The proposal has been reviewed by Development Review on behalf of the Weld County Department of
Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the
application process may not be all-inclusive, as other issues may arise during the remaining application
process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Use by Special Review Permit, for Oil and Gas Support and Service (Material Storage
Yard, specifically for recycled road base, riprap, etc.) outside of subdivisions and historic townsites in the
A (Agricultural) Zone District.
This project is south of County Road 74 and is west of and adjacent to County Road 47.
Parcel number 080302100004.
Access is from County Road 47.
ACCESS
Development Review has reviewed the application materials related to access. The applicant is proposing
to use an existing access onto County Road 47 located approximately 1,405 feet south of County Road 74.
Per Section 8-14-30.B.3., an Access Permit is required for changing the use or type of traffic of any existing
access location. Please refer to Chapter 8 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 47 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the USR map the existing right-of-way (along with its creating document) and the physical
location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of
setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the future right-
of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is
maintained by Weld County.
Per Chapter 8, Article 13, Section 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing, or excavating facilities within, and or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at:

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on County Road 47 counted 422 vpd with 40`)/0 trucks. The 85th percentile speed is 50 mph.
The traffic information submitted with the application materials indicates that there will be approximately 20
passenger car/pickup truck daily roundtrips and 44 semi -truck daily roundtrips. 30% of the traffic will be
going to the south on County Road 47 and 70% of the traffic will be going to the north on County Road 47.
The semi -truck traffic will occur throughout the day and is anticipated to be intermittent based on the
construction needs at the development areas.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to gravel
roads, tracking control devices must be either double cattle guards with 100 feet of road base, or road base
on all driving surfaces. Recycled concrete is not allowed in County right-of-way.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Development Review is requesting an Improvements and Road Maintenance Agreement including, but not
limited to, dust control and damage repair to specified haul routes, and possible triggered and/or upfront
off -site improvements.

DRAINAGE REQUIREMENTS
This area is within a Non -urbanizing Drainage Area. Non -urbanizing Drainage Areas typically require
detention of stormwater runoff from the 1 -hour, 100 -year storm event falling on the developed site and
release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm event falling on the
undeveloped site having a 2`)/0 impervious value.
The applicant has submitted a preliminary drainage report. A final drainage report and detention pond
design completed by a Colorado Licensed Professional Engineer (P.E.) is required prior to recording the
USR map. The drainage report must include a Certificate of Compliance stamped and signed by the P.E.

Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist on the
property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than one (1) acre of land. Grading Permit
applications are accepted after the planning process is complete (map recorded). An Early Release
Request Form may be entertained only after the applicant, Public Works and Planning Department have
reviewed the referral and surrounding property owner comments. The Early Release Request may or may
not be granted depending on referral comments and surrounding property owner concerns. Contact

COLORADO CONSTRUCTION STORMWATER DISCHARGE PERMIT
A Colorado Stormwater Discharge Permit is required when disturbing more than one (1) acre of land.

CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement including, but not limited to, dust control, damage
repair to specified haul routes, and possible triggered and/or upfront off -site improvements is required.

B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Development Review)
C. The USR map shall be amended to delineate the following:
1. County Road 47 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate and label on the USR map the existing right-of-way (along with its creating document)
and the physical location of the road. All setbacks shall be measured from the edge of right-of-
way. This road is maintained by Weld County. (Development Review)
2. Show and label the approved tracking control. (Development Review)
3. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Development Review)
4. Show and label the accepted drainage features. Stormwater ponds should be labeled as
"Stormwater Detention, No -Build or Storage Area" and shall include the calculated water quality
and detention volumes. (Development Review)
5. Show and label the drainage flow arrows. (Development Review)
6. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Development Review)
Prior to Construction:
A. The approved tracking control shall be constructed prior to on -site construction. (Development Review)
B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

C. Overweight and/or oversized special transport permits from the Department of Public Works shall be
acquired for all applicable trucks. (Development Review)
Prior to Operation:
A. Submit a certification from a professional engineer, licensed in the State of Colorado, that the
drainage/detention measures have been constructed in accordance with the accepted drainage report.

