SERVICE AGREEMENT
BETWEEN
BOARD OF WELD COUNTY COMMISSIONERS
AND
WELD COUNTY WORKFORCE DEVELOPMENT BOARD
AND
EMPLOYMENT SERVICES OF WELD COUNTY
THIS AGREEMENT is made and entered into this Z l S+ day of J

County Department of Human Services, hereinafter referred to as "Governing Board",
(2) the Weld County Workforce Development Board, hereinafter referred to as
"WCWDB", and (3) Employment Service of Weld County, acting as the One -Stop
Operator and the American Job Center, hereinafter referred to as "ESWC,"
WHEREAS, the State of Colorado has designated the County of Weld as a
Regional. Planning area and as a local workforce development area; and
WHEREAS, the Workforce Innovation and Opportunity Act (WIOA) Public
Law 113-128, Title I, authorizes programs to provide job training and related
services to individuals seeking employment or career advancement, and
establishes the "One -Stop" delivery system.
WHEREAS, the Act requires the establishment of a local workforce
development board to carry out the functions described in Section 107 (d) of the Act,
and any functions specified for the local board under the Act or the provisions in the
Act establishing a core program which includes policy guidance for the portion of the
statewide workforce system in the local area; and
WHEREAS, it is the responsibility of the parties to this Agreement to ensure
effective delivery of services which provide the most beneficial mix of
program/partner services to the residents and employers of Weld County; and
WHEREAS, it is further the responsibility of the parties to this Agreement to
stimulate the active, effective participation of all WIOA partners and sectors of the
community in the provision of workforce development services; and
WHEREAS, the Act provides the ability for the Governing Board and the
WCWDB to define the scope of their roles and responsibilities by means of an
Agreement, which Agreement is set forth herein;
WHEREAS, ESWC was selected through an open competitive bid process to
be the local One -Stop Operator for the Weld County Regional Planning area and
the local workforce development area; and

WHEREAS, the Act and the Colorado Workforce Development Council
require that any organization that has been selected to perform more than one of the
functions such as local fiscal agent, Local WDB staff, one -stop operator, and/or
direct provider of services; must develop a written agreement with the Local
Workforce Development Board and the Chief Elected Official to clarify how the
organization will carry out its responsibilities while demonstrating compliance with
the Act , corresponding regulations, OMB circulars, and state policies.
NOW, THEREFORE, in consideration of the mutual promises and covenants
herein, the Governing Board, the WCWDB, and ESWC hereby state and agree as
follows:
1. Introduction. The terms of this Agreement are contained in the terms recited in this
document and in the attached Exhibits, each of which forms an integral part of this
Agreement and are incorporated herein. The parties each acknowledge and agree
that this Agreement, including the attached Exhibits, define the performance
obligations, willingness and ability to meet those requirements (the "Work"). If a
conflict occurs between this Agreement and any Exhibit or other attached document,
the terms of this Agreement shall control, and the remaining order of precedence
shall be based upon order of attachment.
Exhibit A consists of Governing Board's Request for Proposal (RFP) as set forth in
Bid Package No. B#2500044 which is incorporated into this agreement by reference
and will be provided upon request to the Department. .
Exhibit B consists of Scope of Services.
Exhibit C consists of ESWC's Response to Governing Board's RFP.
2. Service or Work. ESWC agrees to procure the materials, equipment and/or
products necessary for the Work and agrees to diligently provide all services, labor,
personnel, and materials necessary to perform and complete the Work described in
the attached Exhibits. ESWC shall further be responsible for the timely completion
and acknowledges that a failure to comply with the standards and requirements of
Work within the time limits prescribed by the Governing Board and WCWDB may
result in the Goveming Board's and WCWDB's decision to withhold payment or to
terminate this Agreement.
3. Term. The term of this Agreement shall be from July 1, 2025, through June 30,
2028, or until ESWC's completion of the responsibilities described in the attached
Exhibits and is subject to continued budget appropriations. This Agreement may be
extended upon mutual written agreement of the Parties.
4. Termination; Breach; Cure. Governing Board and WCWDB may terminate this
Agreement for its own convenience upon thirty (30) days written notice to ESWC.

Due to the time needed for the Governing Board and WCWDB to procure
replacement services, ESWC may terminate this Agreement for its own convenience
upon ninety (90) days written notice to the Governing Board and WCWDB. Parties
may immediately terminate this Agreement upon material breach of the other party,
however the breaching party shall have fifteen (15) days after receiving such notice
to cure such breach. Upon termination, the Governing Board and WCWDB shall take
possession of all materials, equipment, tools and facilities owned by the Governing
Board or WCWDB which ESWC is using, by whatever method it deems expedient;
and ESWC shall deliver to the Governing Board or WCWDB all completed or
partially completed Work under this Agreement, together with all other items,
materials and documents which have been paid for by the Governing Board or
WCWDB, and these items, materials and documents shall be the property of the
Governing Board or WCWDB. Upon termination of this Agreement by the Governing
Board or WCWDB, ESWC shall have no claim of any kind whatsoever against the
Governing Board or WCWDB by reason of such termination or by reason of any act
incidental thereto, except for compensation for work satisfactorily performed and/or
materials described herein properly delivered.
5. Extension or Amendment. Any amendments or modifications to this agreement
shall be in writing signed by all parties. No additional services or work performed by
ESWC shall be the basis for additional compensation unless and until the Governing
Board or WCWDB has obtained written authorization and acknowledgement by
ESWC for such additional services.
6. Compensation. The Governing Board and WCWDB agrees to pay ESWC an
amount not to exceed the amount as set forth in the Exhibits. No payment in excess
of that set forth in the Exhibits will be made by the Governing Board or WCWDB
unless a Change Order authorizing such additional payment has been specifically
approved by Weld County. If, at any time during the term or after termination or
expiration of this Agreement, the Governing Board or WCWDB reasonably
determines that any payment made by the Governing Board or WCWDB to ESWC
was improper because the service for which payment was made did not perform as
set forth in this Agreement, then upon written notice of such determination and
request for reimbursement from the Governing Board or WCWDB, ESWC shall
forthwith return such payment(s) to the Governing Board or WCWDB. Upon
termination or expiration of this Agreement, unexpended funds advanced by the
Governing Board or WCWDB, if any, shall forthwith be returned to the Governing
Board or WCWDB. The Governing Board or WCWDB will not withhold any taxes
from monies paid to ESWC hereunder and ESWC agrees to be solely responsible
for the accurate reporting and payment of any taxes related to payments made
pursuant to the terms of this Agreement. Unless expressly enumerated in the
attached Exhibits, ESWC shall not be entitled to be paid for any other expenses (e.g.
mileage). Notwithstanding anything to the contrary contained in this Agreement, the
Governing Board or WCWDB shall have no obligations under this Agreement after,
nor shall any payments be made to ESWC in respect of any period after December
31 of any year, without an appropriation therefore by the Governing Board or

WCWDB in accordance with a budget adopted by the Board of County
Commissioners in compliance with Article 25, Title 30 of the Colorado Revised
Statutes, the Local Government Budget Law (C.R.S. 29-1-101 et. seq.) and the
TABOR Amendment (Colorado Constitution, Article X, Sec. 20).
7. Subcontractors. ESWC acknowledges that the Governing Board and WCWDB has
entered into this Agreement in reliance upon the particular reputation and expertise
of ESWC. ESWC shall not enter into any subcontractor agreements for the
completion of the Work without the Governing Board or WCWDB's prior written
consent, which may be withheld in the Governing Board or WCWDB's sole
discretion. The Governing Board or WCWDB shall have the right in its reasonable
discretion to approve all personnel assigned to the Work during the performance of
this Agreement and no personnel to whom the Governing Board or WCWDB has an
objection, in its reasonable discretion, shall be assigned to the Work. ESWC shall
require each subcontractor, as approved by the Governing Board or WCWDB and to
the extent of the Work to be performed by the subcontractor, to be bound to ESWC
by the terms of this Agreement, and to assume toward ESWC all the obligations and
responsibilities which ESWC, by this Agreement, assumes toward the Governing
Board or WCWDB. ESWC shall have the right (but not the obligation) to enforce the
provisions of this Agreement against any subcontractor hired by ESWC and ESWC
shall cooperate in such process. ESWC shall be responsible for the acts and
omissions of its agents, employees, and subcontractors.
8. Warranty. ESWC warrants that the Work performed under this Agreement will be
performed in a manner consistent with the standards governing such services and
the provisions of this Agreement. ESWC further represents and warrants that all
Work shall be performed by qualified personnel in a professional manner, consistent
with industry standards, and that all services will conform to applicable
specifications.
10. Acceptance of Services Not a Waiver. Upon completion of the Work, ESWC shall
submit to the Governing Board or WCWDB originals of all test results, reports, etc.,
generated during completion of this work. Acceptance by the Governing Board or
WCWDB of reports and incidental material(s) furnished under this Agreement shall
not in any way relieve ESWC of responsibility for the quality and accuracy of the
project. In no event shall any action by ESWC hereunder constitute or be construed
to be a waiver by the Governing Board or WCWDB of any breach of this Agreement
or default which may then exist on the part of ESWC, and the Goveming Board or
WCWDB's action or inaction when any such breach or default exists shall not impair
or prejudice any right or remedy available to ESWC with respect to such breach or
default. No assent expressed or implied, to any breach of any one or more
covenants, provisions or conditions of the Agreement shall be deemed or taken to
be a waiver of any other breach. Acceptance by the Governing Board or WCWDB
of, or payment for, the Work completed under this Agreement shall not be construed
as a waiver of any of the Governing Board or WCWDB's rights under this Agreement
or under the law generally.

11. Insurance. ESWC must secure, before the commencement of the Work, the
following insurance covering all operations, goods, and services provided pursuant
to this Agreement, and shall keep the required insurance coverage in force at all
times during the term of the Agreement, or any extension thereof, and during any
warranty period. For all coverages, ESWC's insurer shall waive subrogation rights
against the Governing Board or WCWDB. ESWC shall provide coverage with limits
of liability no less than those stated below. An excess liability policy or umbrella
liability policy may be used to meet the minimum liability requirements provided that
the coverage is written on a "following form" basis.
Acceptability of Insurers: Insurance is to be placed with insurers duly licensed or
authorized to do business in the state of Colorado and with an "A.M. Best" rating of
not less than A -VII. The Governing Board or WCWDB County in no way warrants
that the above -required minimum insurer rating is sufficient to protect ESWC from
potential insurer insolvency.
Required Types of Insurance.
Workers' Compensation and Employer's Liability Insurance as required by state
statute, covering all of the ECWC's employees acting within the course and scope of
their employment. The policy shall contain a waiver of subrogation against. the
Governing Board or WCWDB. This requirement shall not apply when ESWC or
subcontractor is exempt under Colorado Workers' Compensation Act., AND when
ESWC or subcontractor executes the appropriate sole proprietor waiver form.

Commercial General Liability Insurance including public liability and property
damage, covering all operations required by the Work. The policy shall be endorsed
to include the following additional insured language: "County, its elected officials,
trustees, employees, agents, and volunteers shall be named as additional insureds
with respect to liability arising out of the activities performed by, or on behalf of the
ESWC."
Such policy shall include Minimum Limits as follows:

Personal/Advertising Injury $ 1,000,000

Automobile Liability Insurance for Bodily Injury and Property Damage for any
owned, hired, and non -owned vehicles operating both on County property and
elsewhere in the performance of this Contract.
Contractor's Automobile Insurance Policy shall include Minimum Limits as follows:
Bodily Injury/Property Damage (Each Accident) $ 1,000,000
12. Proof of Insurance. All insurers must be licensed or approved to do business
within the State of Colorado, and unless otherwise specified, all policies must be
written on a per occurrence basis. ESWC shall provide the County with a Certificate
of Insurance evidencing all required coverages, before commencing work or entering
the County premises. ESWC shall furnish the Governing Board or WCWDB with
certificates of insurance (ACCORD) form or equivalent approved by the Governing
Board or WCWDB as required by this Contract. The certificates for each insurance
policy are to be signed by a person authorized by that insurer to bind coverage on its
behalf. The ESWC shall name the County, its elected officials, trustees, employees,
agents, and volunteers as "Additional Insureds" for work that is being performed by
the Contractor.
On insurance policies where the County is named as an additional insured, the
County shall be an additional insured to the full limits of liability purchased by ESWC
even if those limits of liability are in excess of those required by this Contract.
Upon request by the Governing Board or WCWDB, ESWC must provide a certified
copy of the actual insurance policy and/or required endorsements, for examination,
effecting coverage(s) required by the Contract. Such documents are deemed
confidential and deemed not public records for purposes of the Colorado Open
Records Act. All certificates and endorsements are to be received and approved by
the Governing Board or WCWDB before work commences.
Each insurance policy required by this Agreement must be in effect at or prior to
commencement of work under this Agreement and remain in effect for the duration
of the project, and for a longer period of time if required by other provisions in this
Agreement. Failure to maintain the insurance policies as required by this Agreement
or to provide evidence of renewal is a material breach of contract.
All certificates and any required endorsement(s) shall be sent directly to the
Governing Board or WCWDB County Department Representative's Name and
Address. The project/contract number and project description shall be noted on the
certificate of insurance. The Goveming Board and WCWDB reserves the right to
require complete, certified copies of all insurance policies for examination required
by this Agreement at any time.

Any modification or variation from the insurance requirements in this Agreement
shall be made by the County Attorney's Office, whose decision shall be final. Such
action will not require a formal contract amendment but may be made by
administrative action.
13. Additional Insurance Related Requirements: The Governing Board and
WCWDB requires that all policies of insurance be written on a primary basis, non-
contributory with any other insurance coverages and/or self-insurance carried by the
County.
ESWC shall advise the Governing Board and WCWDB in the event any general
aggregate or other aggregate limits are reduced below the required per occurrence
limit. At their own expense, ESWC will reinstate the aggregate limits to comply with
the minimum requirements and shall furnish the Governing Board or WCWDB with a
new certificate of insurance showing such coverage is in force.
Commercial General Liability Completed Operations coverage must be kept in effect
for up to three (3) years after completion of the project. Contractors Professional
Liability (Errors and Omissions) policy must be kept in effect for up to three (3) years
after completion of the project.
Certificates of insurance shall state that on the policies that the Governing Board
and WCWDB is required to be named as an Additional Insured, the insurance carrier
shall provide a minimum of 30 days advance written notice to the Governing Board
or WCWDB for cancellation, non -renewal, suspension,voided, or material changes
to policies required under this Agreement, except when cancellation is for non-
payment of premium, then ten (10) days prior notice may be given.
On all other policies, it is the ESWC responsibility to give the Governing Board and
WCWDB County 30 days' notice if policies are reduced in coverage or limits,
cancelled or non -renewed. However, in those situations where the insurance carrier
refuses to provide notice to the Governing Board and WCWDB, ESWC shall notify
the Governing Board and WCWDB of any cancellation, or reduction in coverage or
limits of any insurance within seven (7) days or receipt of insurer's notification to that
effect.
ESWC agrees that the insurance requirements specified in this Agreement do not
reduce the liability ESWC has assumed in the indemnification/hold harmless section
of this Agreement.
Failure of ESWC to fully comply with these requirements during the term of this
Agreement may be considered a material breach of contract and may be cause for
immediate termination of the Agreement at the option of the Governing Board or
WCWDB. The Governing Board and WCWDB County reserves the right to

