for protection against prairie dogs and ground squirrels , under the provisions of Section 3105
to 3116 inclusive , 1921 Compiled Laws of Colorado . Said petition being verified by M. B . Pierce

Commissioner Straight moved the adoption of the following resolution:
WHEREAS , H . C . Lonaan and this Board have submitted to arbitration the question of
compensation for about 4 . 7 acres of his land taken for a road , and - th : compensation has been
fixed on a basis of 4 . 7 acres of land at V. 0 . 00 per acre ; Cattle pass to be constructed
460 . 00 , total $647 . 00 .
And H . C . Longan is now present and has declared his preference to have the said cattle
pass and fence constructed by the County , and has executed his deed .
RESOLVED , that in consideration for his deed delivered this date to the County , quit
Claim for said 4 . 7 acres , as more particularly described by the center line of said strip ,
warrant shall be issued to the said H . C . Longari for the sum of $137 . 00 .
The County agrees on construction of said road to build on either side thereof , a
four wire fence complete with two rates and with posts of cedar two rods apart . And the
County agrees that it will also at the same time build under said road a cattle pass 14 feet
in width and 7 feet in height at some draw to be selected By H . C . Longan , to be done in a
workman like manner , timbering work to be maintained by the county for the period of lb
years . And said work and construction to be accepted as complete compensation for all
damages for taking of said land and damages to residue if any .

by the assessor at Developed Coal $26 , 960 ; Undeveloped Coal 4P , 380 for 1924 , and hearings
have been had on said 1924 assessment of said property .
RESOLVED , that to properly equalize the 1924 assessment of coal lands on section 25 ,
township 2 north , range 68 west and wouthwest quarter section 31 , township 2 north , range 67
west , the same be valued for 1924 assessment at the sum of Developed coal 019 , 230 ; Undeveloped

F . L . Powars , C . A . Hewitt and D . C . Straight be and they are hereby appointed viewers to
meet at the starting point at 10 : 30 A .M. the 30th day of September , and view the line of
road herein prayed for and file their report thcrenh , as required by law , with the County

To The Board of County Commissioners and
The County Treasurer of ►Veld County , Colorado ,
Greeley Colorado .
Gentlemen :
The following is a full , true and correct copy of a resolution passed and adopted
by the Board of Directors of The Greeley-Poudre Irrigation District , at a meeting of said
Board held in the office of the District at Greeley , Yield County , Colorado , on the 9th day
of ZAug^ust , 1924 , to-wit :
WHEREAS levies have been made by the Board of County Commissioners of Yield County ,
Colorado for payment of interest upon the bonds of The Greoley-Poudre Irrigation District
falling due December 1 , 1912 , and on the first day of June and the first day of December of
each year thereafter to and including December 1 , 1924 , and levies for payment of principal
due upon said bonds in the years 1920 , 1921 , 1922 , 1923 and 1924 , and because of failure to
pau said taxes , practically all of the lands in said District have been sold and for lack of
II bidders have been struck off by the County Treasirer to The Greeley-Poudre Irrigation District
which District now holds said certificates with endorsements thereon for subsequent taxes ;
WHEREAS there has been a concerted effort on behalf of persons interested in the
general welfare of Weld County to form a pool whereby land owners in the District will be able
to deposit bonds of face value sufficient to equal their pro rata share of the bonded indebt-
edness of the District , and by the Committe to be so adjusted that the lands owned by the
depositors of bonds may be redeemed from tax sales insofar as taxes for payment of bond
principal and bond interest in concerned , and all future payment of taxes for bond interest and
and bond principal be paid with bonds and interest coupons , and this Board realizes that it is
for the general benefit of all , ersons in interest to have said pooling agreement perfected
and carried out , and that it is the duty of this Board to do all that it m .;;T legally do to
accomplish said results ;