B. The applicant shall construct all stormwater runoff control features and conveyance elements and install
all sediment and erosion control measures specified in the accepted Final Drainage Report and Grading

DEVELOPMENT STANDARDS (NOTES ON THE USR MAP)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Development Review)
5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned

Re: USR25-0003 Applicant: Noble Energy, Inc.
Environmental Health Services has reviewed the Site -Specific Development Plan and Use by
Special Review for Oil and Gas Support and Service (Material Storage Yard, specifically for
recycled road base, riprap, etc.) outside of subdivisions and historic townsites in the A
(Agricultural) Zone District.
The application states that portable toilets will be provided for two full-time onsite employees
and drivers. Portable toilets follow EH policy.
The dust abatement plan outlines that a water truck will be present onsite, the access road
will be gravel, speeds will be reduced, and site activities will be paused during high wind
events.
According to the Waste Handling Plan, a dumpster will be available onsite, and no chemicals
will be stored on the premises.
A noise evaluation letter was provided, stating that minimal noise impacts are expected due
to staggered traffic throughout the day, no overnight parking or idling, operations during
daytime hours, and brief visit durations.
Environmental Health Services recommends that the following requirements be incorporated
into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.

2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code and the accepted waste handling plan.
4. Fugitive dust should attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations and
the accepted dust abatement plan.
5. Any On -site Wastewater Treatment System located on the property must comply with
all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment
Systems.
6. Adequate drinking, handwashing and toilet facilities shall be provided for employees
and patrons of the facility, at all times. A permanent, adequate water supply shall be
provided for drinking and sanitary purposes, as necessary.
7. For employees or contractors on site for less than 2 consecutive hours a day, and 2
or less full-time employees on site, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be retained on
a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County, contain hand sanitizers and be screened from existing adjacent
residential properties and public rights -of -way.
8. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Hello Amy,
Thank you for the revised reports to reflect the closure and impacts. We are satisfied with the level of input we
have had on this project. Though the majority of your porject's traffic is headed south to 392, my concern remains
with the CR 74 & 47 intersection and traffic coming in on CR 74 eastbound over the hill at posted speed and the
blind spot CR47 to the east. I would ask the county to consider lowering the speed or placing some warning on that
approach. Molly is cc'd here. Let me know if you need anything more.

I just dove into the traffic study for the Chevron Material Storage Yard. It was conducted on April 8. While out of the
hazard and work zones, on April 6-16 we had CR 72 shutdown at 49 & 53 due to loss of containment of an oil well.
These closures impacted the entire area CR 51, CR 49 were closed as well . All traffic was diverted to other roads
and an increase in traffic to CR 74 likely as it this was major emergency. I d0 not think this study is representative

Dear Mr. Muller:
Thank you for your memorandum with recommendations regarding Chevron's proposed Material Storage
Yard (Weld County USR25-0003), dated March 6, 2025. Below are responses to each recommendation.
1. Construction Timing/Mule Deer Severe Winter Range HPH. CPW recommends that construction of this
laydown yard occurs during the non -winter months (May 1 to Nov. 30), since it occurs in a High Priority
Habitat for Mule Deer Severe Winter Range that has a recommended timing stipulation of Dec. 1 to April 30.
Response: Chevron will do its best to accommodate this request by scheduling and planning to construct
outside non -winter months unless development plans require otherwise.
2. Cumulative Impacts Assessment/Mule Deer Severe Winter Range HPH. Furthermore, CPW recommends
that the Applicant include these HPH (High Priority Habitat) and SWAP (State Wildlife Action Plan) acre
impacts in their Cumulative Impacts assessment for the OGDPs (Oil and Gas Development Plans) that will
use this laydown yard.
Response: This laydown yard will be in support of many future OGDP projects in the northern portion of our
acreage. Therefore, it is not feasible to include the laydown yard HPH and SWAP acre impacts into a CI
assessment for a particular OGDP.
3. Fencing. CPW recommends that if fencing (project perimeter or internal) is erected, either during or after
construction of the project, it should be the type that would allow the free passage of wildlife. This will
help to ensure the safety of mule deer, white-tailed deer, and pronghorn antelope in the project area.
Fencing plans should avoid the use of woven wire -type fences that will trap or prevent the movement of
wildlife. CPW recommends using three or four -strand smooth -wire fencing with a minimum bottom strand
height of 17 inches above ground level and a maximum top strand height of 42 inches above ground level,
along with the installation of double stays between posts.
Response: Chevron recognizes the importance of accommodating wildlife in the area while also ensuring the
security and safety of the facility. Unfortunately, the recommended fencing design does not align with site
security requirements. However, Chevron will take into account the design recommendations for Exclusion

