Staff finds that this Use by Special Review is consistent with Section 23-2-220.A.
S ection 23-2-220.A.1. - That the proposal is consistent with Chapter 22 of this Code and any other
applicable code provision or ordinance in effect.
S ection 23-2-220.A.2. - That the proposal is consistent with the intent of the district in which the use is
located.
S ection 23-2-220.A.3. - That the uses which would be permitted will be compatible with the existing
surrounding land uses.
S ection 23-2-220.A.4. - That the USES which would be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the future
development as projected by Chapter 22 of this Code or Master Plans of affected municipalities.
S ection 23-2-220.A.5. - That the application complies with Articles V and Xl of this Chapter if the
proposal is located within an Overlay Zoning District or a Special Flood Hazard Area identified by maps
officially adopted by the County.
S ection 23-2-220.A.6. - That if the use is proposed to be located in the A (Agricultural) Zone District, the
applicant has demonstrated a diligent effort has been made to conserve prime farmland in the locational
decision for the proposed use.
S ection 23-2-220.A.7. - That there is adequate provision for the protection of the health, safety and
welfare of the inhabitants of the neighborhood and the County.

SUBJECT:
Staff has met with the applicant and discussed the road improvements on County Road 40 and
the intersections with HWY 60 and HWY 85. Together with triggers in the Improvements
Agreement and a revised traffic impact study (TIS), staff is requesting that the following
Conditions of Approval be modified:

maintenance includes, but is not limited to, dust control and damage repair to
specified haul routes. The Agreement shall include provisions addressing
engineering requirements, submission of collateral, and testing and approval of
completed improvements. The up -front off -site improvements include:
1. CDOT off -site road improvement requirements:
a. Southbound Highway 60 existing, left turn, deceleration lane, onto
eastbound CR 40 shall be extended to 525, feet plus a 300 -foot
taper, per the State Highway Access Code (SHAC).

c. Extend the U.S. Highway 85 northbound, left, deceleration lane,
turning onto westbound CR 40 by 525 feet, plus a 180 -foot taper, per

turning onto westbound CR 40, to 500 feet, plus a 180 -foot taper, per
SHAC requirements.

design requirements of Chapter 9 of the WCECC manual from US -
85 west for 1,000 linear feet including an 800 -foot eastbound right

The auxiliary turn lane shall meet the WCECC Chapter 4 auxiliary
turn lane design requirements with 200 feet of storage.