1\10:i , THEREFORE BE I ,L _:ESOLVED that this Board of Directors for and on behalf of said Irri . ation
District approve and ratify the agreement entered into between the Greeley-Poudre Bondholders
Committe , the Greeley rational Bank as Depositary , and all those owners of lands in The Greeley-
Poudre District who may deposit bonds in said pool , and that this Bo rd shall recognize certifi -
cates of deposit which may be issued by said Bondholders Committe , certified t said Depositary

in carrying out the provisions of that certain contract ratified and approved by the electors
of the District at the land general election held in December 1923 ;

the amount of principal of bonds of The Greeley-Poudre Irrigation District , at such time out-
standing ;
BE IT 11URTHER .SOLVED that the District shall not hereafter levy any maintenance
tax unless it becomes absolutely necessary so to do and v i ill make effort to meet all its
future expenses out of the taxes and heretofore levied ;
BE IT 2JitTHE1 RESOLVED that it be the policy of this Board of Directors to as ., ist
the Greeley-Poudre Bondholders Committe in its effort to cause the lands in this Irrigation
District to be redeemed from tax sales and for such purposes to rake assignment of said tax
sale certificates as they shall be called for , to said Bondholders Committe insofar as the
same pertain to taxes levied for bond principal and bond interest , in exchange for bonds
of the correct maturity and facr value without charging for penalties or interest and to
make partial assignments of such certificates to said Committe under such agreements as may
be made at the time application is ' .ade to th ;_ s Board for such assignments this portion of
the resolution being passed for the purpose of assuring the Committe that the Board of
Directors desires to have said lands redeemed from tax sales ;
BE IT 'JRTHER RESOLVED that until further order of this Board the County Treasurer
of eld County , Colorado , be and he is hereby authorized , empowered and requested to accept
the payment of all maintenance taxes levied on behalf of this District without making charge
for any penalties or interest and that such paymentg as well as payments of general taxes

Commissioner Straight moved the adoption of the fo lowing resolution :
,:HE ES , on the 19th day of august , 1924 , the Board of Directors of The Greeley-
Poudre Irrigation District did , among other things , adopt the following resolution :
BE IT FURTHER i ESOLVED that until further order of this Board the County Treasurer
of ,'geld County , Colorado , be and he is hereby authorized , empowered and requested to accept
the payment of all maintenance taxes levied on behalf of this District without making charge
for any penalties or interest and that such payments , as well as payments of general taxes
due the County be accepted without requirement of payment of taxes due for bond principal
and bond interest and without requirement that redemption be made from tax sales in so far
as the sale was held because of default in payment of taxes levied for bond principal and
bond interest ; it being the intention of this Board to make it possible for land owners to

were redeemed April 18 , 1917 , by order of the County Commissioners , and it appears Ralph
Voorhees is holder of said certificates .
BE IT RESOLVED , that the County Treasurer is authorized and directed to pay to said
Ralph Voorhees for surrender of said certificates the respective amounts of , $7 . 79 - $7 . 79 and
$8 . 93 plus interest from the respective dates of said tax sales , at 8% .

This supplemental agreement , made and intered into this fifteenth day of August ,
1924 , by and between the Union Pacific Railroad Company , a corporation of the State of Utah ,
( hereinafter called "Lessor" ) , and the County of Weld , State of Colorado , ( hereinafter called
"Lessee" ) , WITNESSETH :

1923 , the Lessor leased to the Lessee for highway purposes certain portions of the Lessor ' s
right of way in Weld County , Colorado .
At and in the vicinity of Eaton and Peckham , Colorado , the Lessee will , by agree-
ment of the parties , abandon certain portions of the premised covered by said agreemnt and
will relocate its existing highway on other portions of the right of way of the Lessor to
be leased as hereinafter proveded . In the vicinity of Eaton , Colorado , the Lessee disires
to lease additional right of way for highway purposes .
At Platteville , Colorado , the Lessor contemplates the extension of certain trackage ,
the construction of which will necessitate the use of the right of way between Grand and
Reynolds Avenues which .. as included in said agreement of May 25 , 1923 , and the Lessor desires
the right to take possession of the leased premises between said avenues at any time upon
giving to the Lessee ninety days ' written notice of its desire to use said premises for tail-
road purposes . The Lessee is willing to refrain from constructing any permanent pavement
upon that portion of the highway between said avenues .