Fencing found in the "Fencing with wildlife in Mind" brochure in order to limit potential problems with
trapped wildlife.
4. Noxious Weeds and Native Re -seeding. The revegetation of disturbed areas and control of invasive weed
species are important components of the project and it is critically important that the site be restored back
to the native plant community that currently exists on site. It is preferable that native vegetation be
retained on -site during the operational lifespan of the project, both as potential habitat for wildlife and to
ensure successful reclamation of the project area, as noxious weeds could spread to adjacent habitats
outside the project area. CPW recommends that the applicant consult with Weld County and the Natural
Resource Conservation Service (NRCS) for current noxious weed best management practices.
Response: All disturbed areas that can be stabilized with native reseeding following construction will be
reseeded accordingly. Post -construction, this site will also be included in Chevron's ongoing weed control and
mowing program to manage noxious weeds.
5. Lighting. Per the U.S Fish and Wildlife Service recommendations, all outdoor lighting should be limited to
warmer colors with "longer wavelengths (>560 nm) and lower correlated color temperatures (CCT<3000
Kelvin degrees)" ("Threats to Birds: Collisions - Nighttime Lighting I U.S. Fish & Wildlife Service"). Per the
American Bird Conservancy, CCTs ranging from 2200 Kelvin Degrees to 2700 Kelvin Degrees is the preferred
range of color. (Misguiding Light: The Role Artificial Light Plays in Bird Mortality from Collisions with Glass
Sheppard, PHD) CPW recommends the latter range of lighting color options for implementation at the
project site.
Response: No lighting is planned for this site. There will be no nighttime operations.

Thank you for the opportunity for Colorado Parks and Wildlife (CPW) to comment on the
proposed Chevron Material Storage Yard Project. It is our understanding that the project is
located in Section 2 of T6N, R65W. The proposed use of the site is for Oil and Gas Support and
Service (Material Storage Yard, specifically for recycled road base, riprap, etc.) for Chevron's
Colt Maverick and West Pony development areas.
The mission of CPW is to perpetuate the wildlife resources of the state, to provide a quality
state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities
that educate and inspire current and future generations to serve as active stewards of
Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species
in Colorado, and to promote a variety of recreational opportunities throughout Colorado. One
way we achieve this goal is by responding to referral comment requests, as is the case for this
project.
After review of this project and location, CPW has the following recommendations:
RECOMMENDATIONS:
The Importance Of High Priority Habitats
Developers and permitting agencies can help avoid, minimize, and mitigate impacts to
wildlife from their projects by working with CPW. High Priority Habitats (HPH) are defined as
sensitive habitats where CPW has recent maps regarding sensitive wildlife use, plus
scientifically -backed best management practice (BMP) recommendations. HPHs are a subset
of CPW's species activity maps that we collect and update for a variety of species and their
particular habitats; we provide these maps to the public and regulatory agencies for the

parcel, and general scientific research.
Mule Deer Severe Winter Range HPH
Mule Deer Severe Winter Range is the portion of a species' range where 90% of individuals are
found during the harshest two winters out of ten, when snowpack is highest and temperatures
are lowest. Mule Deer Severe Winter Range is present in and surrounding the proposed site.
For the identified portions of the proposed Project area that traverse Mule Deer Severe
Winter Range, CPW recommends the following timing limitation be implemented for
construction and operation:
• CPW recommends that construction of this laydown yard occurs during the non -winter

Lighting
Nighttime artificial lighting has been documented to affect wildlife species of all sizes, from
small macroinvertebrates to large mammals. These effects are often species -specific, and in
some cases may be beneficial to one species within a local ecological community, but
detrimental to another species within the same ecological community. These impacts could be
expected year-round and can affect both local resident species and migrating wildlife, which
may lead to collisions with other animals and structures, exhaustion, increased depredation,
and direct mortality. Nighttime artificial lighting may also disrupt nocturnal species that are
not accustomed to a significant increase in artificial light, leading to temporary blindness and
disorientation, which may also increase the likelihood of collisions with infrastructure on site.
CPW recommends that all outdoor lighting be down -shielded to minimize disturbance areas
and dim the lights as much as practicable.
Per the U.S Fish and Wildlife Service recommendations, all outdoor lighting should be limited
