HomeMy WebLinkAbout710375.tiff RESOLUTION WHEREAS, it is the desire of the Board of County Commissioners of Weld County, Colorado, to lease to the State of Colorado, for the use and benefit of the Department of Revenue, the following described premises: Lot 4, Block 184, known as Island Grove Building, City of Greeley, County of Weld, State of Colorado, as per lease agreement attached hereto and made a part hereof by reference, for a monthly lease rental of One Hundred Sixty Dollars ($160. 00). NOW, THEREFORE, BE IT RESOLVED, that the County of Weld, State of Colorado, agrees to lease to the State of Colorado, for the use and benefit of the Department of Revenue, the herein above described premises, as per said lease agreement, all as hereinabove recited. VED AS TO OR1VI: 3 C unty Attorney -;j ;1).1/5 n , j 710375 9 fi LEASE THIS LEASE, Made and entered into this 21st day of December , 1970 by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called the "Lessor , " and the STATE OF COLORADO, for the use and benefit of the DEPARTMENT OF REVENUE, hereinafter called the Lessee. " W I T N E S S E T H: The parties hereto, for the consideration hereinafter mentioned, covenant, and agree as follows : I. The Lessor hereby leases to the Lessee the following described premises: Lot 4, Block 184, known as Island Grove Building, City of Greeley, County of Weld, State of Colorado. To be used exclusively for office space and related purposes by divisions of the Department of Revenue, State of Colorado. 2. TO HAVE AND TO HOLD the said premises for a term of three years , beginning on January 1, 1971 and ending December 31, 1973. 3. The Lessee shall pay the Lessor rent for the demised premises at the following rate: One Hundred Sixty Dollars ($160. 00) per month throughout the term hereof for a total consideration of $5,760. 00. Payment shall be made upon the Lessor rendering a monthly statement in triplicate for the rent provided herein, to the Department of Revenue, Room 420, State Capitol Annex, Denver, Colorado 80203, on the first day of each month during the term of this lease. 4. This lease may be terminated by either party on December 31 of any calendar year throughout the term of this lease by written notice of cancellation mailed to the other party at its last known address at least ninety days prior to the effective date of such cancellation. 5. The Lessor shall furnish to the Lessee, during the occupancy of said premises, under the terms of this lease, as part of the rental consideration, the following : General maintenance of building and external areas abutting same ; plumbing, heating, and air conditioning. Lessee will pay for its own utilities and janitorial service. 6. This lease shall not be valid until it shall have been approved by the Colorado State Controller or by such assistant as he may designate. 7. The Liability of the State as Lessee herein is subject to the appropriation for and availability of funds to meet the considerations set forth herein. 8. The Lessee shall have the right, during the term of this lease , to make alterations , attach fixtures, and erect additions, structures, or signs , in or upon the premises leased hereby; which fixtures , additions , or structures so placed in or upon or attached to the said premises shall be and remain the property of the Lessee and may be removed therefrom by the Lessee prior to the termination of this lease, and the Lessee , shall, before the expiration of this lease , restore the premises to the same condition as that existing at the time of entering upon the same under this lease , reasonable wear and tear, and damages by the elements and by circumstances over which the Lessee has no control excepted. 9. If the said premises be destroyed by fire or other casualty, this lease shall immediately terminate. In case of partial destruction or damage , so as to render the premises untenant- able, either party may terminate the lease by giving written notice to the other within fifteen (15) days of the occurrence of such event, and if so terminated, no rent shall accrue to the Lessor after such partial destruction or damage. 10. The signatories hereto aver that to the best of their knowledge, information, and belief no state employee has any personal beneficial interest whatsoever in the property described herein. 11. By the terms of this lease the Lessor agrees to lease -2- to the State for the use and benefit of the Department of Revenue a total of 1232 square feet of net usable floor area for approximately $1. 56 per square foot per annum.
