CHANGE OF ZONE APPLICATION - PLANNING QUESTIONNAIRE
The following information addresses each section of the Change of Zone application Planning
Questionnaire and is separated into responses for each specific section.
1. Describe the purpose of the proposed Change of Zone.
The proposed Change of Zone (COZ) is for the purpose changing the zoning on the
property to match its historic use of agricultural production which was corn in the early
2000's and then changing to pastureland as the current agricultural use, and allow
agricultural uses/activities by right. The property will also be the future location for the
West Greeley Conservation District office. The property is currently zoned residential
R-1.
2. Describe the current and previous use of the land.
The land is currently and has previously been used to cultivate agricultural crops.
3. Describe the proximity of the proposed use to residences.
There are residences combined with agricultural uses on large lots/tracts (1+ acres)
adjacent to the property on the east and west sides.
The property is bounded by E 18th Street on the north. There are residences on 0.4+
acre lots immediately north of E 18th Street.
The property is bounded by US Hwy 34 (Business Loop) on the south. There are
residences combined with agricultural uses on large lots/tracts (1.6+ acres)
immediately south of US Hwy 34 (Business Loop).
4. Explain how the proposed rezoning will correct what the applicant perceives as
faulty zoning, or how the proposed rezoning will fit with what the applicant
perceives as the changing conditions in the area.
The proposed agricultural zoning will match the property's historic, current, and future
agricultural use, and allow agricultural uses/activities by right.
5. Explain how the uses allowed by the proposed rezoning will be compatible with the
surrounding land uses. Include a description of existing land uses for all properties
adjacent to the subject property.
To the east, south, and west of the property the surrounding land uses are agricultural
(crops, livestock) with interspersed single-family residences. To the north the land
uses are single-family residences. The proposed agricultural zoning allowed uses will
be similar to the agricultural uses of the majority of the adjacent properties and will
therefore compatible with the uses in the area.
6. Does the soil report indicate the existence of moderate or severe soil limitations? If
so, detail the methods to be employed to mitigate the limitations for the uses
proposed.
The soil report does not indicate and moderate or severe soil limitations.
7. Explain how this proposal is consistent with the Weld County Comprehensive Plan
per Chapter 22 of the Weld County Code.

The Weld County Comprehensive Plan identifies the area where this property is
located as an annexation area, urban area, within a Weld County Opportunity Zone.
The area is adjacent to the east City of Greeley boundary. The agricultural use of the
property will conserve its ability to be developed in the future if the city ultimately
annexes and expands into this area.
8. Explain how this proposal will be compatible with future development of the
surrounding area or adopted master plans of affected municipalities.
The property is not currently within the City of Greeley boundary. The City of Greeley
comprehensive plan identifies the area where this property is located as a long range
expected growth area suitable for future development. The agricultural use of the
property will conserve its ability to be developed in the future if the city ultimately
annexes and expands into this area.
9. Explain how this proposal impacts the protection of the health, safety and welfare of
the inhabitants of the neighborhood and the County.
The current agricultural land use on the property will not change and does not cause
an adverse impact on the health, safety and welfare of the members of the
neighborhood or the County.
10. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the
proposal is located within any Overlay Zoning District (Airport, Geologic Hazard, or
Historic Townsites Overlay Districts) or a Special Flood Hazard Area identified by
maps officially adopted by the County.
The property does not lie within a Geologic Hazard Overlay District.
Per the Weld County Comprehensive Plan Map the property lies within a Historic
Townsites Overlay District. All County procedures for any future development within
the District, and the preservation of the rural character of the area will be followed.
The property lies within the Greeley -Weld County Airport Overlay District. Any/all uses
at the site will comply with the Airport Zone height restrictions, will not cause any visual
or communications interference with the airport, and will not cause any other safety
hazard to the airport. The Federal Aviation Administration will be notified of any
proposed future construction that may cause a temporary or permanent obstruction
within the Airport Zone.
A small portion of the property, approximately 7 acres of the 49 total acres, on the
southern boundary lies within the South Platte River 100 -year floodplain. Uses on the
site including any future development within this small portion in the floodplain will
comply with all floodplain use regulations, including obtaining Flood Hazard
Development permits and floodproofing structures, and will comply with all standards
for uses/development within Special Flood Hazard areas.

