A. Change of Zone PZ-101 1 is from A (Agricultural) to PUD
(Planned Unit Development) for 40 lots with R-1 (Low Density

and to determine compliance with the Bulk Requirements from
Chapter 27 of the Weld County Code. Building heightshall be
measured in accordance with Chapter 23 of the Weld County Code
in order to determine compliance with offset and setback
requirements. Offset and setbacks are measured from the farthest
projection from the building. An ILC (Improvement Lot Certificate) wi
be required for each building showing the building height as
measured according to Chapter 23 of the Weld County Code as well
as the offset and setback distances to property lines. The ILC,
bearing the stamp of a Colorado registered engineer or the
certification of a Colorado registered surveyor, will be required prior

project has not been abandoned and that the applicant possesses
the willingness and ability to continue with the submission of the

applicant to demonstrate that the PUD has not been abandoned. If
the Board determines that conditions or statements made supporting
the original approval of the PUD Zone District have changed or that
the landowner cannot implement the PUD Final Plan, the Board of
County Commissioners may, at a public hearing revoke the PUD
Zone District and order the recorded PUD Zone District reverted to

maximum lot coverage shall be twenty percent (20%) excluding
pools and spas (hot tubs), and the maximum building height
shall be thirty five (35) feet. The PUD has 193 acres of open
space consisting of a river corridor and two private
recreational lakes, as indicated in the application materials on
file, and subject to, and governed by, the Conditions of
Approval stated hereon and all applicable Weld County
Regulations.
3) Approval of this plan may create a vested property right
pursuant to Section 23—8-10 of the Weld County Code.
4) Water service shall be obtained from the Central Weld County
Water District and the Little Thompson Water District.
5) Sewer service shall be obtained from the St. Vrain Sanitation
District.
6) A Flood Hazard Development Permit is required for all
construction or development occurring in the floodplain or
floodway as delineated on Federal Emergency Management
Agency (FEMA) FIRM Community Panel Map # 08123C -1890F
dated September 17, 2020 and Letter of Map Amendment
(LOMA) Case No. 03-08-0025A (St Vrain Creek Floodplain).
Any development shall comply with all applicable Weld County
requirements, Colorado Water Conservation Board requirements
as described in Rules and Regulations for Regulatory
Floodplains in Colorado, and FEMA regulations and requirements
as described in 44 CFR parts 59, 60, and
65. The FEMA definition of development is any man—made
change to improved or unimproved real estate, including by
not limited to buildings or other structures, mining, dredging,
filling, grading, paving, excavation, drilling operations, or
storage of equipment and materials.
7) FEMA's floodpiain boundaries may be updated at any time by
FEMA. Prior to the start of any development activities, the
owner should contact Weld County to determine if the
floodplain boundaries have been modified.
8) Permanent restroom and hand washing facilities shall be
provided within easy access of the public gathering area.
9) The recreational uses on the lakes will require compliance with
the water quality standards of the Colorado Department of
Public Health and Environment Swimming Pool and Mineral Bath
Regulations.
10) Use of open space facilities is limited to residents of the
subdivision and their guests. Recreational activities on the
lakes shall include skiing, fishing and sailing. Should the
Homeowners' Association wish to establish a swim beach or
picnic area, or sell memberships to non—residents, the Weld
County Departments of Planning Services and Public Health
and Environment should be contacted to establish the
appropriate permitting process.
11) In accordance with the Augmentation Agreement recorded on
May 15, 1986, in Book 1112, Reception No. 2053601, with the
Central Colorado Water Conservancy District, the Pelican Shores
Homeowners' Association could be held responsible for ensuring
the evaporative depletions from the site are being replaced.
12) Access Shall be granted onto the property for the explicit
purpose of cleaning and maintaining existing lateral ditches as
indicated on the plat.
13) Construction on any ditch within carried water to surrounding
properties shall be done so that the delivery of water is not
impaired.
14) If required, the applicant shall obtain a Stormwater Discharge
Permit from the Water Quality Control Division of the Colorado
Department of Public Health and Environment. Silt fences shall
be maintained on the down gradient portion of the site during
all parts of the construction phase of the project.
15) During development of the site, all land disturbances shall be
conducted so that nuisance conditions are not created. If dust
emissions create nuisance conditions, at the request of the
Weld County Department of Public Health and Environment, a
Fugitive Dust Control Plan must be submitted.
16) In accordance with the regulations of the Colorado Air Quality
Control Commission, any development that disturbs more than
five (5) acres of land must incorporate all available and
practical methods that are technologically feasible and
economically reasonable in order to minimize dust emissions.
17) If land development created more than a 25 acres
contiguous disturbance, or exceeds six (6) months in duration,
the responsible party shall prepare a Fugitive Dust Control
Plan, submit an Air Pollution Emissions Notice, and apply for a
- permit from the Colorado Department of Public Health and
Environment.
18) The site shall be developed in accordance with the
recommendation included in the Preliminary Subsurface
Investigation report by Western Soils, Inc. dated October 18,
2002, including the possible use of a drilled pier foundation
system. This is a result of extensive fill, which reflects
disturbed soil conditions and properties.
19) In accordance with the Preliminary Subsurface Investigation
by Western Soils, Inc., dated October 18, 2002, special
considerations should be given to the depth of any basement
excavations on the South Pelican Shores site due to
groundwater conditions throughout this area of development.
41) Section 27—8-70.A. of the Weld County Code Failure to
comply with the PUD Final Plan: The Board of County
Commissioners may serve written notice upon such
organization or upon the owners or residents of the PUD
setting forth that the organization has failed to comply with
the PUD final plan. Said notice shall include a demand that
such deficiencies of maintenance be cured within thirty (30)
days thereof. A hearing shall be held by the Board of
County Commissioners within fifteen (15) days of the
issuance of such notice, setting forth the item, date and
place of the hearing. The Board may modify the terms of
the original notice as to deficiencies and may give an
extension of time within which they shall be rectified.

42) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld
County has some of the most abundant mineral resources,
including, but not limited to, sand and gravel, oil, natural
gas, and coal. Under title 34 of the Colorado Revised
Statutes, minerals are vital resources because (a) the
State's commercial mineral deposits are essential to the
State's economy; (b) the populous counties of the state
face a critical shortage of such deposits; and (c) such
deposits should be extracted according to a rational plan,
calculated to avoid waste of such deposits and cause the
least practicable disruption of the ecology and quality of
life of the citizens of the populous counties of the state.
Mineral resource locations are widespread throughout the
County and people moving into these areas must recognize
the various impacts associated with this development. Often
times, mineral resource sites are fixed to their geographical
and geophysical locations. Moreover, these resources are
protected property rights and mineral owners should be
afforded the opportunity to extract the mineral resource.
43) WELD COUNTY'S RIGHT TO FARM: Weld County is one of
the most productive agricultural counties in the United
States, typically ranking in the top ten counties in the
country in total market value of agricultural products sold.
The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons
moving into a rural area must recognize and accept there
are drawbacks, including conflicts with long—standing
agricultural practices and a lower level of services than in
town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural areas: open
views, spaciousness, wildlife, lack of city noise and
congestion, and the rural atmosphere and way of life.
Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone
forever.
Agricultural users of the land should not be expected to
change their long—established agricultural practices to
accommodate the intrusions of urban users into a rural
area. Well —run agricultural activities will generate off -site
impacts, including noise from tractors and equipment;
slow —moving farm vehicles on rural roads; dust from
animal pens, field work, harvest and gravel roads; odor
from animal confinement, silage and manure; smoke from
ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife;
and the use of pesticides and fertilizers in the fields,
including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of
agricultural machinery and supplies to assist in their
agricultural operations. A concentration of miscellaneous
agricultural materials often produces a visual disparity
between rural and urban areas of the County. Section
35-3.5-102, C.R.S., provides that an agricultural operation
shall not be found to be a public or private nuisance if
the agricultural operation alleged to be a nuisance employs
methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been, and continues to be, the lifeline for the
agricultural community. It is unrealistic to assume that
ditches and reservoirs may simply be moved "out of the
way of residential development. When moving to the
County, property owners and residents must realize they
cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the
water.
20) The Weld County Sheriffs Office has limited traffic
enforcement powers on roadways within subdivision that are
not maintained by the County.
21) All landscaping within sight distance triangles must be less
than 3.5 feet in height at maturity.
?.,2) A Homeowners' Association shall be established prior to
Nthe sale of any lot. Membership in the Association is
mandatory for each parcel owner. The Association is
responsible for liability insurance, taxes and maintenance of
open space, streets, private utilities, and other facilities.
Open space restrictions are permanent.
23) The Pelican Shores North Homeowners' Association is
responsible for maintenance and preservation of the St.
Vrain river, located on Tract B, and all expenses related
thereto. The County will not assume responsibility.
24) No animal units will be allowed within the PUD.
25) Oil and gas facilities within the PUD must be fenced to
avoid tampering.
26) One development sign, not to exceed thirty—two square
feet, has been approved at each entrance. Signs shall meet
all requirements of Chapter 23, Article IV, Division 2 and
Chapter 27, Article VI, Section 90 of the Weld County Code.
27) Building Permits issued on the proposed lots will be
required to adhere to the fee structure of the County
Facility Fee, County —Wide Road Impact Fee, and Drainage
Impact Fee Programs.
28) Stop signs and street name signs will be required at all
intersections.
29) All single—family residences shall have a legible address
that is clearly visible form the street fronting the property.
30) Installation of utilities shall comply with Section 24-9-10
of the Weld County Code.
31) The Weld County Department of Public Works shall be
notified prior to placing utilities in the road rights -of —way
to determine if permits will be required.
32) A separate building permit shall be obtained prior to the
construction of any building.
33) A plan review is required for each building. Plans may
require the wet stamp of a Colorado registered engineer or
architect. Two complete sets of plans are required when
applying for each permit.
34) Buildings and structures shall conform to the
requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted
by Weld County: 2018 International Building Codes; 2018
International Residential Code; 2006 International Energy
Code; 2017 National Electrical Code; and Chapter 29 of the
Weld County Code. A plan review shall be approved, and a
permit must be issued prior to the start of construction.
35) Each building will require an engineered foundation based
on a site -specific geotechnicat report or an open —hole
inspection performed by a Colorado registered engineer.