negotiate additional specific insurance requirements at the time of the contract
award.
14. Subcontractor Insurance. ESWC hereby warrants that all subcontractors
providing services under this Agreement have or will have the above -described
insurance prior to their commencement of the Work, or otherwise that they are
covered by the ESWC's policies to the minimum limits as required herein. ESWC
agrees to provide proof of insurance for all such subcontractors upon request by the
Governing Board or WCWDB.
15. No limitation of Liability. The insurance coverages specified in this Agreement
are the minimum requirements, and these requirements do not decrease or limit the
liability of ESWC. The Governing Board or WCWDB in no way warrants that the
minimum limits contained herein are sufficient to protect ESWC from liabilities that
might arise out of the performance of the Work under by ESWC, its agents,
representatives, employees, or subcontractors. ESWC shall assess its own risks
and if it deems appropriate and/or prudent, maintain higher limits and/or broader
coverages. ESWC is not relieved of any liability or other obligations assumed or
pursuant to the Contract by reason of its failure to obtain or maintain insurance in
sufficient amounts, duration, or types. ESWC shall maintain, at its own expense,
any additional kinds or amounts of insurance that it may deem necessary to cover its
obligations and liabilities under this Agreement.
16. Mutual Cooperation. The Governing Board, WCWDB County and ESWC shall
cooperate with each other in the collection of any insurance proceeds which may be
payable in the event of any loss, including the execution and delivery of any proof of
loss or other actions required to effect recovery.
17. Indemnity. The ESWC shall defend, indemnify, hold harmless and, not excluding
the Governing Board or WCWDB's right to participate, defend the Governing Board
or WCWDB, its officers, officials, agents, and employees, from and against all
liabilities, claims, actions, damages, losses, and expenses including without
limitation reasonable attorneys' fees and costs (hereinafter referred to collectively as
"claims") for bodily injury or personal injury including death, or loss or damage to
tangible or intangible property caused, or alleged to be caused, in whole or in part,
by the negligent or willful acts or omissions of ESWC or any of its owners, officers,
directors, agents, employees or subcontractors. This indemnity includes any claim
or amount arising out of or recovered under the Workers' Compensation law or
arising out of the failure of such contractor to conform to any federal, state, or local
law, statute, ordinance, rule, regulation, or court decree. It is the specific intention of
the parties that the Governing Board and WCWDB shall, in all instances, except for
claims arising solely from the negligent or willful acts or omissions of the Governing
Board or WCWDB, be indemnified by ESWC from and against any and all claims. It
is agreed that ESWC will be responsible for primary loss investigation, defense, and
judgment costs where this indemnification is applicable. In consideration for the
award of this contract, ESWC agrees to waive all rights of subrogation against the

Governing Board or WCWDB, its officers, officials, agents, and employees for losses
arising from the work performed by ESWC for the Governing Board or WCWDB.
18. Non -Assignment. ESWC may not assign or transfer this Agreement or any interest
therein or claim thereunder, without the prior written approval of the Governing
Board and WCWDB. Any attempts by ESWC to assign or transfer its rights
hereunder without such prior approval by the Governing Board and WCWDB shall,
at the option of the Governing Board and WCWDB, automatically terminate this
Agreement and all rights of ESWC hereunder. Such consent may be granted or
denied at the sole and absolute discretion of the Governing Board and WCWDB.
19. Examination of Records. To the extent required by law, the ESWC agrees that a
duly authorized representative of the Governing Board or WCWDB, including the
County Auditor, shall have access to and the right to examine and audit any books,
documents, papers, and records of ESWC, involving all matters and/or transactions
related to this Agreement. ESWC agrees to maintain these documents for three
years from the date of the last payment received.
20. Interruptions. Neither party to this Agreement shall be liable to the other for delays
in delivery or failure to deliver or otherwise to perform any obligation under this
Agreement, where such failure is due to any cause beyond its reasonable control,
including but not limited to Acts of God, fires, strikes, war, flood, earthquakes, or
Governmental actions.
21. Notices. All notices or other communications made by one party to the other
concerning the terms and conditions of this contract shall be deemed delivered
under the following circumstances:
a) personal service by a reputable courier service requiring signature for receipt; or
b) five (5) days following delivery to the United States Postal Service, postage
prepaid addressed to a party at the address set forth in this contract; or
c) electronic transmission via email at the address set forth below, where a receipt
or acknowledgment is required and received by the sending party; or
Either party may change its notice address(es) by written notice to the other. Notice

22. Compliance with Law. ESWC shall strictly comply with all applicable federal and
State laws, rules and regulations in effect or hereafter established, including without
limitation, laws applicable to discrimination and unfair employment practices.
23. Non -Exclusive Agreement. This Agreement is nonexclusive, and the Governing
Board or WCWDB may engage or use other Contractors or persons to perform
services of the same or similar nature.
24. Entire Agreement/Modifications. This Agreement including the Exhibits attached
hereto and incorporated herein, contains the entire agreement between the parties
with respect to the subject matter contained in this Agreement. This instrument
supersedes all prior negotiations, representations, and understandings or
agreements with respect to the subject matter contained in this Agreement. This
Agreement may be changed or supplemented only by a written instrument signed by
all parties.
25. Fund Availability. Financial obligations of the Governing Board and WCWDB
payable after the current fiscal year are contingent upon funds for that purpose being
appropriated, budgeted, and otherwise made available. Execution of this Agreement
by the Governing Board and WCWDB does not create an obligation on the part of
the Governing Board or WCWDB to expend funds not otherwise appropriated in
each succeeding year.
26. Employee Financial Interest/Conflict of Interest — C.R.S. §§24-18-201 et seq.
and §24-50-507. The signatories to this Agreement state that to their knowledge, no
employee of Weld County has any personal or beneficial interest whatsoever in the
service or property which is the subject matter of this Agreement.

27. Survival of Termination. The obligations of the parties under this Agreement that
by their nature would continue beyond expiration or termination of this Agreement
(including, without limitation, the warranties, indemnification obligations,
confidentiality and record keeping requirements) shall survive any such expiration or
termination.
28. Severability. If any term or condition of this Agreement shall be held to be invalid,
illegal, or unenforceable by a court of competent jurisdiction, this Agreement shall be
construed and enforced without such provision, to the extent that this Agreement is
then capable of execution within the original intent of the parties.
29. Non -Waiver. No term or condition of this Agreement shall be construed or
interpreted as a waiver, express or implied, of the monetary limitations or any of the
other immunities, rights, benefits, protections, or other provisions, of the Colorado
Governmental Immunity Act §§ 24-10-101 et seq., as applicable now or hereafter
amended.
30. No Third -Party Beneficiary. It is expressly understood and agreed that the
enforcement of the terms and conditions of this Agreement, and all rights of action
relating to such enforcement, shall be strictly reserved to the undersigned parties
and nothing in this Agreement shall give or allow any claim or right of action
whatsoever by any other person not included in this Agreement. It is the express
intention of the undersigned parties that any entity other than the undersigned
parties receiving services or benefits under this Agreement shall be an incidental
beneficiary only.
31. Board of County Commissioners of Weld County Approval. This Agreement
shall not be valid until it has been approved by the Board of County Commissioners
of Weld County, Colorado, or its designee.
32. Choice of Law/Jurisdiction. Colorado law, and rules and regulations established
pursuant thereto, shall be applied in the interpretation, execution, and enforcement
of this Agreement. Any provision included or incorporated herein by reference which
conflicts with said laws, rules and/or regulations shall be null and void. In the event
of a legal dispute between the parties, Contractor agrees that the Weld County
District Court shall have exclusive jurisdiction to resolve said dispute.
33. No Employment of Unauthorized Aliens - ESWC certifies, warrants, and agrees
that it does not knowingly employ or contract with an unauthorized alien who will
perform work under this Agreement (see 8 U.S.C.A. §1324a and (h)(3)) nor enter
into a contract with a subcontractor that employs or contracts with an unauthorized
alien to perform work under this Agreement. Upon request, ESWC shall deliver to
the Goveming Board or WCWDB a written notarized affirmation that it has examined
the legal work status of an employee and shall comply with all other requirements of
federal or state law.

ESWC agrees to comply with any reasonable request from the Colorado Department
of Labor and Employment in the course of any investigation.

and WCWDB may terminate this Agreement for breach, and if so terminated, ESWC
shall be liable for actual and consequential damages.
Acknowledgment. The Governing Board, WCWDB and ESWC acknowledge that each
has read this Agreement, understands it and agrees to be bound by its terms. All parties
further agree that this Agreement, with the attached Exhibits, is the complete and
exclusive statement of agreement between the parties and supersedes all proposals or
prior agreements, oral or written, and any other communications between the parties
relating to the subject matter of this Agreement.