commercial/industrial, and/or oil and gas) of all existing and proposed accesses to
the parcel. Include the approximate distance each access is (or will be if proposed)
from an intersecting county road. State that no existing access is present or that no
new access is proposed, if applicable.
There is an existing access on the south end of the property from US Hwy 34
(Business Loop). The access is used for entry to the residential home and out
buildings, and the agricultural fields north and west of the home/out building area. The
access is approximately 1,850 feet northwest of the intersection of US Hwy 34
(Business Loop) and E 24th Street, and approximately 1,870 feet southeast of the
intersection of US Hwy 34 (Business Loop) and E 20t" Street.
There is an existing access at the southwest corner of the property from US Hwy 34
(Business Loop). The access is used for entry onto a farm road that runs along the
west edge of the property, and the Greeley No. 3 Canal irrigation structures
immediately north of the access. The access is approximately 2,650 feet northwest of
the intersection of US Hwy 34 (Business Loop) and E 24th Street, and approximately
1,070 feet southeast of the intersection of US Hwy 34 (Business Loop) and E 20th
Street.
There is existing access on the north end of the property from E 18th Street. This
access is used for entry onto a farm road that runs along the west edge of the
property, adjacent to the Greeley No. 3 Canal. The access is approximately 370 feet
east of the intersection of E 18th Street and Elder Avenue, and approximately 2,120
feet west of the intersection of E 18th Street and Vern Avenue (total length along the
alignment of E 18th Avenue).
2. Describe any anticipated change(s) to an existing access, if applicable.
No changes to the existing accesses are anticipated.
3. Describe in detail any existing or proposed access gate including its location.
There are no existing gates at the south or southwest access locations off of US Hwy
34 (Business Loop). There is an existing gate approximately 710 feet south of north
access location off of E 18t" Street on the farm road. The farm road is fenced (barbed
wire) along its boundary to the gate location.
4. Describe the location of all existing accesses on adjacent parcels and on parcels
located on the opposite side of the road. Include the approximate distance each
access is from an intersecting county road.
North property boundary:
There are six existing accesses to properties on the opposite side of E 18th Street
north of and within the east -west limits of the WGCD property.
• One of the accesses is immediately across the street from the north access
on the WGCD property, at the west edge of the WGCD property. This
access is approximately 370 feet east of the intersection of E 18th Street

The easternmost access is approximately 1,050 feet east of the intersection
of E 18th Street and Elder Avenue, and approximately 1,440 feet west of the
intersection of E 18th Street and Vern Avenue (total length along the
alignment of E 18th Avenue).
South property boundary:
There are four existing accesses to properties on the opposite side of US Hwy 34
(Business Loop) south of and within the east -west limits of the WGCD property.
• One of the accesses is immediately across the street from the southwest
access on the WGCD property, at the west edge of the WGCD property.
The access is approximately 2,650 feet northwest of the intersection of US
Hwy 34 (Business Loop) and E 24th Street, and approximately 1,070 feet
southeast of the intersection of US Hwy 34 (Business Loop) and E 20th
Street.
• One of the accesses is between the southwest and south accesses on the
WGCD property.
• There is an existing access immediately across the street from the south
access on the WGCD property. The access is approximately 1,850 feet
northwest of the intersection of US Hwy 34 (Business Loop) and E 24th
Street, and approximately 1,870 feet southeast of the intersection of US
Hwy 34 (Business Loop) and E 20th Street.
• The remaining access is to the east. It is approximately 1,500 feet
northwest of the intersection of US Hwy 34 (Business Loop) and E 24th
Street, and approximately 2,220 feet southeast of the intersection of US
Hwy 34 (Business Loop) and E 20th Street.
West property boundary:
• There are five parcels adjacent to the west side of the WGCD property.
Accesses to these parcels are from E 18th Street, E 20th Street, and US
Hwy 34 (Business Loop).
East property boundary:
• There are four parcels adjacent to the east side of the WGCD property.
Accesses to these parcels are from E 18th Street, and fern Avenue.
5. Describe any difficulties seeing oncoming traffic from an existing access and any

