A public hearing was conducted on March 19, 2025, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated February 14, 2025, and duly published
February 19, 2025, in the Greeley Tribune, a- public hearing was conducted to consider
the request of Cervi Enterprises, Inc., c/o Kerr-McGee Oil and Gas Onshore, LP, for Use
by Special Review Permit, USR24-0025, for Oil and Gas Support and Service (substation
and compressor station) outside of subdivisions and historic townsites in the
A (Agricultural) Zone District. Matthew Conroy, Assistant County Attorney, made this a
matter of record.
El Diana Aungst, Department of Planning Services, presented a brief summary of
the proposal, and described the sign posting and location of site, with access off of
U.S. Highway 34, near County Road (CR) 69, per Colorado Department of
Transportation (CDOT) access permit #49110. She shared 11 referrals were sent out,
seven (7) agencies responded with no concerns, or included conditions that have been
addressed through Development Standards (DS) and Conditions of Approval (COA), and
four (4) agencies did not respond. She explained no screening or landscaping is
proposed, and two (2) surrounding property owners were Noticed; however, no
correspondence was returned. She shared, per the Development Review staff, a Final
Drainage Report has been submitted, which has been accepted, and a Weld County
Grading Permit is required if more than one (1) acre of land is disturbed during

construction. Ms. Aungst relayed, per the Department of Public Health and Environment,
since no permanent employees will be onsite, portable toilets are acceptable, during
construction, and can be utilized during operation. She further stated Dust Mitigation and
Waste Handling Plans were submitted and will be adhered to, in accordance with the DS,
a water truck and gravel application on all access and driving surfaces will be used for
dust control, and an Air Pollution Emissions Notice (APEN) may also be required. She
also explained a Noise Modeling Report was not submitted; however, there are no
buildings within 2,000 feet of the site, and the light industrial noise limits of 70 decibels
during the day and 65 at night, will be adhered to. She relayed Environmental Health has
15 DS, #10 - #24, that shall be adhered to and there are no outstanding items with the
request. Ms. Aungst entered the favorable recommendation of the Planning Commission
into the record, as written, and displayed images of the site and surrounding views.
Matt Wells, OXY USA, represented the applicant, and in response to Chair Buck,
indicated he had not had contact with any of the Commissioners regarding this case.
Mr. Wells narrated a PowerPoint slide show (Exhibit D), elaborating on the location of the
site and the support and service operation. In response to Commissioner Ross,
Kevin Barnes, Senior Electrical Engineer, explained the efficiency of an electrical rig,
versus a traditional rig, stating with electric power there is a 95% R -factor, which is
typically 85% or better with this facility. He further explained combustion runs at around
50% to 70%, with the biggest obstacle being the utility power available; however, OXY
employs hybrid technology, and this site is utility based, with power coming off the
transmission system. He explained it is more economical drilling with utility -based electric,
rather than gas or fuel -based drilling rigs. In response to Commissioner Maxey,
Mr. Barnes confirmed Tri-State has a switchyard north of this location, which is being
extended to facilitate this connection as a private substation. He stated over the long term,
the amount of power produced may require an additional facility and equipment, and
noted how future development will depend on the parties involved.
='' In response to Chair Buck, Mr. Wells indicated they have reviewed, and agreed to
abide by, the Conditions of Approval and Development Standards, as presented.
No public testimony was offered concerning this matter.
Upon review of the Conditions of Approval and Development Standards,
Commissioner Maxey recommended striking the last sentence of DS #17. The Board
agreed to the aforementioned change.

Commissioner James moved to approve the request of Cervi Enterprises, Inc.,
c/o Kerr-McGee Oil and Gas Onshore, LP, for Use by Special Review Permit,
USR24-0025, for Oil and Gas Support and Service (substation and compressor station)
outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based
on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended. The motion was
seconded by Commissioner Ross, and it carried unanimously. There being no further
discussion, the hearing was completed at 10:25 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 2nd day of April, A.D., 2025:
