The Board having under consideration the matter of final payment to be made to V Van Gorder, Contractor upon one certain concrete Bridge situated on the South line of section 16, Tp. 3, Range 6E , known as the Mead Lateral Bridge. And it appearing that said bridge is now completed, it was ordered that the following notice be published in the official paper as required by law. • LEGAL NOTICE Notice is hereby given that on September 16th, 1919, final payment on the Concrete Bridge across Mead Lateral on the South line of section 16, Tp. 3, Range 65, will be made to Contractor V. Van Gorder. All parties having contracts or having furnished material or labor therefore, or having claims against said contractor on account thereof , may present their claims therefor, to the Board of County Commissioners of Weld County, on or before said 16th day of September 1919, at 10:00 o'clock A. IN THE MATTER OP PUBLIC ROADS 0 -D P HOLLEY ROAD ORDER APPOINTING APPRAISER TP. . 4 RANGE 61 • /D0 On this day the Board having under- consideration the matter of petition for public ,,,,\,_ road in Township 4, Range 61. 1 And it appearing to the Board that said proposed road as petitioned would require the taking of certain lands belonging to Harley Warren among others. AND IT FURTHER APPEARING to the Board that the matter of compensation for the taking -- of such land cannot be agreed upon by said Harley Warren and said Board of County Comm- issioners. And it having been agreed by and between said Board and said Warren that each should appoint one appraiser and the two appraisers should appoint a third to appraise a strip of 40 feet in width on the East side of Northeast quarter of section 28, Tp. 4, R. 61, belonging to said Warren to be used for said proposed road. NOW THEREFORE, on motion duly made, seconded and carried, H. A. Irons is hereby appointed as appraiser herein for such purposes. IN THE MATTER OF EQUALIZATION ' . Commissioner The minutes of the meeting of the 2nd, were read and there being no objections or corrections thereto the same were approved. IN THE MATTER OF BRIDGE CONSTRUCTION -PAWNEE CRPFK ORDER REJECTING BIDS AND RE-ADVERTISING NORTH OF STONEHAM The Board having under consideration the matter of bids for the construction of a Bridge across Pawnee Creek North of Stoneham, as heretofore advertised. And the hour of 10: 00 o'clock having arrived bids were ordered opened and read, to—wit: The hid of A R Mackey, in the sum of $18"78.00. • And the Board having considered said matter it was on motion duly made, seconded and parried, ordered that said bid be rejected, and new bids called for. M. , Tuesday, September 16th, 1919, for the furnishing of all material and labor necessary for 60 foot pile Bridge over Pawnee Creek, North of Stoneham, herein described and located, in accordance with specification now on file at the office of County Supervisor of Roads and Bridges. Each bid must be accompanied by a certified check made payable to Weld County, for at least 5 per cent of the amount of each bid, as evidence of good faith that the succ— essful bidder will enter into contract for the work if his proposal should be accepted. The right is reserved to reject any or all bids and waive such defects or inform— alities as may occur in any bid should it be deemed to the interest of the County to do so. September 4th, 1919. Mr. T. E. Rowe, Chairman, Board of County Commissioners, Greeley, Colorado. Dear Sir. After visiting the Hyle Bridge yesterday, under contract to the McDonald Construction Company, and the examination made by Mr. Maloney, Chief Engineer of this Department, and Mr. Stimson representing your Board, in view of the r228 dis-•closures of Pier No. 8, of the bridge by the excavation to the pile level which shows this particular pier to be in bad condition, and the previous exposure of Pier No. 7 which showed that pier to be in bad condition, and the examination and previous reports made by your own engineer and also by Mr. Randall of this office -- both of which reports show the balance of the piers and both abutments in this bridge to be in, probably, the same condition, I believe we are justified in eonoluding that all the piers together with the abutments are faulty,- and that the specifications,:which are part. of the ' contract, regarding the deposit of concrete in excavation for footings for piers were evidently not complied.with. Therefore, the contractor should be required to repair all the ,piers and abutments in the best mariner possible before the bridge is accepted by your Board. Your engineer, Mr. Stimson has suggested a plan which meets the approval of Mr. Maloney, Chief Engineer of this Department, which provides for the driving of Wakefield piling, completely surrounding each pier and abutment, to be held in place below water level by a collar of reinforced concrete -- which protection can be installed at less - oost than the excavation and exposure 's dttithe'ee piers if repaired by replacing the defective concrete. N THE MATTER OF BRIDGE CONSTRUCTION -HYLES BRIDGE ORDER CALLING FOR BIDS TO REPAIR AND COMPLETE The Board proceeded to consider the matter of repair of the Hyles Bridge and after a general discussion of that subject and a careful consideration of the letters received from T J Ehrhart, State Highway Commissioner, and Mr. A L Doud, who represents the McDonald Construction. Co. , the following resolution was offered by Commissioner Birkle, who moved the adoption thereof, to—wit: WHEREAS, the R P McDonald Construction Co. , failed to comply with the plans and specifioations in the construction of the Hyles Bridge and on that account the piers and abutments below the water level are defective and must be repaired before the bridge will be safe for general use; and whereas demand has been made upon the McDonald Construction Co. , to