There are no difficulties seeing oncoming traffic from either direction at the south and
southwest access locations from US Hwy 34 (Business Loop). US Hwy 34 is straight
on either side of the accesses for 1,000+ feet in either direction.
There is no difficulty seeing oncoming traffic coming from the southeast at the north
access location from E 18th Street. E 18th Street is straight for 1,000+ feet to the
southeast. It is very difficult to see oncoming traffic coming from the west at the north
access location. There are a sharp horizontal curve and trees immediately west of the
access along E 18th Street.

6. Describe any horizontal curve (using terms like mild curve, sharp curve, reverse
curve, etc.) in the vicinity of an existing or proposed access.
US Hwy 34 is straight on either side of the south and southwest accesses for its entire
length between E 20th Street and E 24th Street.
E 18th Street is straight for 1,000+ feet to the southeast of the north access. A sharp
horizontal curve turning approximately 45 degrees from southeast to west is
immediately to the west of the north access.
7. Describe the topography (using terms like flat, slight hills, steep hills, etc.) of the
road in the vicinity of an existing or proposed access.
The topography of the road in the vicinity of all access is flat for 1,000+ feet on either
side of all accesses.

BYLAWS
Of the
WEST GREELEY CONSERVATION DISTRICT
Section 1. ORGANIZATION. Within ten (10) days after the formal organization of
this district the Board of Supervisors, hereinafter called the Board, shall meet at some
convenient place within or adjacent to the district and shall proceed:
(a) To take office upon the taking of an oath and if required by the state or local
board, the filing ofa bond.
(b) To elect from its members a president, vice-president, secretary and treasurer,
provided that if in the opinion of the Board it is wise to do so, the office of secretary and
treasurer may be combined; and provided further, that this section shall be subject to the
provisions of Section 13 of these Bylaws. A majority vote of the Board shall be necessary to
a choice of an officer.
(c) To adopt a seal in accordance with the provisions of Section 35-70-108 of
the Colorado SoilConservation Act.
(c) To select someplace within or adjacent to the district which shall thereafter
until further action ofthe Board be the principal place ofbusiness ofthe district.
Section 2. BOARD OF SUPERVISORS. The election, qualifications, term of office,
and duties of the Board of supervisors shall be as provided in Section 35-70-105 and 35-70-107
of the Soil Conservation Act and as provided in Section 4 of these Bylaws. Three of the five
supervisors must be actively engaged in farming and/or ranching.
Section 3. APPEALS. If the owner of any lands within the district desires, he/she
may appeal from any decision of the Board of Supervisors to the State Conservation
Board. The procedures for the appeal is outlined in Section 35-70-110 ofthe Colorado Soil
Conservation Act.
Section 4. POWERS AND DUTIES OF OFFICERS. The President shall preside at
all meetings ofthe Board and ofthe landowners within the district. He shall be the executive
officer of the district and shall sign, for the district and the Board, contracts, agreements,
vouchers, warrants, checks or other papers necessary to the conduct ofthe affairs ofthe district,
when duly authorized so to do by the Board. He shall have such other duties and powers as
usually devolve upon the executive officer ofapublic corporation.