Scope of Services
I. Designation
The Governing Board is the designated grant recipient for all WIOA Title I, Title III and
other Federal and State funding appropriations for workforce development programs
for the Weld County Department of Human Services, Division of Employment Services
of Weld County.
The Weld County Department of Human Services is the designated administrative
entity for the workforce center programs under the governance of the Governing
Board for Weld County. ESWC, a division under the Weld County Department of
Human Services, is identified as the American Job Center and was selected as the
One -Stop Operator through an open and competitive bid process. ESWC functions as
a comprehensive workforce one -stop center for Weld County and programmatically
delivers the employment and training programs funded under WIOA Title I and Title III
and other Federal and State funded workforce development programs and initiatives,
as well as the work components of the Temporary Assistance for Needy Families
(TANF), Community Services Block Grant (CSBG), and the Employment First
programs in Weld County.
The WCWDB has been created by the Governing Board by Resolution and is
comprised of representatives from private sector employers, educational agencies,
labor unions, and other human service providers as prescribed by the Act to provide
policy, oversight, strategic planning on broad labor market issues and development of
employment and training programs regarding the one -stop delivery system for Weld
County.
II. Purpose
The purpose of this agreement is to define the roles and responsibilities of the parties
hereto to determine optional services and service variations to meet local employers'
and job seekers' needs, oversee the operation of the Workforce Programs, better
prepare youth and unskilled adults for entry into the labor force and afford training to
economically disadvantaged individuals and other individuals facing serious
employability barriers who are in need of such training to obtain productive
employment in Weld County.
Each partner to the Agreement shall provide the specific knowledge, expertise and
resources needed to affect a high -quality workforce one -stop delivery system.
III. Workforce Plan Developments
The Governing Board, the WCWDB, and ESWC (under Human Services) will take an
active role in the development of the Regional and local area Workforce Development
Plans. ESWC staff shall support the work of the WCWDB and prepare the plans, other

regional policies, and any Memorandums of Understanding required by the Act under
the policy guidance of the WCWDB and the approval of the Governing Board.
IV. Roles and Responsibilities
A. WCWDB Responsibilities
The WCWDB shall perform the following functions:
1. Develop Local Plan - In partnership with the Governing Board develop
comprehensive four (4) year local and regional plans to implement the
Workforce Innovation and Opportunity Act (WIOA).
2. Conduct workforce research and regional labor market analysis to identify
economic conditions; the knowledge and skills needed for employment in the
region; and an analysis of the available workforce to assist in the development
of the regional/local area plan.
3. Convene, broker, and leverage with local workforce development system
partners and stakeholders to assist in development of local plan and in
identifying non-federal expertise and resources to leverage support for
workforce development activities.
4. Lead efforts to engage with a diverse range of employers and entities in the
region to promote business representation; to develop effective linkages with
employers to support utilization of the workforce system; to ensure that
workforce investment activities meet the needs of employers and support
economic growth in the region; and to implement proven or promising strategies
for meeting the employment and skill needs of workers and of employers (such
as establishment of industry/sector partnerships).
5. In partnership with the Governing Board, provide oversight of programs to
ensure appropriate use and management of program funds for activities, to
maximize performance outcomes, and to develop Memorandum of
Understandings (MOUs) with required one -stop partners.
6. In partnership with the Governing Board and the Governor, negotiate local
performance accountability measures as described by the Act.
7. Select or re -certify the one -stop operator through utilization of the Weld County
Procurement Process. The selection will be made through a competitive bid
process which will take place every three years, barring any major changes.
8. Identify eligible providers of training services in the local area.

9. Conduct oversight for local youth workforce investment activities, including
identifying eligible providers of youth program elements in the local area by
awarding grants or contracts on a competitive basis utilizing the Weld County
Procurement Process.
10.Develop a budget (with the grant recipient) for the activities in the local area,
consistent with the local plan and duties of the WCWDB.
11.Work with representatives of secondary and post -secondary education
programs, in the local area to develop and implement career pathways within
the area.
12.Lead efforts in the local area to identify, promote, and disseminate proven and
promising strategies and initiatives to meet the needs of employers and workers
with disabilities.
13.Develop strategies for using technology to maximize the accessibility and
effectiveness of the local workforce development system for employers,
workers, and jobseekers.
14.Coordinate activities with education and training providers in the local area,
including workforce, adult education and literacy, career and technical
education, and Vocational Rehabilitation activities. Specifically, this includes
reviewing applications to provide adult and literacy activities under Title II for
the local area to determine whether applications are consistent with the local
plan and implementing cooperative agreements and/or Memorandums of
Understanding with Vocational Rehabilitation agencies to enhance provision of
services to individuals with disabilities.
15.Annually assess the physical and programmatic accessibility of all of the one -
stop centers in the local area in accordance with Section 188 of the Act for
individuals with disabilities.
B. Governing Board Responsibilities
The Governing Board shall perform the following functions:
1. Oversee the activities of Employment Services in operating the American Job
Center and as the selected One -Stop Operator in accordance with the plans
and recommendations formulated by the WCWDB and approved by the
Governing Board.
2. Appoint membership to the WCWDB.
3. Serve as the grant recipient and assume financial liability for funds or resources

received and administered by the Director of the Weld County Department of
Human Services pursuant to the agreements with the State.
4. Establish the conditions and terms of employment for all Weld County
Department Human Services employees.
5. Ensure that adequate resources are available to assist the WCWDB in carrying
out its duties.
C. Joint Governing Board and WCWDB Responsibilities
The Governing Board and WCWDB shall jointly perform the following basic
functions:
1. Develop a comprehensive local and regional plan consistent with Section 107 of
the Act;
2. Select or re -certify one -stop operators under Section 107 and terminate, for
cause, the eligibility of such operators as appropriate;
3. Program planning and establishment of basic policies and guidelines, and
principles for program operations;
4. Promote the Act, appropriate state legislation and local programs for the benefit
of unemployed individuals and local employers;
5. Oversee program implementation and outcomes to assure that legislative intent
is met and resources are being utilized for the maximum benefit;
6. Identify available public funding intended for the job training needs of job -
seekers and employers;
7. Allocate available resources to the agency and capable service providers in
order to attain maximum benefits;
8. Provide a public record of the resources devoted, activities undertaken and
performance achieved for the benefit of funding sources, local citizenry,
taxpayers and those communities targeted for assistance;
9. Participate in the selection of organizations to be the local One -Stop Operator,
including both administration and service delivery; and
10.Provide strategic planning on broad labor market issues in ways that are
innovative, performance based and responsive to local needs.

D. ESWC's Responsibilities as the One -Stop Operator
In the role of the One -Stop Operator, ESWC will work with the WCWDB and the
Weld County Department of Human Services to ensure customers have access to
connect with the full range of relevant programs, services and activities provided by
the required partners in the Weld County Americas Job Center, and the one -stop
service delivery system as specified in §121 of the Workforce Innovation and
Opportunity Act of 2014, and Colorado Policy Guidance Letter (PGL) WIOA-2016-
02.
In addition to its role as the One -Stop Operator, ESWC is the Americas Job Center
for the Weld County Regional Planning area and the local workforce area. In the
role of One -Stop Operator, ESWC will be responsible for and support the Americas
Job Center in the following ways as directed:
1. Facilities, Equipment and Operations Management, including:
a. Report any facilities issues such as heating, cooling, restrooms, janitorial
service, necessary repairs or other issues related to space and furniture;
b. Oversee the center calendars to ensure all classes and activities are
adequately staffed and offered appropriately;
c. Ensure technology is functional and current;
d. Ensure that all staff in the center are properly trained and utilize the required
data management systems for all data entry.
e. Working with partners to guarantee adaptive technologies to support
disabled clients are in good working order, available and that staff is properly
trained in this area;
f. Ensure that all Americans with Disabilities Act requirements are met and
managed and prepare annual report to the Workforce Development Board
regarding the requirements of the American Disability Act.
g. Certify all equipment is maintained and appropriately secured;
h. Assist in coordinating services in the Fort Lupton Office; and
i. Communicate any concerns or recommendations to the Department Head.
2. Resource Sharing Agreement (RSA) and Memorandums of Understanding:
a. With the WCWDB, create, maintain and update any RSA as necessary to

