RESOLUTION •
WHEREAS, a public hearing was schedule on Monday, May 8,
1972, in the chambers of the Board of County Commissioners of Weld
County, Colorado, for the purpose of hearing the petition of Charles
R. Schmidt and Betty A. Schmidt, 320 No. Co. Rd. , Ft. Collins,
Colorado 80521, requesting approval to locate a dairy farm operation
on the following described property, to-wit:
The Southwest Quarter of the Northwest Quarter of the
Northwest Quarter (SW 4NW 4NW 4) of Section Twelve
(12), Township Six (6) North, Range Sixty-five (65)
West of the 6th P. M. , Weld County, Colorado,
containing ten acres, more or less, and
WIIEREAS, the petitioners withdrew their application for
location of said dairy farm operation and neither were they present at
the hearing, and
WHEREAS, there was some opposition to the request of petitioners
for the location of a dairy farm operation, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said request to locate a dairy farm operation may be
authorized upon the approval of the Board of County Commissioners of
Weld County, Colorado, and
WIIEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the Weld
County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that because the application of Charles R. Schmidt and
Betty A. Schmidt, 320 No. Co. Rd. , Fort Collins, Colorado 80521, to
locate a dairy farm operation on the premises indicated above was
withdrawn, there is no question before the Board to decide; consequently,
the situation is moot and the application is denied.

Colorado, for the purpose of hearing the petition of D. H. Coulson and
Betty Coulson, Box 82Y, Route 1, LaSalle, Colorado, requesting approval
of site for dog kennel operation on the following described property, to-wit:• That part of the Southeast one-quarter of Section 13,
Township 3 North, Range 65 West of the 6th Principal
Meridian, Weld County, Colorado, and that part of
Plots 21 and 22, Milton Lake Estates, First Filing, a
subdivision of a part of Section 12 and 13, Township 3
North, Range 65 West, described as: Beginning at

WHEREAS, the petitioners were present, and
WHEREAS, there was no opposition to the request of petitioners
for the location of a dog kennel operation, and
WHEREAS, the said requested location for a dog kennel operation
is located in an agricultural zone as set forth by the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(3) of the Zoning Resolution
of Weld County, said dog kennel operation may be authorized on the
approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioners and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of D. H. Coulson and Betty Coulson,
Route 1, Boa 82Y, LaSalle, Colorado, to locate a dog kennel operation
on the premises indicated above be, and it hereby is granted under the
conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2, That said dog kennel operation shall contain not more than
two hundred fifty (250) dogs at any one time.
3. That petitioners shall proceed with due diligence to effect i
said dog kennel operation and that they shall have up to one year from
date hereof to begin construction of said dog kennel operation.
4. That all applicable subdivision and coning regulations shall
be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

of Colorado and rules and regulations relating thereto heretofore passed by the

RE: IN THE MATTER OF CHANGE IN BOUNDARY LINES OF THE
COMMISSIONER DISTRICTS IN WELD COUNTY, COLORADO.
WHEREAS, due to the establishment of enumeration districts
in Weld County as a result of the 1970 Federal..Census, and
WHEREAS, the Board of County'Commissioners, Weld County,
Colorado, is of the opinion that the County Commissioner districts do not
conform to the proper division of the County with respect to population,
and
WHEREAS, in order that Weld County complies with the law
in every respect, it is desirable, necessary and in the best interests of
the County that the Board of County Commissioners, Weld County,
Colorado, now consider, determine and re-establish new boundary lines
of the commissioner districts within the County, all as shown on Exhibits
A and B attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED that the new boundaries
of each of the commissioner districts within Weld County shall be as shown
on Exhibit A, map of the City of Greeley, and as shown on Exhibit B, map
of Weld County, except the City of Greeley, noting thereon the division of
the commissioner districts within the City of Greeley and Weld County, all
as shown on the aforementioned Exhibits A and B attached hereto and made

WHEREAS, a public hearing was held on Monday, May 22, 1972,
in the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Duane Wilson, Route 2,
Box 152; Eaton, Colorado, requesting permission for expansion of a
sheep feed lot operation on the following described property, to-wit:

to begin construction for the expansion thereof.

shall not contain more than 2850 head at any one time.
4. That petitioner shall construct a sealed retention pond as designed
by the soil conservation engineer.
5. That all applicable subdivision regulations and zoning regulations

RESOLUTION
WHEREAS, a public hearing was held on Monday, May 22, 1972,
in the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Albert Stroh,
Johnstown, Colorado, requesting permission for expansion of an
existing feedlot operation on the following described property, to-wit:
The South Half of the Southwest Quarter of the
Southeast Quarter (SzSW4SE4) of Section 20,
Township 4 North, Range 67 West of the 6th
P. M. , Weld County, Colorado, containing 20
acres, more or less,
WHEREAS, the petitioner was present and represented by counsel,
Melvin Dinner, and
WHEREAS, there was some opposition to the request of petitioner
for the expansion of an existing cattle feedlot operation, and
WHEREAS, the said requested expansion of an existing cattle
feedlot operation is located in an agricultural zone as set forth by the
Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said cattle feedlot operation or any expansion thereof
may be authorized upon the approval of the Board of County Commissioners
of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner, and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Albert Stroh, Johnstown,
Colorado, for expansion of an existing cattle feedlot operation on the
premises indicated above be, and it hereby is granted under the con-
ditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That when expansion of said cattle feedlot operation is completed,
same shall not contain more than 3, 000 head at any one time.
3. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning
Resolutions of Weld County, Colorado.