In consideration of the leasing to it by the Lessor of said right of way herein-
before described and shown shaded in yellow on said Exhibits "E" and "F" , it is hereby
agreed that Section 3 of said agreement of May 25 , 1923 , in so far as the same pertains
to the premises covered thereby between said Grand and Reynolds Avenues in the Town of
Platteville , shall and is hereby changed to read as follows :
The Lessor reserves the right to take possession of all or any portion of the
leased oremises whenever the use thereof may become necessary or exeedient , in the judgement
of the Lessor , for railroad purposes , including the location of puvlic or private ware-
houses , elevators , or other structures with the design to facilitate and promote traffic ;
PROVIDED , however , that in the event the Lessor elects to take possession of all or any
portion of the leased oremises in accordance v. ith this reservation , it shall first serve
upon the Lessee ninety days ' Britten notice of such election .
The Lessee further agrees that , without the approval of the Lessor , it will not
construct or permit the construction of a concrete or other hard surface road or permanent
pavement on the premises covered by said agreement between said Grand and Reynolds Avenues
in the Tov,n of Platteville , and that an:"- repairs to the present road between said Grand
and Reynolds Avenues shll be made ieith geavel in such a manner as not to interfere with
any trackage or development plans of the Lessor .
This agreement shall be sucplimental to said agreement dated 1,:ay 25 , 1923 , and all
the terms , covenants and conditions of said agreement , except as herein specifically modified
shall continue in full force and effect between the parties hereto .
IN WITNESS WHEREOF , Union Pacific Railroad Company has caused these presents to be
signed by its proper officers thereunto duly authorized , and the County of Weld has caused
these presents to be signed by the Chairman of its Board of County Commissioners pursuant
to authority vested in said Chairman by a resolution duly passed and adopted by said Board of
County Commissioners on the fifteenth day of August , 1924 , and to be attested by its County
Clerk and th.e seal of said County to be hereunto affixed , all on the day and ;-ear first above

In consideration of the leasing to it by the Lessor of said right of way herein-

mises covered thereby between said Grand and Reynolds Avenues in the Town of Platteville ,
shall and is hereby changed to read as follows :
The Lessor reserves the right to take possession of all or any portion of the leased
premises whenefer the use thereof may become necessary or expedient , in the judgment of the
Lessor , for railroad purposes , including the location of public or private warehouses , elevators ,
or other structures with the design to facilitate and promote traffic ; PROVIDED , however ,
that in the event the Lessor elects to take possession of all or any portion of the leased
premises in accordance with this reservation it shall first serve upon the Lessee ninety
days ' written notices of such election .
The Lessee further agrees that , without the approval of the Lessor , it will not
construct or permit the construction of a concrete or other hard surface road or permanent
pavement on the premises covered by said agreement between said Grand and ieynolds Avenues
in the Town of Platteville and that am repairs to the present road between said Grand and
Reynolds Avenues shall be made with ;ravel in such a manner as not to interfere with any
trackage or development plans of the Lessor .
This agrement shall be supplemental to said agreement dated May 25 , 1923 , and all
the terms , covenants and conditions of said agreement , except as herein specifically modified ,
shall continue in full force and effect between the parties hereto .
IN WITNESS WHEREOF , Union Pacific Railroad Company has caused these presents to be
signed by its proper officers thereunto duly authorized , and the County of Weld has ca.uded
these presents to be signed by the Chairman of its Board of County Commissioners pursuant to
authority vested in said Chairman by a resolution duly passed and adopted by said Board of
County Commissioners on the 15th day of August , 1924 , and to be attested by its County Clerk
and the seal of said County to be hereunto affixed , all on the day and year first above written . "