ensure partners are contributing their share of the costs of the center;
b. Ensure that all shared costs are transparent to all partners;
c. Update and Coordinate Memorandums of Understanding as needed with
mandatory partners; and
d. Work though agreements with partners to recommend improved service
delivery, document any accomplishments and strengthen the workforce
system with all partners, helping to assure career services are available
regardless of where customers enter the workforce system.
3. Staff Training:
a. Staff training will occur quarterly at a minimum
b. Coordinate and document staff training in areas of leadership, customer
service, workforce development, lean processes, networking, public
speaking and other skills to be determined;
c. Facilitate cross training among the staff and partners; and
d. Assist managers in identifying training needs
4. Staff Committees:
a. Coordinate staff committees to address needs within the America's Job
Center and the workforce system. Committees might be internally facing (i.e.
staff development, hospitality) or customer -facing (i.e. marketing, safety, and
aesthetics).
5. Marketing:
a. Promote the services of the America's Job Center, including development of
marketing and outreach materials and management of the center Facebook,
Linked In and other digital media pages with the support and under the
direction of the Weld County Department of Human Services and the
Governing Board.
6. Maintaining Appropriate Barriers:
a. To ensure adequate firewalls are established and maintained, ESWC will follow
the WCWDB bylaws and Conflict of Interest Policy, and Weld County
Government Purchasing guidelines to ensure ESWC staff recuse themselves for
any WCWDB functions that would create a conflict of interest. Instances in

which ESWC employees may recuse themselves include but are not limited to
the following circumstances:
Prior to full disclosure of the information, any discussion about any matter
regarding the provision of services by such member (or an entity represented
by such member) or that would directly benefit such member or the
immediate family of such member;
Any situation where ESWC or an individual employee receives any direct
financial benefit from any contract for which he/she has participated in the
development of the Request for Proposal (RFP) or determination of contract
terms or performance standards; or
• Any situation where ESWC or an individual employee engage directly or
indirectly in any business transactions or private arrangements for profit
which accrue from or are based upon the member's position on the board.
• From board or council votes when a conflict of interest arises.
7. Additional Responsibilities:
a. Maintain knowledge of the mission and performance standards of all
partners;
b. Ensure ESWC's non -program -related policies and procedures are effectively
communicated and carried out at the America's Job Center, affiliate sites and
connection sites;
c. Comply with all policies governing operations of the Department and the
Governing Board;
d. Ensure non -program Equal Employment Opportunity (EEO) requirements
are met, including coordinating staff training and assuring EEO posters and
processes are in place;
e. Establish a methodology for measurement; and ensuring services,
especially workshops, are of the highest quality and are meeting customer
needs and the needs of the labor market;
f. Conduct regular surveys and screenings of center -wide customers and staff
members for continuous improvement of all services and environments of the
America's Job Center, connection sites and affiliate sites.
g. Report to the WCWDB on operations, performance accountability and

continuous improvement processes as requested.
V. Weld County Workforce Development Board Bylaws
The Governing Board shall review and approve the WCWDB Bylaws and
subsequent amendments thereto.
VI. WCWDB Staff Support/Access to Records
Employment Services shall provide the appropriate staff to support the WCWDB.
Accompanied by ESWC staff, the WCWDB shall have full and complete access to Weld
County Department of Human Services premises and those records and overall
information pertaining to the programs and activities of the one -stop delivery system.
VII. Administration of Grants and Funds
The administration of all grants, contracts, etc., awarded to or entitled to the Weld
County Workforce Region shall be the responsibility of the Governing Board. This
responsibility shall include grant seeking, grant package preparation and submittal,
receipt of contracts or awards, obligations of funds, auditing of funds, audit resolution,
reporting, monitoring, evaluation and closing out.

Employment Services of Weld County (ESWC) submits the following responses to the
Request for Proposal for the One -Stop Operator for the Workforce Innovation and
Opportunity Act (WIOA).
As the existing and designated Local Area and American Job Center (AJC) under the
Workforce Innovation and Opportunity Act, ESWC has existing infrastructure and
experience to perform efficiently and effectively each of the functions identified in the Scope
of Work under this Proposal.
Employment Services has demonstrated successful performance of all responsibilities
mandated by four (4) federal acts. After the implementation of the Comprehensive
Employment and Training Act (1973) and the Job Training Partnership Act (1982), the
Workforce Investment Act (1998) resulted in the creation of the One -Stop Operator system.
This continuity of service extends to present day under WIOA (2014).
As identified within this proposal, ESWC has developed and has current Resource Sharing
Agreement (RSA) and Memorandum of Understanding (MOU) agreements with each of the
required partners under WIOA and coordinates services and training across the workforce
development system. In its role as the Weld County AJC, ESWC works closely with the
Weld County Workforce Development Board (WCWDB) and its committees to ensure
services and programs are designed and structured to meet the identified needs of our
community. Through these efforts, the Weld County Public Information Office supports the
marketing and outreach materials regarding the AJC. Weld County Government and the
Weld County Department of Human Services provide support and direction of the
management of programs of the center.
Additionally, ESWC has very good knowledge of the mission and performance standards of
all partners and can ensure non -program -related policies and procedures are effectively
communicated and carried out at the Center and our affiliate sites. ESWC has a strong
commitment and history of compliance with policies governing the operation of programs as
well as compliance with Equal Employment Opportunity (EEO) and Americans with
Disabilities Act (ADA) requirements.
As identified within this proposal, ESWC is committed to staff training and has an existing
measurement process to ensure services are of the highest quality and that those services
meet the needs of our customers and the local labor market. Through the operation of
programs, ESWC has a demonstrated track record of meeting and exceeding performance
measurement standards for programs and is committed to program accountability and
continuous improvement processes.