RESOLUTION
RE: AGREEMENT BETWEEN WELD COUNTY AND THE CITY OF
WINDSOR, COLORADO, PROVIDING PLANNING SERVICES TO
WINDSOR.
WHEREAS, Weld County has planning services available to assist
cities and towns within the County, and
WHEREAS, the City of Windsor, Colorado, wishes to avail it-
self of such planning services, and
WIIEREAS, the County of Weld and the City of Windsor are desirous
of entering into a contract whereby the County will provide planning ser-
vices to the City of Windsor, and
WIIEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interests of the County to enter
into such agreement on the basis recited therein,
NOW, THEREFORE, BE IT RESOLVED, by the Board of County

THIS AGREEMENT is made and entered into this 31st day of
May, 1972, by and between WELD COUNTY, COLORADO, hereinafter
referred to as the "COUNTY" and WINDSOR, COLORADO, hereinafter
referred to as the "CITY".
WITNESSETH:
WHEREAS, Weld County, Colorado, has undertaken a program to
conduct planning studies and prepare a comprehensive plan for the
future development of said COUNTY; and
WHEREAS, Weld County has planning services available to assist
cities and towns within the COUNTY; and
WHEREAS, the CITY of Windsor, Colorado, has indicated the need
to obtain professional planning assistance from the COUNTY; and
WHEREAS, the COUNTY through its Planning Commission has
expressed its willingness to provide consulting planning services to the
CITY.
NOW, THEREFORE, in consideration of the foregoing and of the
mutual covenants and agreements hereinafter set forth, the parties
hereto legally intending to be bound hereby, do covenant and agree for
themselves and their respective successors and assigns as follows:
1. The COUNTY agrees to provide planning services to the
CITY, using the staff and time of the Weld County Planning Department.
2. The COUNTY agrees to provide a planner to assist the CITY
Planning Commission in surveying and analyzing local needs for public
or community facilities. The COUNTY agrees that the planner will
meet with the CITY Planning Commission and/or CITY officials as
required in the conduct of this work.

3. The COUNTY further agrees that COUNTY planner will provide
consulting assistance to the CITY Planning Commission in improving
administration and application of existing zoning requirements within
the CITY. Specifically, the COUNTY planner will review existing
zoning regulations and help establish an informal set of performance
guide lines that will clarify their intent and aid in their understanding
and administration.
4. It is mutually agreed that the COUNTY planner shall spend
reasonable time as necessary on the following items:
(a) Zoning review, including field checks of proposed sites, and
written reports of findings and recommendations.
(b) Subdivision review with respect to lot size, street widths,
street locations and items generally relating to zoning requirements.
(c) Reviewing and rewriting outdated regulations -ind procedures.

mutually agreed upon on an ad hoc basis.
5. The CITY agrees to pay to the COUNTY for the hereinabove
stipulated and described services the sum of Two Hundred and no/100ths
Dollars ($200. 00) per month for the three-month period hereinafter set forth.
6. It is mutually agreed that facilities and materials used shall be
paid for on an actual cost basis.
7. It is mutually agreed that any substantial changes in the scope
of services of COUNTY planner to be performed hereunder, including
any increase or decrease in the cost for such services, shall be in-
corporated in written amendments to this contract.

WHEREAS, it is apparent to the Board of County Commissioners,
Weld County, Colorado, that there is a lack of necessary space in .the
present Weld County Jail for the care of juveniles who need detention
from time to time, and
WHEREAS, the Greeley Police Department facilities have been
used frequently to house juveniles whenever space is not available in
the County without compensation from the County, and
WHEREAS, the City of Greeley, by John P. Parkinson, Chief of
Police, has brought to the attention of the County, the matter of space
and attendant costs for housing of juveniles detained at the city jail, and
WHEREAS, until future and more permanent arrangements can be
made to house such juveniles, the Board believes it to be in the best
interests of the County to enter into an agreement with the City of
Greeley relative to incarceration of juveniles in the city jail and pro-
viding for reimbursement to the city for such services.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the attached agreement
with the City of Greeley providing for such services be, and it hereby
is approved.