absence ofthe President from the district or from any meeting ofthe district or the board whenthe
President shall be incapacitated from any cause.
The Secretary shall be responsible for the oversight ofthe seal ofthe district and of all
papers, documents and records ofthe district and the Board. He shall also be responsible for the
oversight ofkeeping accurate and complete minutes ofallmeetings ofthe district landowners and
the Board, which minutes shall be available for inspection by any owner of land in the district at
reasonable times. He shall attest the signature of the President to contracts, agreements, and
other papers necessary to the conduct ofthe affairs ofthe district, except for the disbursement of
funds.
The Treasurer shall be the custodian ofthe funds ofthe district and shall at all times be
charged with their safe -keeping. He shall furnish bond in such amount and with such conditions as
shall be required by the Board, and the cost of such bond shall be borne by the district. He shall
have authority to affix his signature, to vouchers, warrants, checks or other instruments for the
disbursement offunds ofthe district. He shall be responsible for the oversight ofkeeping at all
times an accurate and complete record ofthe financial transactions ofthe district and offunds
remaining in his hands, and suchrecords shallbe available for inspection by any landowner ofthe
district at reasonable times.
Section S. MEETINGS OF THE BOARD. QUORUM. Regular meetings ofthe Board
shall be held once each month at a convenient place within the district. At each meeting ofthe
Board, the members present shall fix the day and hour of the next regular meeting, and the
secretary shall notify each member in writing, or by telephone or personal message, not less than
three (3) days before the date of such meeting. Special meetings of the Board may be called at
any time by the President or by any three members ofthe Board on twenty-four (24) hours' notice in
writing or by telephone or personal message. The presence ofthree (3) members ofthe Board shall
be necessary to constitute a quorum, and amajority ofthose present shall prevail, except that in any
meeting for the purpose of preparing and certifying a budget, a majority of the whole Board shall
approve such action.
Section 6. MEETINGS OF LANDOWNERS. The first annual meeting of the
landowners ofthe district shall beheld at aplace convenient within or near the district boundaries
on the first Tuesday of February, 1949 and subsequent annual meetings shall be held each year,
at such time and place as hall be determined by the Board (amended January 2016). Special
meetings ofthe landowners ofthe district may be called by the Board when deemed desirable, or
by a petition signed by five (5) percent of such landowners.
TheSecretary shall give notice ofsuch regular or special meetings bymailing to each landowner
at his last known address written notice of such meeting not more than thirty (30) days in advance
ofthe date thereof and by posting on public bulletin boards within the district a notice ofthe time
and place and the purpose of such meeting not less than ten (10) days prior to the date of such
meeting, or by a notice published in a newspaper ofgeneral circulation within the district not more
than thirty (30) days nor less than ten (10) days in advance ofthe meeting.
At allregular annual meetings the landowners shall receive the reports ofthe officers of
the district and shall transact such other business as may come before the meeting.
At any special meeting ofthe landowners only such matters shall be considered as have
been included in the notice given.
At any regular annual or special meeting ofthe landowners ofthe district a majority of
those present in person shall prevail, but the presence ofat least fifteen (15) qualified voters shall
be necessary to constitute a quorum. The Board of Supervisors shall make all arrangements for
and conduct meetings oflandowners.
Section 7. VOTERS BY AGENTS. At any meeting ofthe landowners ofthe district, a
corporation owning land within the proposed or existing district is entitled to vote if such
corporation duly authorizes an agent to vote in the election in its behalf.
. Section 8. QUALIFICATIONS OF VOTERS. Any person in interest may be heard at any
special or regular meeting oflandowners ofthe district, but only qualified voters, as defined by
Section 35-70-104 ofthe Colorado Soil Conservation Act, or their authorized agents shall be
permitted to vote. At all such meetings the Board shall appoint a committee on the district, and
such committee shall examine the qualifications of all persons presenting themselves for the
purpose ofvoting and shall report to the President a complete list of qualified voters present in
person. Such list shall constitute the voting list of such meeting, and in the event ofprotest as to any
portion of such report or as to any name which has been excluded from the list or included in the list,
such report may be accepted or amended by a majority vote of those qualified voters present
against whose qualifications no protest is made.
Section 9. RULES AND ORDER OF BUSINESS. At all meetings of landowners within
the district, Robert's Rules of Order shall govern the conduct of business, and the order of
business shall be established by the Board.
Section 10. TAXATION. Taxes or assessments within the district may be levied in
accordance with Section 35-70-107 of the Colorado Soil Conservation Act. Members of the
Board of Supervisors shall serve until such time as their successors are elected. Vacancies in the
offices of President, Vice -President, Secretary and Treasurer shall be filled by the Board.
Section 11: VACANCIES. Vacancies on the Board shall be filled asprovided in Section
35-70-107 ofthe Colorado Soil Conservation Act. Members ofthe Board of Supervisors shall
serve until such time as their successors are elected. Vacancies in the offices of President, Vice -

Section 12. REMOVAL OF SUPERVISORS AND OFFICERS. Any member
of the Board of Supervisors may be removed from office by the recall procedure
outlined in Section 32- 1-906 and 32-1-907 included in the District Handbook. Any
officers of the Board may be removed from such office at any time by a majority of all
the members of the Board. Any supervisor will automatically be removed from the
board for missing three (3) consecutive meetings.
Section 13. EMPLOYMENT OF ASSISTANCE. If in the opinion of the Board
it shall be necessary or for the best interests of the district to employ some person or
persons not qualified to vote in the district, as secretary or treasurer or both secretary and
treasurer, it shall have the power to do so, and it shall have the power to employ such
legal, technical or other assistance as may be necessary to the conduct of the affairs of
the district, but in no event shall the employment of any assistance authorized in this
section obligate the district beyond the amount of its available funds or reasonable
revenue expectancy.
Section 14. AMENDMENT OF BYLAWS. The bylaws of this conservation
district may be altered, amended, or repealed or additions made thereto, at any regular
or regularly called special meeting of the district, upon compliance with the following
requirements: A petition whose text sets forth the proposed amendments in full, signed
by not less than (50) fifty qualified voters of the district, must be filed with the
supervisors; the complete text of the proposed amendment must be published at least
once in a newspaper of general circulation within each county in which property
included within the district is located, not less than ten days prior to the said meeting;
and those present at the said meeting at which the proposed amendment is to be
considered shall constitute a quorum for the consideration of the proposed amendment,
and the affirmative vote of majority thereof shall be required to adopt the proposed
amendment.

o Dust Complaint — Phinney/Schwindt — ongoing issue. WGCD
will start up by contacting Weld County and make

• Oath of Office Swearing In — Tony Becker and John Leone were sworn in to
fulfill a four year terms.
• Officer Elections — Becker made the following motion:

NRCS and WGCD staff members prior to the inspection for instruction and
expectations.
• District Organization — CACD Executive Director, Sharon Pattee, will assist
with expanded outreach efforts and lobbying for Conservation Districts on behalf
of WGCD until a new District Manager is in place. Simpson moved to give
CACD $10,000 to assist with deficit budget for Executive Director. Becker
seconded. Motion passed. Office Administrator, Nourse, will see to day to day
office matters, staff and Houston Garden reports from Conklin.

• Envirothon Results — Competition was April 26-27 in Castle Rock. Nineteen
teams competed from Colorado. WGCD sponsored two teams from Greeley West
High School. Sarah Maisonneuve, Community Outreach/Education
Coordinator, attended the competition, coached and recruited the help of
specialists from all over the Colorado Front Range to donate their time and
knowledge to prepare the teams.

WEST GREELEY CONSERVATION DISTRICT
CHANGE OF ZONE APPLICATION - MINERAL RESOURCE STATEMENT
The property is on the fringe of the South Platte River floodplain which is an area that typically
contains sand and gravel deposits. Further, based on the NRCS soils report, and soil logs from
the construction of water wells on the property, the property appears to contain a significant
resource of sand and gravel that could be extracted.
The NRCS soils report shows that gravelly sand soils are present at the property. It identifies
Altvan Loam, Aquolls and Aquents, and Ustic Torriorthents soil types which all contain gravelly
sub -stratums.
Soil logs found in the water well permits for the property show that sand and gravel was
encountered during the construction of the wells. Based on the logs the overall thickness of sand
and gravel encountered was 37 to 51 feet. The well permits are attached for reference.
