to the A (Agricultural) Zone District — West Greeley Conservation District
A public hearing was conducted on February 19, 2025, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated January 16, 2025, and duly published
January 22, 2025, in the Greeley Tribune, a public hearing was conducted to consider the
request of the West Greeley Conservation District, for Change of Zone, COZ24-0007,
from the R-1 (Low Density Residential) Zone District to the A (Agricultural) Zone District.
Karin McDougal, Deputy County Attorney, made this a matter of record.
El Diana Aungst, Department of Planning Services, presented a brief summary of the
proposal, and described the sign posting and location of the site. She shared 22 referrals
were sent out, 16 agencies responded without concerns or included conditions which are
addressed in the Conditions of Approval (COA), and six (6) agencies did not respond.
Ms. Aungst elaborated on the COZ request, which encompasses four (4) parcels, or
approximately 48 acres. She described the structures, including a residence on the
southern portion of the site, noted one of the parcels is partially in the floodplain,
encumbered by USR-832, for an Oil and Gas Production Facility, and is zoned R-1 (Low
Density Residential); therefore, the USR will need to be either vacated or partially
vacated, prior to recording the COZ Plat. She described the surrounding properties and
zoned uses, and explained the site is located in an Opportunity Zone, approximately 1/3
mile northeast of the City of Greeley, and partially in the Municipal Separate Storm Sewer
System (MS4) overlay and consists of mostly cropland. She relayed 38 Notices were sent
to surrounding property owners (SPOs) and no correspondence was received back.

Ms. Aungst explained the site is located within the Coordinated Planning Agreement area
of the City of Evans and the Town of Kersey, and both returned their Notice of Inquiry
(NOI) stating they are not interested in annexation. She further stated the property is
located within the City of Greeley's Growth Management Area, as well as their Long
Range Expected Growth Area, in which the community anticipates annexation and urban
development to occur in the future, and their Comprehensive Plan indicates the property
as Future Suburban Area; however, the site does not currently meet the requirements for
annexation. She shared, per the Development Review staff, the COZ does not trigger
access road standards, per the Weld County Code, the parcels are located within an MS4
area; however, there are no MS4 requirements at this time, and any future commercial or
industrial uses will have to be approved through a USR or Zoning Permit process. She
explained the COA will apply to this zone change and any future USR or zoning permit
and will adequately address and mitigate potential impacts. Ms. Aungst entered the
favorable recommendation of the Planning Commission into the record, as written, and
displayed images of the site and surrounding views. In response to Commissioner Maxey,
Ms. Aungst explained how a full or partial vacation of the USR will be determined.
Lauren Light, Department of Public Health and Environment, stated the parcel will be
served by City of Greeley for water and on -site wastewater treatment systems, as
necessary, there is an existing septic system near the residential home site, and the
applicant indicates the residence is no longer being utilized and will be demolished. She
shared water and sewer notes are recommended for the plat.
El Jason York, J&T Consulting, Inc., represented the applicant, and in response to Chair
Buck, indicated they had not had contact with any of the Commissioners regarding this
case. Mr. York presented a PowerPoint slide show (Exhibit D), elaborating on the West
Greeley Conservation District and the location of the site. He shared the proposed COZ
is consistent with the Weld County Comprehensive Plan, stating the location has been in
ongoing agricultural production. In response to Commissioner Ross, Mr. York explained
there is no property currently adjacent for consideration of annexation into the City of
Greeley.
No public testimony was offered concerning this matter.
In response to Chair Buck, Mr. York indicated they have reviewed, and agreed to
abide by, the Conditions of Approval, as presented.

Commissioner Ross moved to approve the request of the West Greeley Conservation
District for Change of Zone, COZ24-0007, from the R-1 (Low Density Residential) Zone
District to the A (Agricultural) Zone District, based on the recommendations of Planning

staff and the Planning Commission, with the Conditions of Approval, as presented. The
motion was seconded by Commissioner Peppier, and it carried unanimously. There being
no further discussion, the hearing was completed at 10:26 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 5th day of March, A.D., 2025:
