As part of that passaround the Public Works Dept. requested the ability to negotiate any counteroffers within a specific boundary. This accepted offer for the Burch Family, LLLP ROW acquisition, which has been signed by the owner, is within those boundaries previously approved. The Public Works Dept. will have a representative available at the meeting to answer any questions. 2025-2402 S/Z5 EelOU S3 BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: High Plains Blvd. Between WCR 32 & 34 — Corrected Initial ROW Offers (Blue Sky Dairy, Fischer, Viscariello, Getman, and Burch) DEPARTMENT: Public Works DATE: 5/15/25 PERSON REQUESTING: Cameron Parrott Brief description of the problem/issue: We have recently received appraisals for the right-of-way acquisitions needed for the High Plains Blvd. project. Staff determined that an error had been made in the calculation for the incentives that was originally presented to the BOCC and is shown corrected in this document. After reviewing the comps used in both appraisals, we believe that the land values determined by the owner's appraiser appear to be low. Fischer: There didn't appear to be any major differences between county and the owner's appraisals for the Fischer property. This is pastureland for horses with a residence well away from the new roadway. Viscariello: The Viscariello property is a smaller residential property and the major differences between the appraisals received appear to be in relation to the easement values and the damages to the property. The difference in easement values between the two appraisals is $10,500 in the county appraisal vs. $22,500 in the owner's appraisal for a total difference of $12,000. These differences are attributed to the county appraiser valuing the easements as 50% value while the owner's appraisal shows these at 90% value. These are permanent easements which do limit what the owner will be able to do in those areas in the future. The difference in damages between the two appraisals is $27,200 in the county appraisal vs. $57,600 in the owner's appraisal for a total difference of $30,400. This is mainly attributed to the reduction in property value due to the proximity of the new roadway found in the owner's appraisal. Getman: There didn't appear to be any major differences between county and the owner's appraisals for the Getman property. This is a farmed field with a residence well away from the new roadway. The county's appraisal had the land value slightly higher than the owner's appraisal. Burch Family LLP: The Burch Family LLP property is a large, farmed field within the Town of Mead which already has a subdivision plat and zoning attached to it. Our project will pass though areas zoned as General Commercial and Residential. The major differences between the appraisals received for the Burch Family LLP property appear to be in relation to the land and easement values. The difference in land values between the two appraisals is $631,300 in the county appraisal vs. $703,400 in the owner's appraisal for a total difference of $72,100. The difference in easement values between the two appraisals is $165,600 in the county appraisal vs. $414,000 in the owner's appraisal for a total difference of $248,400. These differences are attributed to the county appraiser valuing the easements at 50% value while the owner's appraisal shows these ranging from 45% to 90% value based on location. These are permanent easements which do limit what the owner will be able to do in those areas in the future. These differences in land and easement values also contribute to a difference in the 30% incentive offered. The difference between the two incentives is $239,100 from the county appraisal vs. $335,200 from the owner's appraisal for a total difference of $96,100. The damages listed in both appraisals for the Burch Family LLP property did not include impacts to an existing center pivot sprinkler. Staff estimates that damages associated with this sprinkler could be in the range of $100,000 to $150,000. Staff is asking if this amount could be included as part of the negotiations process following this initial offer. This would keep the ROW acquisition process moving forward without needing to reconnect with the BOCC to ask to include this anticipated increased amount of compensation to this owner. Staff would like to extend initial offers for these purchases as follows: • Blue Sky Dairy — Extend initial offer based on the county's appraisal $330,000 • Marth Fischer — Extend initial offer based on the owner's appraisal $377,200 • Viscariello — Extend initial offer based on the owner's appraisal values for $137,100 • Mark & Linda Getman — Extend initial offer based on the county's appraisal values for $117,800 • Burch Family LLP — Extend initial offer based on owner's land values and damages but split the difference in the value of the easements between the county and the owner's appraisal values. This would make the initial offer $703,500 for the land, $289,800 for the easements, $298,000 for the 30% Incentive on land values, and $7,600 for damages for a total initial offer of $1,298,800 What options exist for the Board? Allow staff to make offers for these ROW acquisitions based on staff suggestions shown above Deny staff to make offers for these ROW acquisitions Consequences: Denial of making offers for these ROW acquisitions will delay the project. Impacts: The ROW acquisition phase of this project is controlling the entire project schedule and the ability to meet completion goals. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): $330,000 + $377,200 + $137,100 + $117,800 + $1,298,800 for a total of $2,260,900 for these properties. Recommendation: Staff recommends extending initial offers for these acquisitions based on the described values listed above for a total amount of $2,260,900. Staff also recommends the BOCC allow the department to negotiate counter offers for the acquisitions up to $2,600,000.