construct a line of single track spur , extending from its main line at or near Tampa station ,
in the SE+ of Section 8 , Township 2 North of Range 63 West , in Weld County Colorado , and
extending from thence approximately south across said SE* of said Section 8 , thence South-
easterly across the W2 of Section 16 , Township 3 North of Range 63 West to a point at or
near the North Quarter line of Section 21 said Township and Range and thence south through
the center of Section 21 , 28 and 33 , Township 2 North of Range 63 West and thru the center
Section 4 , 9 and 16 , Township 1 North of Range 63 West , to a point near the center of said
Section 16 , Township 1 North of Range 63 West , whence said line will turn on a curve to the
West and will extend due West on the center line of Section 16 , Township 1 North of Range
63 West and along said center line thru said Section 16 and Sections 17 and 18 , Township
1 North of Range 63 West , and thru a part of Section 13 , Township 1 North of Range 64 West
to its terminus in the EN of said last named section , a total distance and length of
approximately 9 . 6 miles , and , in addition certain sidings for receiving stations in connection
therewith ; and
WHEREAS , said line will of necessity intersect and cross certain public roads
and highways , including the State Highway between Sections 4 and 9 , Township 1 North of
Range 63 West ; and
WHEREAS , this Board is desirous of granting permission for the crossing of all
of said highlr.-ay ' s by said line of track , in such manner as will not interfere with said
highways .
NOW , THEREFORE , BE IT RESOLVED , by the Board of County Commissioners of Weld County ,
Colorado , that permission is hereby given to said Chicago Burlington & Quincy Railroad Company
to construct , maintain and operate said line of track over and across all said roads and high-
ways , on condition that each crossing and intersection the said Company install proper rail-
road crossings over the tracks and grade the road surface at each and every approach to said
crossings , so as not to interfere with the utility of the highways so intersected and crossed
and upon condition also that the crossings and manner of installation be approved by the
State Highway Commission to the crossing of said State Highway , and that the intersections be
approved by the Public Utilities 'Commission of Colorado , also on condition the Company shall
construct grades 30 feat wide at County road crossings , said grades to be level for 10 feet
from ends of ties , and thereto at an angle not exceeding 4% grade from the County road .
BE IT THEREFORE RESOLVED , that one copy of this resolition be , by th e Clerk of
the Board , forwarded to the State Highway Commissioners , and one copy to the Colorado
Public Utilities Commission , and one copy to the Chicago , Burlington & Quincy Railroad
Company . "

STATEMENT
BY THE COLMISSI0iJ :
This proceeding arised upon the application of the Board of County Commissioner of
Weld County , Colorado , in compliance with section 29 of the Public Utilities Act as amended •
April 16 , 1917 , for the opening of the public highway crossing at grade over the right -of-way,
and track of the Chicago , Burlington & Quincy Railroad Company between Hudson and Keensburg ,
Colorado , at a point on the section line between Sections 29 and 30 , Township 2 North , Range
64 Nest of the sixth Principal Meridian .
The application , dated March 14 , 1924 , and received by the Commission March 17 ,
1924 , was referred to Mr . E . E . '; bitted , General Solicitor for the respondent railroad , _ for
an expression of its attitude in the matter .

Upon Llarch 28 , 1924 , an answer from the attorneys for the railroad to the matters
set forth in the at plication was received by the Commission and three days later an amended
answer was filed stating the disposition of the railroad to oppose the establishment of the
grade crossing at the pint on the section line , but assenting to the utilization , as a
subway , of a masonry culvert about one half mile west of the proposed location . The Board
of County Commissioners of Weld County , requested a hearing in the matter , stating that they
did not favor the subway on account of the drainage problem involved .
On June 11 , 1924 , a party composed of C . A . Hewitt and F . L . Powars , County Comm-
issioners of Weld County ; C . W. Charleston and H . A . Aalberg , Engineers and P . Herigstad ,
Roadmaster for the Railroad ; L . L . Stimson , and Engineer from Greeley employed by Weld County ;
and W . L . Reynolds , Railway and Hydraulic Engineer for this Commission , made an inspection
of the two sites and the adjacent features . Mr . Reynolds made a report on conditions as
they appeared to him stating that the culvert lacked sufficient headroom , that the connecting
roadway on the south wo,; ld be expensive and ' that facilities for draining the subway were not
favorable , expressing an opinion that the grade crossing as proposed in the application had
better merit . Copies of this report were sent to both the County Commissioners and the
railroad and on July 21 , 1924 , a letter from J . H . Barwise , Attorney for the railroad , was
received waiving its contention for a subway crossing and consenting to the grade crossing
on the section line , under the usual terms of division of cost .
An agreement having been. reached as to location and division of cost and it appear-
ing that public convenience and necessity require the establishment of the crossing as set
forth in the application , the Commission will , therefore , issue its order granting the request
of the application under the conditions as herein set forth .