1. Organizational Experience and Past Performance
Employment Services of Weld County (ESWC), with oversight provided by the
Weld County Board of Commissioners and the Weld County Workforce
Development Board (WCWDB), has effectively operated and administered a
wide variety of employment and training programs for over 44 years. ESWC
aligns program services with local and regional labor market needs and creates
comprehensive strategies and partnerships that meet those needs. To support
the economic vitality of Weld County, ESWC focuses on providing quality,
customer -driven employment and training programs, as well as services to
employers, job seekers, and other stakeholders.
As the local One -Stop Operator and provider of services under the Workforce
Innovation and Opportunity Act of 2014 (WIOA), ESWC consistently meets or
exceeds the adjusted levels of performance every year. Exhibit 1 to this
proposal provides information on performance levels achieved for the most
recent completed program year.
A. Describe your vision, mission, staffing and service expertise, services
provided, current customer base, funding sources, and funding stability.
Describe how this proposal relates to your organization's goals and to
ESWC's strategic plan goals.
The mission of ESWC is "To keep the workforce system responsive to
employers, employees andjob seekers". ESWC's vision, in collaboration with
our workforce system partners, is to develop and operate employment and
training programs in innovative, adaptive, and customer -driven ways that are
understandable to its customers and easy to use. Administered locally,
Employment Services focuses on outcomes and performance that are supportive
to individuals' growth to earn family sustaining employment; and flexible and pro-
active in changing resources to meet customer need.
As previously indicated, ESWC has effectively developed and operated a wide
variety of employment and training programs over many years. As a result, we
have identified the appropriate levels of staffing to effectively deliver needed
services to job seekers and employers efficiently and cost-effectively to ensure
resources are focused on our customers. Through regular review of funding
streams and the organizational structure, ESWC's turnover is primarily limited to
natural attrition.
ESWC's customer base covers all of Weld County and has offices in Greeley
and Fort Lupton to ensure adequate access to services. Historically, ESWC has
served a large number of employers and job seekers with barriers such as ex -
offender, homeless, individuals with disabilities, and basic skills deficient.
Exhibit 1, the ESWC Dashboard, shows data for the last completed Program
Year (July 1, 2023, to June 30, 2024). The dashboard provides information on
the number of customers served in most ESWC programs and identifies some of
the funding sources and expenditures. In addition to the programs listed in the
Budget Section, ESWC also operates the Temporary Assistance for Needy
Families (TANF) program (Colorado Works), Employment First (EF), Colorado
Child Care Assistance Program (CCCAP), Chafee Foster Care Independence
Program (CFCIP), Youth Corps programs to include AmeriCorps, and the Weld
County Veterans Service Office (VSO). Funding for the various programs has
been historically stable through Federal and State allocations. Levels may vary
year to year. However, there typically is not a variance of more than 10% (+ or -
)
As the designated American Job Center (AJC) for the Weld County Local Area
and provider of Title I (Adult, Dislocated Worker, and Youth) and Title III
(Wagner-Peyser) WIOA services, ESWC's proposal to be the One -Stop Operator
aligns with the WCWDB's strategic plan and goals:
1) Open opportunities for workers and communities: Expanding workforce
opportunities for underserved communities by ensuring equitable access to
workforce programs;
2) Building a better care economy: Strengthening the care economy by
enhancing upskilling, job quality, and career pathways for care workers, with
a focus on low -wage, diverse, young adult, and women workers;
3) New industry partnerships that lead to real, good jobs: Developing
industry partnerships that drive inclusive hiring, competitive compensation,
and career development while ensuring training leads to quality jobs; and
4) Action today for the future of work: Engaging leaders across the public
and private sectors to invest in workers and communities, preparing for
future jobs and emerging industries.
B. Describe your organization's and staff's experience related to One -Stop
Operations and your organization's capacity to carry out your proposed
Operator services.
As the designated operator under the Comprehensive Employment and
Training Act (CETA), Job Training Partnership Act (JTPA), the Workforce
Investment Act (WIA), and WIOA, ESWC has over 44 years of extensive
experience related to the One -Stop Operator duties. The majority of ESWC
staff have achieved Certified Workforce Development Professionals (CWDP)
status through the National Association of Workforce Development
Professionals (NAWDP). While this reflects our commitment to expertise, the
varying experience of new hires and units that do not intersect with
employment & training means that achieving 80°/0 or higher staff certification
is a realistic success. The five (5) competencies of the CWDP are based on
customer service methodology; diversity in workforce development; labor
market information and intelligence; principles of communication; and
workforce development, structure, policies and programs.
Throughout its existence, ESWC has ensured the services from multiple
employment and training programs are integrated to allow for expanded options
for job seekers and employers. Every customer has access to a set of core
employment -related services such as job fairs, computers to apply for
employment, and workshops to assist with interviewing and resume creation.
Priding itself on delivering services seamlessly, ESWC increases their access
and helps ensure their future success through continued evaluation of the local
economy and labor market.
Existing relationships and agreements with the Title II (Adult Education) and Title
IV (Vocational Rehabilitation) core partner programs ensure services to
customers, and the community, are customized to meet local needs. Direct
linkages with other WIOA partner programs, and existing partnerships with
education, economic development, and other workforce system partner's
services, are other means ESWC utilizes to provide accessibility across various
programs.
The ESWC Business Services Unit ensures services and programs are relevant
to the needs of Weld County employers. The unit's communication and
networking results in employers participating in initiatives that focus on in -
demand industry sectors and occupations. Through the connections with
employers, ESWC can ensure services are relevant to the Weld County
community and provide job seekers and workers with the skills and credentials
needed to obtain or advance in employment.
2. Relationships and Collaboration
A. Describe and document your partnerships within Weld County, Colorado
Department of Labor and Employment, community colleges, and other
W/OA-mandated partners (Adult Basic Education, Wagner-Peyser, Division
of Vocational Rehabilitation, and Temporary Assistance to Needy Families
(TANF/DSHS). Be sure to include a clear statement of relationship between
your organization and each partner, how your past relationship will support
your role as Operator, and how you will foster shared values, outcomes
and resources for the betterment of the workforce development system.
As stated previously, this proposal is to allow Employment Services of Weld
County (ESWC) to continue to function as the One -Stop Operator. As the
identified American Job Center (AJC) for the Weld County Local Area, ESWC
directly operates two (2) of the four (4) Core Partner programs (Title I -Adult,
Dislocated Worker, and Youth, and Title III -Wagner Peyser). Funding is allocated
through the United States Department of Labor Employment and Training
Administration and passed through by the Colorado Department of Labor and
Employment (CDLE).
In addition to those Workforce Innovation and Opportunity Act (WIOA) Core
Partner programs, ESWC is also the provider of services for several one -stop
partner programs identified in WIOA law through our contractual relationships
with CDLE and our relationship with Weld County Government and the Weld
County Department of Human Services (WCDHS). The programs and services
operated through those relationships include: the Trade Adjustment Assistance
(TAA) program under Chapter 2 of Title II of the Trade Act of 1974; Veterans
Programs authorized under Chapter 41 of Title 38, U.S.C.; National Farmworker
Jobs Program for Migrant Seasonal Farmworkers (MSFWs) under Section 167;
Unemployment Insurance programs and services under State unemployment
compensation laws; the workforce component of the Temporary Assistance for
Needy Families (TANF) program (Colorado Works) Part A of Title IV of the Social
Security Act; workforce component of the Employment First (EF) program under
the Supplemental Nutrition Assistance Program (SNAP); employment activities
under the Community Services Block Grant (CSBG) Act under 42 U.S.C. 9901 et
seq.; and Youth Corps-AmeriCorps programs under the National and Community
Service Act.
The programs listed above fund staff positions for ESWC and covers operational
and infrastructure costs through an established cost allocation planand process,
which then allows for more resources to be used to benefit customers. For those
partner programs which do not fall under the umbrella of ESWC, we have long-
standing relationships and developed the required Resource Sharing Agreement
(RSA), and Memorandums of Understandings (MOU's) as identified in WIOA law.
These agreements encompass Training and Employment Guidance Letter
(TEGL) 17-16 Infrastructure Funding of the One -Stop Delivery System.
ESWC, through the Weld County Workforce Development Board (WCWDB) and
the Board of Weld County Commissioners, have current MOUs with the local
Title II Adult Education Programs, Aurora Mental Health and Recovery (AMHR),
Community Educational Outreach - Intervention Community Correction Services
(CEO — ICCS); and Aims Community College. In each of these cases,
representatives of these programs are members of the WCWDB and/or their sub-
committees. The MOUs identify partner contributions regarding service
coordination, improvement of service delivery, identifying and documenting
accomplishments and performance outcome efforts, ways to strengthen the
workforce system, and ways to assure career services are available to customers
regardless of where the customer enters the workforce system. Additionally,
ESWC has similarly executed MOUs with the Vocational Rehabilitation provider
under Title IV of WIOA and Service Employment Redevelopment (SER) — Jobs
for Progress National, Inc., the provider of services under Title V of the Older
Americans Act.
ESWC has a long-standing history of collaborative partnerships and efforts with
community colleges and community -based organizations regarding the
development of programs and initiatives that benefit Weld County's job seekers
and employers. Ongoing efforts exist with Aims Community College (Carl D.
Perkins Career and Technical Education Act of 2006), Front Range Community
College, local school districts, and other partners to increase training
opportunities in the targeted growth industries for Weld County. Through sector
initiatives, ESWC, education partners, and local and regional employers develop
training to meet employer identified needs and implement strategies that align
resources, developing new programs and resources to facilitate the growth of the
identified industry sectors.
To ensure individuals with disabilities are provided equal access to services
through ESWC, as well as our other partners in the workforce development
system, ESWC partners and works with community -based organizations such as
Envision, Connections for Independent Living, and the Division of Vocational
Rehabilitation (DVR). Increasing systems access for individuals with disabilities is
of the utmost importance to ESWC. Commitment to this goal is ongoing, with
continuous evaluation and enhancement of accessibility across all programs and
services.
ESWC has a proven track record of successful implementation of programs that
focus on measurable outcomes and performance. Both current and past
relationships with partners focus on meeting the identified needs of employers
and developing partnerships that can best serve the Weld County community.
Through the engagement of the WCWDB, employer groups, job seekers and
partner programs, ESWC looks for ways to improve the structure and delivery of
services to increase our ability to meet the needs of workers and employers.
Further, ESWC works with local economic development, chambers of commerce,
educational entities, and targeted task groups regularly to identify needs and
then, through those collaborative partnerships, develop services to address those
needs.
ESWC has a well -established collaborative relationship with Upstate Colorado
Economic Development. This partnership includes involvement in the site
selection process for new business, identifying potential labor force and training
needs, and action in company start-up processes through recruitment and hiring
events and business retention efforts. ESWC also has active partnerships with
Windsor Economic Development and regional Economic Development Partners
that participate in the Northern Colorado Regional Economic Development
Initiative (NoCo REDI), which encompasses both Weld and Larimer counties.
Aware that not every community has an economic developer, ESWC
participates in many local chambers of commerce meetings. These entities are
on the front line in their communities and are the main link to the needs of
existing businesses as well as potential new employers and can assist the
workforce development system in its responsiveness to business needs.
B. Describe (if applicable) your existing relationship within ESWC.
Not applicable. ESWC is submitting this proposal to enable us to continue to
function in the role of the One -Stop Operator.
3. Operator Plans
A. Describe your plan for improving the operation of the Weld County
America's Job Center and affiliate and connection sites.
Employment Services of Weld County (ESWC) is committed to continuous
improvement in its role as the American Job Center (AJC). In addition to aligning
with the Weld County Workforce Development Board (WCWDB) initiatives,
ESWC implements the strategic plan of the Weld County Department of Human
Services (WCDHS) to enhance and improve Workforce Innovation and
Opportunity Act (WIOA) Title I and Wagner Peyser Title III services. Program
services and performance outcomes are evaluated on an ongoing basis to
ensure ESWC remains responsive to local labor market trends and employer
needs. Leadership ensures that service delivery is up to date and that program
performance meets established standards.
ESWC continuously evaluates program services and performance outcomes to
