RESOLUTION
WHEREAS, Henny Penny, Inc. c/o J. Lee Sears, 140 Denver
Avenue, Fort Lupton, Colorado, has requested permission to locate a
commercial egg production operation on the following described property,
to-wit:
A parcel of land located, in the Southeast Quarter'(SEI)
of the Northeast Quarter (NE4) of Section Thirty-five
(35), Township Two-(2) ,North, Range Sixty-five :(65)
West of the 6th' P:1\/1. , Weld County, Colorado, contain-
ing 40 acres, more or less,, and
WHEREAS, the said requested location of a commercial egg
production operation is located in an agricultural zone as set forth by
• the Weld County Zoning Resolution, and
` WHEREAS, according to Section 3. 3 (3)(c) of the Zoning Resolution
of Weld County, said request to locate a commercial egg production
operation may be authorized upon the approval of the Board of County
Commissioners of Weld County, and
WHEREAS, the Weld County Planning Commission, by resolution,
has recommended that the request to locate a commercial egg production
operation be approved;
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Henny Penny, Inc. , c/o J, Lee Sears, 140 Denver Avenue, Fort Lupton,
Colorado, to locate a commercial egg production operation on the
following described property, to-wit:
A parcel of land located in the Southeast Quarter (SE4)
of the Northeast Quarter (NE-) of Section Thirty-five '
(35), Township Two (2) North, Range Sixty-five (65)
West of the 6th P. M. , Weld County, Colorado, contain-
ing 40 acres, more or less, and
as provided by Section 3. 3(3)(c) of the Zoning Resolution of Weld County,
Colorado, is hereby granted under the conditions following:
1, Any water and sanitation facilities to be installed shall be
approved by. the State Health Department. '
2. That petitioner shall proceed with due diligence to construct
said commercial egg production operation and that he shall
have up to one .year from date-hereof to begin construction
• thereof.
3. That the manure accumulating as a result of the business
operation conducted herein shall be removed from the
premises at least annually.
4, That all applicable subdivision regulations and zoning
regulations shall be followed and complied with in
accordance with the Zoning Resolutions of Weld County,
• Colorado.

Chairman Billings ,announced that if given 'notice, the cafeteria can prepare
sandwiches for luncheon meetings.•

Commissioner Coordinator Reports: Actual numbers of calls made on the Watts
and Denver lines, were stated by 'Commissioner Jacobucci. He noted that an average
' of three calls per minute go through the switchboard.. Chairman Billings expressed
' ' the outstanding job done by the Communications Department during the flood.
Commissioner Moser spoke briefly on the costs of repairing and replacing vari—
ous county bridges. An urgent need is to replace bridge 44/47A. This should
be discussed by the Board as the flat cars intended for use on this .bridge have
not arrived. Mr. Smith added his opinion on this bridge and the flat cars; as
well as money that could be available. The Daniels Bridge was mentioned.

Commissioner 'Steinmark 'informed the Board that Governor Lamm has included Weld
• County in the disaster proclamation. $465,000 was submitted for Weld, although
no figure has been confirmed. Notice was received that the 1976-1977 State
Social Services allocation is inadequate. Investigations will be made to see
where costs can lie cut or more funds obtained. Mrs. Steinmark read a letter
regarding the school lunch program for the elderly.
Commissioner Carlson reported on the tri-area planning meeting he attended con-
cerning drainage. He indicated that a HUD Grant may be the only source of fund-
ing for completion of this project. A meeting was also held last week on oil, gas
and uranium drilling.

Chairman Billings reminded the Board of the budget meeting with Mr.. Buss on
August 12, .1976.
A break was called by the Chairman.

COMPREHENSIVE MANPOWER PLAN: Human Resources Director Walt Speckman reviewed Manpower
policies. The maximum length of time a person maybe employed under Manpower
grants is two years. Senior citizen employment was referenced by Anthony Espin-
oza. Other aspects of Manpower including deaf employees and on-the-job-training
were briefly discussed. A motion was made by Commissioner Carlson and seconded
by Commissioner Steinmark to approve the Manpower proposal.. The motion carried
• unanimously..
PRECINCT BOUNDARY MAPS: Updating precinct boundary lines pursuant to state law was stressed
by Mary Ann Feuerstein, County Clerk and ,Recorder. Maps were presented showing
the newly established lines. 'They were marked Exhibit A, City of Greeley, Ex-
hibit B, outlying areas not in Greeley city limits, and Exhibit C, town fallouts.
Following explanation of the line locations, Commissioner Moser made a motion
to approve' Exhibits A, B and C as presented. It was seconded by Commissioner
Jacobucci and the motion carried unanimously.
GATES CYCLO PLANT ODOR: Chairman Billings referred to approval given in 1972 for this plant
in the Hudson area upon the condition that aerators be installed. To date, this
has not been done. The Health Department is aware of the problem and are moni-
toring. A motion to inform Gates that they must comply or will be issued a
cease and desist order was made by Commissioner Moser, seconded by Commissioner
Steinmark. It carried unanimously. Chairman Billings requested the Commis-
• sioner•s secretary to send the letter to Gates. A thirty day time limit. was
discussed by the Board. -

KERSEY IMPROVEMENT DISTRICT: Mr. Smith notified the Board that the county .is not involved
in this project. A letter to that effect will be sent to Weld County by the
town of Kersey.