IT IS THEREFORE ORDERED , That in accordance with Section 29 of the Public Utilities
Act of the State of Colorado , as amended April 16 , 1917 , a public highway crossing at grade
shall be , and the same is hereby permitted to be opened and established o-. er the main line
track of the Chicago , Burlington , & Quincy Railroad Company between Hudson and reensburg at
a point where the north and south section line between Sections 29 and 30 , Township 2 North ,
Range 64 West of the sixth Principal Meridian crosses said track , conditioned , however , that
before said crossing shall be opened to public travel it shall be constructed in accordance
with plans and specifications prescribed in the Commission ' s order in re-Improvement of
Grade Crossings in Colorado , 2 Colo . P. U . C . 128 .
IT IS FURTHER OR: EH:ED , That the expense of construction and maintenance of grading
the roadway , including the necessary drainage therefor at said new crossing shall be borne
by Weld County , Colorado , and that all other expense in the matter of installation and main-
tenance of said crossing shall be b .) rne by the Chicago , Burling on & uincy Railroad Company .

Comes now the Chicago , Burlington & Quincy Railroad Company and for amended answer
to the application filed in the above entitled matter says :
•1 . Said Railroad Company admits the allegations of Paragraph 1 of said a !Tlication .
,2 . Said Railroad Company denies each and every allegation contained in Paragraph 2
of said application .
3, . For further answer said Railroad Company respectfully says that there is now a
subway crossing under its railroad about one-half mile west of the crossing proposed in said
application and that said sub<<:'ay crossing can be made useable and will be a convenient and
absolutely safe crossing if roads are built thereto , which can be done at a small expense ,
that at this time in view of the numerous accidents occurin : at crossings because of coll-
isions between automobiles and railroad trains it is highly desirable that any underground
crossing , such as the one above mentioned , should be taken advantage of and used in prefer-
ence to a grade crosJing ; that said under-ground crossing , if roads are built thereto , will

serve all purposes which the proposed crossing would serve if established ; that there is another
crossing at grade over said railroad about one mile east of the crrossinF proposed in said appli -
cation ; said last metti oned cross in be in. at the place in said county called Roy ; that the
said subway cros sin -r and the said crossing at Roy furnish all means for crossing said railroad
in the vicinity of the proposed crossins. , that are necessary , convenient or desirable and an
additional crossing at the place proposed in said applic ation is and will be unnecessary .
The establishment thereof will create an expense which is and will be unnecessary and which will
be unaccompanied with any commensurate benefit to the public and will create an additional
source of danger to the traveling public . 11 -d the employes and passengers upon said railroad .
WHEREFORE , said Railroad Company prays that an order be made herein estahlihing the
said subway as a public crossing , that said county be required to make roads thereto instead
of to the point whee crossing is asked in said application and that said application be dis -
missed .

Directors , to -wit :
"That on Julyll , 1916 , said Board included within the boundaries of said Irrigation
District said above described land , based upon a position and contract of petitioner to include
said land , which he had made entry upon the Public Land Laws , when he received final title
therefor ; that petitioner received patent for said land March 10 , 1916 .
That the land of your petitioner has rev r been cultivated and irrigated and is now ,
and always has been , incapable of cultivation by irrigation from the irrigation system of siad
irrigation district by reason of the fact that water from said irrigation system cannot be con-
duced upon the land of your petitioner except by a lateral 11- miles in length ; that said
lateral runs over and across land that is wholly sandy and porous to such an extent that water
turned in at the head of said lateral from said irrigation system will practically entirely
dlisappear in the sands and porous soil across which said lateral traverses before reaching the
land of your petitioner and it is now and always has been, impossible to obtain water from the
irrigation system of said District in any beneficial amount upon the land of your petitioner.
That the location of petitioner ' s said land and the unsuitable character and quality
of the soil makes the l .nd of your petitioner unsuitable for irri :-7ation and cultivation from
the irrigation system of the District and incapable of irrigation and cultivation except at
a great financial loss .
That your petitioner did not participate in the organization of said District .
That your petitioner has paid to the County Treasurer of Weld County , Colorado , all
- taxes other than taxes fo" irrigation district , purposes , levied or assessed thereon and no
such taxes or interest , penalties or fees thereon are by law due or properly chargab le against
said land , " and .

