically for the designated purpose(s) outlined in Grantee's proposal to provide LOW or NO COST respite services to families. Grant funds shall not be used for any food or beverage. Grantee must obtain Easterseals Colorado's approval prior to requiring families to pay for services received through the grant award. Easterseals Colorado shall reimburse Grantee for respite services not to exceed $12,000.00. Grantee shall report to Easterseals Colorado by April 1, 2026, if the awarded funds will not be expended within the grant period. If Grantee needs to amend the budget during the grant period, Easterseals Colorado must provide written approval of changes. Background Checks and InsuranciRequirements: • In compliance with C.R.S. § 26-3.1-111, which requires certain employers to obtain a CAPS check to determine if a person who will provide direct care to an at -risk adult is substantiated in the case of mistreatment of an at -risk adult. The full list of Employers Easterseals Colorado General Grant Terms, Conditions and Understandings Contract revised July 30, 2025 Page 1 required to obtain CAPS checks are listed at C.R.S. § 26-3.1-111, all respite care providers (staff and volunteer) involved with the program funded by this grant must complete a fingerprint -based background check before providing care. I attest that my agency is in compliance with C.R.S. § 18-6.5-107, which requires state -funded contracting agencies that employ persons to serve in positions that involve direct contact with vulnerable persons in the homes and residences of such vulnerable persons, to complete fingerprint -based criminal history record check of such employees through the Colorado Bureau of Investigation (CBI) or another background check system that provides information at the same level of detail or higher than the CBI records check. Grantee must keep documentation of all provider fingerprint -based background checks and privacy insurance policy for a minimum of four years after the grant period ends. Easterseals Colorado and the State of Colorado State Unit on Aging, reserve the right to request access to and/or request copies of fingerprint and background checks for review. Grantee must also carry a privacy insurance policy during the entire grant period to receive funds. Proof of qualifying insurance policy must be submitted to and approved by Easterseals Colorado prior to providing any care services. Grant Outcomes (as determined bythe submitted Grantee proposal): 1. The 1st measurable outcome will be an increase in the number of older adults who receive respite services 2. The 2nd measurable outcome will be to enhance the quality of services provided. This will be achieved through the administration of a survey before and after respite services. 3. Add any additional outcomes Terms of Payment: Grantee must select one billing option (initial choice): o (a) Monthly invoices shall be submitted by the 1St of the month to ESC to be considered for payment within 30-60 days of receipt. o (b) Bi-Monthly invoices shall be submitted by the 1St of the month to be considered for payment within 30-60 days of receipt. Data Collection Sheets are required to be submitted with the monthly invoice. The Data Collection Sheet must be signed by a Family Caregiver and by the Grantee. Grant Reporting Requirements: Grantees are required to: • facilitate the collection of Colorado Respite Coalition online survey data from family caregivers who received respite services during the program period. • report data from any agency surveys conducted during the program period. • collect non -identifying demographic data for reporting purposes as indicated by ESC. • submit a final budget showing how funds were expended during the grant period. Easterseals Colorado General Grant Terms, Conditions and Understandings Contract revised August 13, 2025 Page 2 GENERAL GRANT TERMS, CONDITIONS AND UNDERSTANDINGS Easterseals Colorado, as fiscal agent, and upon the recommendation of its respite grant review committee is awarding this grant to the above -named agency, Grantee, contingent upon the following: 1. UNAUTHORIZED USE OF GRANT. No part of the Grant will be used: (i) to carry on propaganda or otherwise influence legislation within the meaning of 26 U.S. Code § 4945 (d)(1);(ii) to attempt to influence the outcome of any specific public election; (iii) to carry on, directly or indirectly, any voter registration drive within the meaning of Section 4945(d)(2) of 26 U.S. Code; (iv) for any political expenditure within the meaning of Section 4955(d) of 26 U.S. Code; or (v) to make payment to an individual, except for compensation or expense reimbursement to employees of, or consultants to, Grantee within the scope of their employment or engagement. 2. ACCOUNTING AND AUDIT. Grantee must: (i) keep an accurate record on a fund accounting basis of the receipt and disbursement of funds and expenditures incurred under the terms of this Contract; (ii) retain all books and records relating to this Contract (including bills, invoices, canceled checks, receipts, etc.) for at least four (4) years after expiration of the Period; and (iii) comply with all requests by Easterseals Colorado to inspect or receive copies of such books and records. At Easterseals Colorado's expense, it may audit the books and records of Grantee relating to this Contract, and Grantee will aid as requested in connection with the audit. 