WHEREAS, heretofore the Board of County Commissioners,
Weld County, Colorado, by resolution, created a PUBLIC WORKS
FUND-COUNTY SERVICES BUILDING, in the office of the Weld
County Treasurer, and
WHEREAS, it has been determined by the Board that it would
be in the best interest of the County that all moneys credited to said
fund be invested and re-invested and all interest therefrom be
credited to said account and used solely for the specific purpose or
purposes of the account so long as said account is in existence.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, Weld County, Colorado, and it hereby
authorizes and directs the County Treasurer to invest and re-invest
all funds in the PUBLIC WORKS FUND-COUNTY SERVICES
BUILDING, and to credit said account with all interest received
from such investment or investments for the benefit of the purpose
or purposes for which the account was created and to be maintained
until further order of the Board.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
July, A.D. , 1974.

Gentlemen:
Your question, "May funds in the Public Works Fund - County
Services Building be invested and re-invested and interest therefrom
be credited to and maintained within said account" ?
The answer is, yes.
Colorado Revised Statutes 1963, 35-7-10. APPORTIONMENT
AND SEPARATION OF FUNDS, provides in part as follows: "It
shall be the duty of the county treasurer to apportion, and keep all
taxes collected by him in the several funds for which the taxes were
levied, and it shall not be lawful to use the moneys belonging to
any fund, for the purpose of paying warrants drawn or which
properly should have been drawn upon some other fund; provided,
that the amount of interest gained through the investment of county
funds, regardless of the origin of such funds, may be credited to
the general fund of the county by the county treasurer, unless such
investment is made from specific funds allocated for a definite
purpose and so maintained
In view of the above, it is my opinion that any interest accruing
on moneys in the Public Works Fund - County Services Building Account
may, by resolution of the Board of County Commissioners, be ear-
marked for a specific purpose and so maintained and not necessarily
be credited to the general fund.