RE: STATEMENT OF TERMS BETWEEN WELD COUNTY AND THE
AND THE CITY OF GREELEY FOR USE OF GREELEY JAIL
FACILITIES,
This statement sets forth the terms and conditions under which the
City of Greeley will detain in its jail facilities juvenile prisoners under
the direct custody of the Department of Probation, District Court, 19th
Judicial District. This statement has been signed on behalf of the City
of Greeley by John P. Parkinson, Chief of Police, and this statement
has been signed on behalf of the Department of Probation, District Court,
19th Judicial District, by the Board of County Commissioners of Weld
County, Colorado. By signing this statement, each of said parties
signifies that he or it is authorized to bind the City of Greeley on the
one hand, and the County of Weld on the other hand, to the terms set
forth herein.
The terms and conditions for the detention of juvenile prisoners
is as fellows:
1 . The City of Greeley, shall, to the extent possible, make its jail
facilities available for temporary detention of juveniles under the direct
custody and supervision of said Department of Probation. The foregoing
provisions shall not require the City of Greeley to receive for detention
such juveniles, when the jail facilities are needed for prisoners under
the custody of the Greeley Police Department or the Greeley Municipal
Court.
2. The City of Greeley will provide each juvenile prisoner with the
same services, insofar as meals, towels, blankets, toiletries, etc. ,
as are now provided for other prisoners.
3. The County of Weld will make monthly payments to the City of
Greeley, in amounts determined by reference to the following rate

prisoners. The rate schedule for each juvenile prisoner for the period
specified is as follows:

4. At monthly intervals the City of Greeley shall submit to the
County of Weld a statement of charges, setting forth the name of the
prisoner, the number of hours detained, and the charges for each
prisoner, and the total charges. Each such statement shall be due and
payable within thirty (20) days after the statement is submitted.
5. In consideration of the agreement by the City of Greeley
to continue detaining juvenile prisoners, when its facilities so permit,
and in recognition of the fact that the City of Greeley has provided this
service at least since January 1, 1972 for no compensation, the County
of Weld hereby agrees to pay to the City of Greeley on or before May 21,
1972, the amount of $404. 30. Said aniount will cover all such services
rendered by the City of Greeley in the past and up to the effective date
of the Schedule of Charges set forth in this statement, which Schedule
shall apply to juvenile prisoners received from and after May 1, 1972.
6, Either the City of Greeley or the County of Weld may
terminate the arrangements set forth above, upon first giving ten
(10) days written notice of such termination to the other.

WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has long been concerned with the needs and welfare
of its youthful citizens, and
WHEREAS, Weld County is proud of the various 4-H organizations
throughout the county and of their various activities, and
WHEREAS, Weld County recognizes the services and worthwhile projects
. rendered by members of the 4-H organizations, and
WHEREAS, the Board is of the opinion that it would be in the best
interest of the county to express its appreciation and to fully recognize
all county 4-H leaders and its membership.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that August 16, 1972 be and is hereby declared to
be known as 4-H COUNTY GOVERNMENT DAY in Weld County.

WHEREAS, by Resolution adopted .June 30, 1971, by the Board of i
County Commissioners, Weld County, Colorado, a land use permit was
granted to Harvey J. Petersen for a dairy farm operation on the following

WHEREAS, the Board has reviewed the facts and circumstances
surrounding the delay in the matter, and
WHEREAS, the Board being fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the request of petitioner,
Harvey J. Petersen, be, and it hereby is granted.
BE IT FURTHER RESOLVED, that the period of time to begin
construction of said dairy operation be extended to June 30, 1973, on con-
dition that petitioner proceed with due diligence to complete construction
of the operation; otherwise, the Board may, for good cause shown, on
its own motion, revoke the permit so granted.

west of Greeley, Colorado; said intersection of 50th Avenue and U. S.
Highway #34 By Pass being located adjacent to property wholly owned by

RESOLUTION
WHEREAS, on or about April 7, 1971, personal judgment was
rendered against Eugene Gibbs, deputy sheriff and jailer for Weld
County, Colorado, in the sum of One Hundred Dollars ($100. 00)
together with costs therein in the sum of Ten Dollars ($10. 00) re-
sulting from an incident occurring at the Weld County Jail on or
about June 1970, and
WHEREAS, Gibbs was at the time a duly appointed and acting
Deputy Sheriff and performing services within the scope of his
employment, and

WHEREAS, it has been brought to the attention of the Board
of County Commissioners, Weld County, Colorado, that, although
Gibbs was accused of acts beyond the scope of his employment,
the Board is of the opinion that Gibbs, if guilty of anything, was
guilty only of following instructions and of being over zealous in
the performance of his duties as Deputy Sheriff and Jailer, and
WHEREAS, the Board is satisfied that Gibbs was acting well
within the scope of his employment and following instructions as
a dutiful Jailer, and
WHEREAS, the Board is of the opinion that it would be in the
best interests of the County to reimburse Gibbs for the sum of
One Hundred Ten Dollars ($110. 00) representing the amount of the
judgment and costs which he was ordered to pay.
NOW, THEREFORE, BE IT RESOLVED, and it hereby is
ordered, that Barton Buss, chief accounting officer of Weld County,
prepare the necessary voucher and cause the amount of One Hundred
Ten Dollars ($110. 00) be paid directly to Mr. Eugene Gibbs.

RESOLUTION
RE: AGREEMENT BETWEEN WELD COUNTY AND THE EVANGELICAL
LUTHERAN GOOD SAMARITAN SOCIETY AND CLOSING THE WELD
COUNTY NURSING HOME.
WHEREAS, it has been determined that Weld County cannot justify
the expenditure of public funds to repair and/or remodel the old Weld
County Nursing Home building; and
WHEREAS, investigation discloses that there are sufficient nursing
home facilities in the area to absorb the patients presently at the county
nursing home; and
WHEREAS, the Evangelical Lutheran Good Samaritan Society has
submitted an agreement offering to accept present county nursing home
patients into its privately owned facilities, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interests of the County to close
said nursing home permanently; and further, believes it to be in the
hest interests of the County to enter into such agreement on the basis
recited therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the agreement submitted
by the Evangelical Lutheran Good Samaritan Society to accept patients
presently in the county nursing home, copy of which is attached hereto
and made a part hereof by reference, be, and it hereby is approved.
BE IT FURTHER RESOLVED, by the Board of County Commissioners,
that the Weld County Nursing Home be, and it hereby is declared to be •
permanently closed.
BE IT STILL FURTHER RESOLVED, that all patient care at said
Weld County Nursing home cease within thirty (30) days of the time
that patient removal from the premises is begun.

Gentlemen:
The undersigned, Evangelical Lutheran Good Samaritan Society,
hereinafter called the Society, with offices at 708 22nd Street, Greeley,
Colorado, hereby offers to relocate all of the patients, both welfare
patients and the private paying patients, now residing at the Weld
County Nursing Home, 1534 11th Avenue, Greeley, Colorado, upon the
following terms, provisions and conditions:
1. The Society, at no expense to it, will accept transfer of
patients to its new privately owned facility, however, it is understood
that each patient shall have a choice of another home to which he or
she would like to be transferred at his or her own expense.
2. The Society will relocate said patients within thirty (30) days
from the date that its new facility is licensed.
3. The Society agrees that welfare and other patients now
residing at the Weld County Nursing Home under existing programs
for care of the aged, will be provided board, room and nursing home
care so long as such patients are eligible for such State and Federal
assistance at the rates that are set by the State and Federal agencies
involved at no cost to the County of Weld.

4. The private paying patients now residing at Weld County
Nursing Home will be furnished board, room and nursing home care
at competitive rates, which we understand now prevail as to such
patients at the Weld County Nursing Home, at no cost to the County
of Weld.
5. The Society agrees that present personnel now employed at
the Weld County Nursing Home will be absorbed where feasibly
economical and that when such personnel are employed by the Society,
they will be entitled to the same benefits as all present employees of
the Society.
6. This offer is made upon the condition that Weld County will
operate no nursing homes within Weld County so long as the Society
and other privately owned and operated nursing homes in Weld County
are adequate and are satisfactorily supplying the needs of Weld resi-
dents for nursing home care.
7. In consideration of Weld County phasing out its nursing home
operations, the Society further agrees that it will at all times use its
best efforts to provide adequate and satisfactory nursing home care
for Weld County residents.
8. It is mutually agreed that whenever the Hoard of County
Commissioners, upon the advice of the State and Local Health Depart-
ment, should decide that privately owned and operated nursing homes
are not satisfactorily fulfilling the needs of Weld County residents,
the Board may by resolution provide the necessary facilities under
the appropriate statutes providing therefore.
9. This offer together with your acceptance upon the terms,
provisions and conditions above stated shall constitute a binding
agreement and shell inure to the benefit of and bind our successors.

RESOLUTION
RE: ADJUDICATION OF WATER WELLS OWNED BY WELD COUNTY.
WIIEREAS, it has come to the attention of the Board of County
Commissioners, Weld County, Colorado, that the present state law
requires that all active water wells located in Weld County must be
adjudicated on or before July 1, 1972, and
WIIEREAS, Weld County owns several of such water wells that
need to be made of record and said water rights preserved and
adjudicated, and
WIIEREAS, it is in the best interest of Weld County to have all
of the county's water wells properly registered and adjudicated.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, and it hereby is ordered that Glenn Billings ,chairman,be
authorized to execute any and all necessary instruments relating to the
application and leading to the final registration and adjudication of all
county water wells being the property of Weld County, Colorado.