3. CONFIDENTIALITY. Grantee acknowledges that in the performance of this Contract, Grantee may have access to information that is private or confidential to, or a trade secret of, Easterseals Colorado. Grantee agrees not to disclose any such information (the "Confidential Information") to any third party without the specific written authorization of Easterseals Colorado, regardless of the form or format in which, or means by which, Grantee becomes aware of such information. For the purposes of this Contract, Confidential Information shall not include information that is in the public domain unrelated to actions by Grantee or information that Grantee has obtained in good faith from legal sources other than Easterseals Colorado. Grantee agrees to take whatever measures are reasonably necessary to ensure that the employees, independent contractors and agents of Grantee are personally bound to maintain the Confidential Information in the same manner as Grantee. Grantee agrees that breach of confidentiality would result in irreparable harm to Easterseals Colorado and all equitable remedies, including injunctive relief and recovery of attorney's fees, shall be available to Easterseals Colorado for any breach or threatened breach of confidentiality by or through Grantee. 4. ACKNOWLEDGMENT/PUBLICITY. Easterseals Colorado encourages the Grantee to publicize information concerning the awarded Grant in the Grantee's newsletters, annual reports and other relevant publications. Grantee will allow Easterseals Colorado to review and approve the text of any proposed publicity concerning this Contract prior to its release. Easterseals Colorado General Grant Terms, Conditions and Understandings Contract Page 3 revised July 30, 2025 Grantee must add a link to the Easterseals Colorado website, www.easterseals.com/co/ and its program, the Colorado Respite Coalition, www.coloradorespitecoalition.org on agency website to acknowledge partnership. Easterseals Colorado welcomes any photographs relevant to the grant for use by Easterseals Colorado and/or the Colorado Respite Coalition. Photos must have prior client releases for publication purposes. Easterseals Colorado or the Colorado Respite Coalition or State of Colorado, State Unit on Aging ("Parties"), without further notice, mayuseinformation regarding this Contract and/or Grant, the amount and purpose of the Grant and photographs, logo or trademark, and other published printed information or materials (provided by Grantee) and its activities, in Parties' periodic public reports, newsletters and news releases. 5. NO OBLIGATION TO THIRD PARTIES; NO ASSIGNMENT. Easterseals Colorado expressly disclaims any obligation to employees or independent contractors hired or engaged by Grantee to assist Grantee in carrying out its obligations under this Contract. Employment or engagement of such third parties is referred to in this paragraph as "engagement." If Grantee elects to engage third parties for such purpose, Grantee will: (i) notify third parties that their engagement is subject to the terms and conditions of this Contract, (ii) include the following language in any written agreement between Grantee and any third party: "[third party] hereby acknowledges that [Grantee]'s rights under this agreement are subject to all the terms and conditions of a Grant Contract with Easterseals Colorado ("Easterseals Colorado"). [Third party] agrees that Easterseals Colorado has no obligation whatsoever to [third party] for any monies payable to [Grantee] under the Grant Contract and [third party] agrees to look solely to [Grantee] for payment of any claims [third party] may have."; and (iii) hold Easterseals Colorado harmless from any and all claims of third parties arising from or relating to the Grant, this Contract or Grantee's agreement with any third party. Easterseals Colorado and Grantee agree that they are the sole parties to this Contract and no third party shall become a third party beneficiary of this Contract. Grantee may not assign this Contract without the prior written consent of Easterseals Colorado. 6. REPRESENTATIONS OF GRANTEE; COMPLIANCE WITH LAWS, RULES AND REGULATIONS; INSURANCE; GOVERNING LAW. By signing this Contract, Grantee represents that: Grantee is in compliance with and, at all times will continue to be in compliance with, all laws, rules, and regulations of the United States and of the State of Colorado that are applicable to Grantee, including but not limited to: (i) 26 U.S. Code §4945; (ii) Title VI of the Civil Rights Act of 1964; (iii) Title IX of the Education Amendments Act of 1972; (iv) Section 504 of the Rehabilitation Act of 1973; v) the Age Discrimination Act of 1975; and (vi) the Americans With Disabilities Act of 1990; (vii) HIPAA; [Grantee may explain in a separate written document the reason(s) it believes it is exempt from compliance with any of these laws and the written explanation will be included as a Special Condition Easterseals Colorado General Grant Terms, Conditions and Understandings Contract revised July 30, 2025 Page 4 applicable to the Grant]; Grantee is knowledgeable about the Executive Order 13224 and the USA Patriot Act of 2001 and agrees that no part of the Grant will be expended or re -granted, so as to benefit any person or organization with ties to terrorists. When requested, Grantee will provide current information concerning its activities and that of the recipients of any re -granted funds; At all times, Grantee will maintain adequate liability insurance covering all of its activities relating to the Grant; and Grantee's representations are true and may be relied upon by Easterseals Colorado. Grantee will immediately notify Easterseals Colorado in writing if Grantee fails to comply with any provision of this Contract or if any representation of Grantee is no longer true. This Contract shall be construed and enforced according to the laws of the State of Colorado.