The Hill-n-Park weed letter was referred to Commissioner Jacobucci and Mr.
David for action.
Commissioner Carlson made a motion to send a letter to RaymoniCarper, State
Division of Property Taxation, stating that the Board believes that construction
firms which truly are not non-profit should pay fair and equal property taxes.
It was seconded by Commissioner Moser and the motion carried unanimously. The
Commissioner's secretary was directed to send the letter.
AIRPORT BOARD APPOINTMENTS: Mr. Buss presented the name of Phil Brewer as a person who
should be reappointed to a full term. He also mentioned. Don Preston and John
- Althoff as possible candidates for a full term.appointment. All three had
agreed to serve if appointed to fill one of the two vacancies. Upon discussion,
Commissioner Moser made a motion to appoint Don Preston and reappoint Phil
Brewer to full terms on the Airport Board. Commissioner Carlson seconded the
motion and it carried unanimously.
KEN-WIL ACRES RESOLUTION CLARIFICATION: It was brought to the attention of the Board by
Mr. David that the dedication of perpetual rights-of-way resolution presented
on Monday should not take effect until final approval is given to the plat.
A resolution was also presented establishing an escrow account of $6180.36
for the development of 64th Avenue. Mr.. Buss corrected the figure to read
$6108.36. Commissioner Jacobucci moved that the resolution for dedication
of perpetual rights-of-way not take effect until final approval and that the
figure for the escrow account be corrected as indicated. Commissioner Moser
seconded the motion and it carried unanimously.

LIE, INC, YE GREELEY VILLAGE INN, DANCE LICENSE: Commissioner Carlson made a motion to
grant the dance license as requested. Commissioner Jacobucci seconded the
motion and it carried unanimously.
CANCEL WELFARE WARRANTS, JULY, 1976: Chairman Billings highlighted the request for
cancellation and read into the record figures as stated on the resolution.
It was moved and seconded by Commissioners Jacobucci and Moser to authorize
the cancellation. Motion carried unanimously.
HEALTH HAZARDS ON BIG THOMPSON RIVER: Each Board member received a letter from the
Weld County Health Department -relating to the numberous piles of debris in
the river. These are causing odor problems and health hazards and need im-
mediate attention. Chairman Billings instructed Mr. Buss to contact the
Governor's Office today and notify them of this letter. A copy of said let-'
ter should• then follow.
Glen Paul of the Health Department elaborated on the problem.situation. Sheriff
Don Bower noted the observations of his office and agreed with the urgent need
for aid.
GATES CYCLO PLANT: Chairman Billings informed Mr. Paul of the action taken Monday by
the Board. The 30 day period was explained and if there is noncompliance a
cease and desist order will be issued.
BUILDING MORATORIUM NEAR AIRPORT: Because of the future possible expansion of the Weld
County Municipal Airport, a request was made by Phil Brewer, President of the
Airport Board, for a moratorium on building in that area. A master plan is in
the process of being formulated and is expected to take 12 to _15 months to
complete. Until the exact expansion area is determined no residential building
is desired within 2 miles of each end of the runway East and West, nor 1 mile
on either side of the runway North and South. Mr. David was asked to research
whether the Board can have a moratorium of this nature. It was also brought out
that the master plan will cost $50,000 with $45,000 to be paid by the FAA.

The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the law and by-laws of said Board at the
regular place of meeting in the Weld County Centennial Center, Greeley, Colo-
• rado, on Monday, 'August 16, 1976, at the hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call the fol-
•
lowing members were present, constituting a quorum of the members thereof:

MINUTES APPROVED: The Board approved the minutes of the Board of County Commissioners'
meeting of August 11, 1976. A motion was made and seconded. Motion carried.
ADDITIONS TO AGENDA: Chairman Billings added to the agenda the notification from the City
of Greeley regarding county owned property and the letter from attorney John
W. Henderson. '
BIDS PRESENTED AND APPROVED: None
CLAIMS APPROVED: On motion it was moved and seconded to approve the following claims.
' Motion carried.
County General Payroll termination of an employee, $ 101.20.
ELECTED OFFICIALS AND DEPARTMENT HEADS: Glen Paul, Health Department, commented on the
Gates Cyclo Plant and added that he had discussed the matter with Ken Smith,
He indicated there is an easy solution that can be worked out that will be
• satisfactory. If the Environmental Protection Agency makes a study, a copy .jj
will be presented for the Board's review. Mr. Paul indicated that Mr. Smith
will send in writing a letter stating the manner of correction that will be
adhered to. Mr. Paul commented upon the spraying of the pond beginning today
on approximately 500 acres in Weld County. Chairman Billings announced that
Weld County will receive Federal funds as soon as the President signs the ^
approval form. Chairman Billings commented upon the clean up resulting from
the flood and the types of equipment to be used in order not to destroy any .
bodies among the debris.
County Treasurer, Mike Loustalet, reported his collections are slightly down '
from last year at this time. He then submitted to the Board the delinquent
personal property tax list for years 1963, 1966, 1967 and ,1968. He added
that the lists had been turned over to a collection agency and that these
still remain uncollected. Commissioner Steinmark made a motion to cancel
the delinquent personal property- taxes as presented by the Treasurer. Com-
missioner Carlson seconded the motion and it did carry unanimously. Mr. Lou-
stalet added that the usual delinquent tax sale has been scheduled for Nov-
ember 15, 1976. Mr. Loustalet asked that a resolution be drawn to designate
. the third floor Board room as a part of his office to conduct said sale.
The additional item the Treasurer commented upon was the difficulties in
collecting taxes on mobile homes.

Section 302 (d) Expiration. Every permit issued by the Building Official under the provisions of this Code shall expire by limitation and become null and