WHEREAS , said petition has b , en duly published as required by law , and said Board
having heard the evidence in support of the allegations therein and being now fully advised in
the premises
BO 'H HEREBY FIND , that by law said above described land , and all thereof , should be
excluded from said District , removed from the assessment rolls of Weld County , Colorado , for
11 irrigation district purposes and that all Irrigation District taxes should be cancelled and
annulled , and that the relief prayed for in said petition should in all respects be granted
IT IS , THEREFORE ,

Oi DEa ED that the order and resolution of this Board of July 11 , 1916 , purporting to
include said land insaid District , be , and the same is hereby , cancelled , annulled and set
aside , with the same force and effect as if said resolution had never been adopted .
Il IS FURTHEP (MDERED , That the Board of County Commissioners of Weld County , Colo-
rado , be and the same hereby is , instructed to require the County Treasurer of Weld County ,
Colorado , to cancel all purported taxes , both past Lend future , for the Denver-St Vrain Municipal
Irrigation District purposes , against said land , and to require the County Assessor of Weld
County , Colorado , to remove said land from the assessment rolls of Weld County , Colorado ,
so far as the assessment for The Denver-St Vrain Lunicipal Irri 7 Lion District purposes is
concerned .
IT IS FLJPTHE ORDERED , that a certified copy of this resolution shall be full authority
to the Board of County Commissioners , The County Treasurer and the County Assessor of Weld
County , Colorado , for the cancellation of all Irrigation District taxes against the above de-
scribed land for the ommission of said land from future taxation for Irrigation District purposes ,
unless said land shall hereafter be regularly included within said District .

1 `, 2,ESOLIV'ED , That a public road 60 feet in width , be established , being 30 feet each
side of a line described as follows :
Beginning at a point which is the southeast corner of section 26
and is the southwest corner of section 25 , in township 6 north
of ran-;e 58 west of the 6th P . M . ; running thence northerly along
the said section line to a Point which is 30 feet north of the
quarter corner between said two sections ; from said quarter
corner running easterly on the east and west center line of said sec -
tion 25 to a point 30 feet east of the southeast corner of the west
half of the northwest quarter of said section 25 ; from said corner running north
along the line between the west half and the east half of said
northwest quarter to the north line of said section 25 ; all in Weld
County , Colorado .
And that the County Attorney is instructed to bring eminent domain proceedings to
acquire the right of way for said roaa for a public highway and for immediate possession .

WHE S , it is understood that the Colorado State Highway Department has allocated certain
Fede al Aid Funds for construction purposes on State Road No . 2 , from Fort Morgan west and
it is further understood that this allocation of dunds is not entirely agreeable to the
County Commissioners of Morgan County and
WHEREAS the County Commissioners of Weld County feel that any section on the part of any
County which would tend to delay the development and completion of State Road No . 2 between
Fort Morgan and Greeley is inadvisable .
THEREFORE be it received that the Board of County Commissioners of Weld County due hereby
request the Colorado State Highway Department to transfer such funds as may have been
allocated in Morgan County to the continuation of State Road No . 2 , from Greeley east .
Be it further resolved that the Board of County Commissioners of Weld County are ready and
willing to sign such agreement pertaining to the acquisition of right of way and the main-
tenance of completed projects as have heretofore been signed and are made a part of the
a regiment with the various counties for the allocation of Federal Aid Funds .

Whereas , Weld County has petitioned the Court in the above entitled estate to allow
the claim of Weld County for taxes , and to vacate its previous order disallowing said claim ,
and the county , through its County Treasurer and County Commissioners , are insisting that they
propose to carry the prosecution of the claim for said tuxes to the Supreme Court of the State
in effort to obtain a favorable adjudication of said claim ,
AND HREAS , said clim , with interest at statutory rates , is now in excess of the
sum of $1000 , and the expense to each party in litigating said claim , including counsel fees
and court costs , and costs incident to recording , printing. and other expenses on writ of error ,
might equal $500 . 00 , and is certain to cause additional expense and delay to each ;
AND ,iHEI?EAJ , said estate is now ready to be finally settled and distributed among
the creditors , and the cost of litigation might be more than the compromise fi -~lure hereinafter
set forth , beside the loss of interest to the claimants and other persons interested , and the
delay caused thereby might be as much as three years , and it seems to the best interest of
said estate , as well as of the County of Weld , to compromise said dispute , and to finally and
fully settle on a basis of litigation costs and the uncertainties of outcome of said litigation ;
THEREFORE , it is stipulated by and between the attorneys for said estate and the
County Attorney of Weld County that said claim of the county heretofore filed in sid estate ,
may be reviewed and order entered that it shall be compromised and fully settled by payment to
the County Treasurer of field County the sum of OOC . 00 .