ensure they align with local labor market trends, employer needs, and
established standards. Quarterly reports are provided to the Weld County
Workforce Development Board (WCWDB), with focus groups or standing
committees leading improvement efforts. To expand workforce access, ESWC
partnered with the High Plains Library District (HPLD) to launch a mobile
workforce unit, funded by a grant from The Weld Trust, bringing job search
assistance, training, and employment services to rural and underserved areas.
Additionally, ESWC's participation in NoCo Works strengthens regional
partnerships, facilitates cross -county workforce alignment, and enhances
employer engagement through industry partnerships, modernized recruitment
practices, and expanded career pathways. ESWC also prioritizes equitable
workforce access by improving outreach, expanding digital and virtual services,
and enhancing programs for veterans, youth, and individuals in the reentry
process, ensuring the Weld County AJC remains a leader in workforce
innovation.
B. Describe your plan for improving the management of facilities and offices,
including negotiating with landlords, managing repairs and maintenance,
and working with staff and partners to design, organize and manage space
configurations.
At a minimum, ESWC completes an annual evaluation of facilities for both AJC
locations (Greeley and Fort Lupton). Over the past four (4) years, ESWC has
maximized its 4,958 square feet in Building B on the WCDHS campus (Greeley),
enhancing service delivery and expanding access for job seekers and
employers. ESWC now hosts bi-monthly job fairs, in-house workshops, and
large-scale hiring events, utilizing a 60 -to 65 -person conference room for
training, industry panels, and workforce development initiatives. Additionally, five
(5) co -located partners provide integrated services that support customer needs.
With streamlined facility maintenance coordinated by Weld County Government
and strategic partnerships, ESWC continues to expand workforce opportunities,
strengthen employer engagement, and improve access to essential services.
C. Describe your plan to service, analyze and recommend improvement and
tracking of services, classes, etc.
Employment Services of Weld County (ESWC) continuously evaluates program
services and performance outcomes to ensure efficiency, accessibility, and
effectiveness. Using the state's management information system, Connecting
Colorado, staff track demographics, services, and referrals, providing valuable
data to guide service improvements. The WCWDBreviews this information
during scheduled Board meetings, where members identify needs and direct task
groups or committees to analyze, track, and recommend ways to enhance
service delivery. As a division of WCDHS, ESWC exemplifies DHS' 2025 draft
Strategic Priorities. By enhancing service integration, streamlining customer
navigation processes, improving internal collaboration, and leveraging
technology to increase efficiency and communication, ESWC meets priority one
(1) Service Excellence & Client -Centered Innovation, priority three (3)
Community Engagement & Public Trust, and priority five (5) Internal
Collaboration & Communication. Upon the publishing of the final priorities, ESWC
will revisit the DHS Strategic Plan to ensure ESWC remains responsive to
workforce needs while advancing DHS' guiding principles and values.
ESWC, in collaboration with our WIOA Partners and other community -based
organizations, continues to develop interconnected workshops to meet the
identified needs of the workforce systems customers. For example, ESWC
partners with HPLD to co -host workshops at ESWC and the LINC Library
Innovation Center. Using the Connecting Colorado database, ESWC's Workshop
Facilitator tracks services/classes for each customer. ESWC also has an onsite
Assessment and Learning Center, and staff continuously promote the various
fee -for -service employer -focused services and training available. Many of the
assessments and computerized training options (SHL Talent Assessments and
Conover Workplace Readiness, etc.) are well suited to assist employers in
identifying qualified applicants and would prove beneficial in improving their
recruitment efforts.
D. Describe your plan to manage and support appropriate technology,
including adaptive technology, for Weld County's America's Job Center
(one -stop center) as well as manage, support and ensure that all equipment
is secure and maintained in good working condition.
An internal WCDHS Information Technology (IT) team, known as Logistics, and
overall Weld County IT team support ESWC. With the established partnerships
with both teams, ESWC can efficiently manage and support technology
operations for both staff and customers. Adaptive/Assistive technology (both
hardware and software) is readily available to customers in the Resource Room.
Examples of adaptive technology include, but are not limited to, FS Reader 3.0,
Jaws 17.0, Wynn Wizard 7.0, Zoom Text 10.1, Dragon Naturally Speaking,
Zoom Text Videos, adjustable height stations, large type keyboards, roller ball
mouse, etc. Continued efforts in this area include annual internal reviews of
technological needs to expand or enhance service delivery, scheduled computer
refresh for all staff and customers, and collaborative engagement with partners
and community -based organizations to meet customer's "where they are". A
strong partner example is HPLD; they have provided laptops for use at the
annual Workforce Symposium, annual Young Adult Job Fair, and will soon walk
alongside ESWC in the launch of a mobile workforce center.
E. Describe your plan and strategy to ensure that all staff in the center are
properly trained and utilize the required data management system for all
data entry.
All ESWC staff train on the respective data management systems that pertain to
their job duties. Staff receives internal training concerning the use of the
Connecting Colorado data system, which is the primary data system for the Title I
and Title III programs under WIOA. As part of our existing agreements with our
Title II and Title IV WIOA partner programs, partner staff is provided training as
appropriate to ensure their customers are registered correctly and receive
information on open job orders. Other partner programs operated by ESWC,
such as Temporary Assistance for Needy Families (TANF — Colorado Works)
and Employment First (workforce component of the Supplemental Nutrition
Assistance Program), utilize Connecting Colorado and the Colorado Benefits
Management System (CBMS). The Child Care Assistance Program utilizes
CBMS and the Child Care Automated Tracking System (CHATS), while Chafee
utilizes Connecting Colorado and Trails, Colorado's Statewide Automatic Child
Welfare Information System. For these programs, staff receive state -sponsored
training and must pass a specified test regarding that system before they are
granted access.
F. Describe your plan for developing, managing and ensuring a fair and
equitable Resource Sharing Agreement that looks beyond simple space
and supply sharing to distribute the cost of supporting the Workforce
Development System across the Core WIOA partners.
When crating Resource Sharing Agreements (RSA, ESWC uses a boiler
template of Federal language to minimize duplicative review and approval efforts
of County Attorneys, Partners, and State staff. The Workforce Coordinator is the
primary point of contact for the development and management of each partner's
RSA, as designated by the WCWDB. Under WIOA, costs include, but are not
limited to, rental of facilities, utilities and maintenance, equipment and
assessment -related products, assisted technology for individuals with disabilities,
and outreach activities. Partners recognize that infrastructure costs apply to all
required partners whether they are physically located at the AJCs or not. ESWC
bases contributions on the proportionate use and relative benefit received; in -
kind contributions maximize program impact through the sharing of services,
resources, and technologies, improving each program's effectiveness.
G. Describe your plan to create a well trained staff by developing and posting
opportunities for training in areas of leadership, customer service,
workforce development best practices, career coaching skills, lean
processes, human -centered design, networking, social media, public
speaking and others. Be clear about how such trainings will be funded,
their frequency and the purpose for which they are offered.
ESWC recruits, develops, and retains staff by promoting workforce culture &
engagement, building leadership capacity at all professional levels, and aligning
professional development opportunities mutually beneficial to staff. All of which
align with the DHS draft Strategic Priorities. A few pieces of training that staff has
attended over the years include Workplace Respect, IT Security to include
HIPPA, Question, Persuade, and Refer (QPR) Gatekeeper Training, and Mental
Health First Aid. In addition to these efforts, each Memorandum of Understanding
(MOU) with Partner Programs addresses the cross -sharing of training
opportunities to ensure staff of all programs is knowledgeable of services
available. ESWC staff also takes advantage of all training resources provided
through Weld County Human Resources. As mentioned in Section 1
(Organizational Experience and Past Performance), ESWC staff have become,
or are in the process of becoming, Certified Workforce Development
Professionals (CWDP) through the National Association of Workforce
Development Professionals (NAWDP). Trainings are supported by State funding,
and Federal funding, when appropriate.
H. Describe your organization's plan for the development of staff committees
that address needs within the Center and workforce system. Provide detail
about the specific committees that currently exist or will be established
and their purpose and desired outcomes.
ESWC plays an active role in each of the following WCDHS teams: the All -
Department Meeting, the Annual Achievement Summary, the safety committee,
and strategic planning. These efforts address needs within ESWC by moving
forward department initiatives, enhancing staff engagement and organizational
culture, and providing staff the opportunity to expand their skills and network.
In 2023, ESWC formed the STEM Committee (Self -Care, Teamwork,
Engagement, and Motivation) as part of an internal effort to support staff well-
being and organizational culture. Initially supported by Darrell "Coach D"
Andrews, an industry recognized workforce development expert, the committee
works to engage staff, prevent burnout, and foster a positive work environment,
reinforcing the agency's commitment to retention, morale, and overall workforce
effectiveness.
The WCWDB maintains two sub -committees to include staff representation. The
Awareness Committee, supported by ESWC's Business Services Manager,
focuses on board recruitment, continued sector awareness and engagement
amongst employers, expanding partnerships with the private industry, promoting
economic development, training and retraining, and the Workforce Center
branding. The Youth Committee, supported by the Employment & Training
Operator, builds and maintains comprehensive partnerships and identifies needs
and gaps and how to approach these to include pursuing opportunities to
diversify funding streams. Through engagement with school districts through
Weld County, they coordinate and focus on business needs to create a talent -
based, skilled workforce, develop work -based learning to include
apprenticeships, career pathways, and entrepreneurships. The Youth Committee
has prioritized efforts based on the goals of the State Youth Council. These goals
include talent equity agenda, shared value/commitment, and youth
representative recruitment.
Describe your plan for promoting the services of the one -stop centers and
affiliate and connection sites, including the development and distribution
of marketing and outreach materials. Explain the process by which the
materials will be developed, standards imposed and coordination with
ESWC. Please be detailed about how you will target and serve specific
WIOA populations with barriers (including but not limited to the long term
unemployed, veterans, youth, minorities, individual with disabilities, etc.).
Weld County Government's Public Information Office (PIO) works closely with
ESWC to develop, distribute and coordinate marketing and outreach materials
along with other initiatives which involve communications and public relations.
ESWC's Workforce Coordinator works closely with PIO and WCDHS Logistics
Team to update marketing, outreach materials and maintain the content on the
ESWC website.
ESWC trains staff at the AJC to welcome individuals from all walks of life,
including individuals from underserved populations. Core training topics include
the nondiscrimination requirements of WIOA Section 188 and giving priority to
recipients of public assistance, other low-income individuals, and individuals who
are basic skills deficient, prioritizing funding and staff resources to those truly in
need.
Veterans receive priority service across all programs and the relocation of Weld
County's Veterans Service Office (VSO) to ESWC has contributed to a boast in
Veterans requesting employment assistance. In addition to internal referrals from
the VSO, Wagner Peyser staff personally reach out to Veterans who are not
currently receiving staff -assisted services but who are actively seeking
employment and offer additional services to include WIOA. ESWC has a long-
term partnership and MOU with the CDLE, co -locating two (2) Jobs for Veterans
State Grants Representatives. Under Colorado's Veterans Service -to -Career
Program, ESWC partners with the Northern Colorado Veterans Resource Center
(NCVRC) to administer Weld Project Salute. Unfortunately, Senate Bill 23-302
repealed the -fiscal note for this program, so ESWC anticipates expending all
funding by June 30, 2025, but are committed to maintaining this vital relationship
with NCVRC.
A Wagner Peyser staff member is the lead for the Reemployment Services and
Eligibility Assessments (RESEA) program, connecting unemployed individuals
with services as quickly as possible. WIOA Adult and Dislocated Worker staff
also identify long-term unemployed individuals in Connecting Colorado and call
potential program participants offering re-employment and training services.
Employment First (EF) and TANF (Colorado Works) staff inform participants,
verbally or electronically, about the WIOA program, co -enrolling eligible
individuals and ultimately reducing the length of time public assistance is needed.
Additional partners and outreach activities include, but are not limited to, the
Immigrant and Refugee Center of Northern Colorado (IRCNoCo), Vocational
Rehabilitation, Rocky Mountain Service Employment Redevelopment (SER) —
Jobs for Progress, Inc., the 19th Judicial District of Probation, Parole and
Colorado Youth Detention Continuum, Child Welfare and Youth Services through
the WCDHS, Youth Net, School to Work Alliance Program (SWAP), numerous
school districts, Platte Valley Youth Services — Division of Youth Corrections, and
North Range Behavioral Health.