repair the piers and abutments and said company has failed and refused to do such repair work; and whereas L L Stimson as County Surveyor, has recommended a plan for the repairing the piers and abutments which, in the opinion of the Board, is the most practicable and most economical way to repair the bridge; NOW THEREFORE, be it resolved that the Board of County Commissioners cause the piers and abut— ments in said Hyles Bridge to be repaired in the manner specified by L L Stimson as County Surveyor and that such repair work be done ^y contract. BE IT FURTHER RESOLVED, that a notice be published in the Weld County News, the official news— paper of Weld County, Coloraod, and also in the Greeley Tribune—Republican for a period of not less than ten days, notifying the public generally that sealed proposals will be received by the Board of County Commissioners of Weld County at the offi-e of the Board of County Commissioners at the Court House in Greeley until ten o'clock A. M. , on Monday. October 13, 1919, for the furn— ishing of all material and labor necessary for the repairing of the piers and abutments and comp— letion of the Hyles Bridge in accordance with the specifications now on file at the office of the Co. engineer, and that each bid must be accompanied by a certified check of at least 5* of the amount bid as evidence of the good faith that the successful bidder will enter into contract for the work if his proposal should be accepted. Said notice shall also specify that the Board reserves the right to reject any or all bids and waive such defects or informalities as may occur is any bid should it be deemed to the best interest of the County to do. so. The motion to adopt the foregoing resolution was seconded by Commissioner Peters and being put to vote the resolution was unanimously adopted. I j A IN THE MATTER OF ABATEMENT OF THE b HENRYLYN IRRIGATION DISTRICT TAXES ORDER OF REMISSION TEAT WHEREAS, it has been certified to this Board that the following described land, to-wit: The SE4 SW4, SW-4 SE-4, Sec. 19, Tp. 2 N. , R. 62 W. , standing in the name of John•M- Cram, which land', A is included in the Henrylyn Irrigation District, has been selected by the Bondholders committee . (appointed under a certain agreement dated June 15th, 1918, between the Henrylyn Bondholders r company, the Henrylyn Irrigation District and others) and the Board of Directors of the Henrylyn Irrigation District to be relieved from taxes for the bond interest, in accordance with paragraph XIII of said contract providing for the ultimate exclusion of certain lands now in said district, and for the present relief of said lands from the taxes for bond interest. t AND WHEREAS, The district has certified its willingness to relieve said land from all other irrigation taxes. NOW THEREFORE, in accordance with said certificate and said contract be it hereby resolved ' that the Treasurer of Weld County, Colorado, ne and he is hereby authorized to cancel all Henrylyn Irrigation District taxes assessed and now standing against said described land. Attorney. 4 The minutes of the meeting of October 11th, were read and there being no objections or corrections thereto the same were approved. . )IN THE MATTER OF BRIDGE CONSTRUCTION -HYL .C BRIDGE IN RE BIDS FOR REPAIRS G�s� The Board met for the purpose of opening bids for repair work upon the Pyles Bridge, pursuant to the notice heretofore published. Mr. R. P. McDonald of the R. P. McDonald Construction Company, appeared before the Board and stated that his oompany desired to repair the bridge at its own expense and would do the repair work in accordance with the plans and specifications prepared by the County Engineer, upon which the commissioners had asked for bids. Mr. McDonald further stated that he decided to have the commissioners pay unto his company out of moneys due the company under its contract, the sum of $250.00 eaoh for the two piers that already had the piling around them and the sum of $525.00 each for the other nine piers and the sum of X00.00 each for the two abutments, which payment should be made immediately upon completion of the repair work upon any pier or abutment and the same as paid to be charged against the amount remaining due the R. P. McDonald Construction Company, under the contract for the building of the bridge. The Board thereupon postponed the opening of bids to and until the 20th day of October, 1919, at 10: 00 o'clock A. M. , and informed Mr. McDonald that in case he proceeded to repair the bridge according to plans and specifications prepared by Mr. Stimson that they would not let contract to any other person for such work so long as the McDonald Construction Company proceeded diligently with the work and that in oase said company did do said repair work according to the plans and specifications prepared by Mr. Stimson, that the county would pay to the company out of the money due the company under the original contract the amounts above specified and said amounts to he charged against the account with the McDonald Construction Company, but no payment to be made unless the repair work was done according to plans and specifications or in such way that it met the approval of the county engineer and no payment to be made upon such repair work until certificate was furnished from the County Engineer that the pier or piers or abutments upon which the payment was claimed have been properly repaired. Upon motion duly made , seconded and carried, L. L. Stimson as County Surveyor was instructed to supervise the repair work upon said bridge and for said purpose was authorized to employ a competent inspector to remain at the bridge at all times that work may be in progress. The choice of inspector and the amount to be paid for such work to be subject to the approval of the Bo3rd of County Commissioners.