Detailed budget information is based on one (1) staff member who currently
performs and supports the essential functions outlined in the WIOA One -Stop
Operator RFP, along with additional duties. Since these responsibilities are
integrated into the existing structure of Employment Services of Weld County
(ESWC), there are no associated costs included in the "Operating Expenses" line
item. While a staffing chart is not required based on this structure, we have
included the most current organizational chart, with the individual performing the
WIOA One -Stop Operator functions clearly circled in red.
Wages earned for duties beyond the scope of this RFP are supported by funding
sources outside of WIOA employment -related programs and Wagner-Peyser.
These sources include, but are not limited to, Temporary Assistance for Needy
Families (TANF), Employment First, Community Services Block Grant (CSBG),
County Administration, Common Support, and Child Welfare.

QUESTIONS AND ANSWERS
1. How many WIOA Mandatory partners does Weld County have? 7 active mandated partners.
2. Are there any mandatory partners Weld County would like to have but either the partner is
not available in Weld County or there needs to be research completed regarding additional
partners? I am not aware of any mandatory partners that are needed or currently being
pursued outside of the ones currently in place.
3. Do all the mandatory partners currently have MOUs and RSAs? Yes, they have MOUs.
4. What is the termination date of the MOUs? It depends on the partner. Most have an annual
renewal or termination date of June 30, but a few have other dates because they have been
started off cycle.
5. Does Weld County meet with partners in a group setting and if so how often? Yes. This is
done in a couple of different ways both monthly and quarterly. An example is called Community
of Practice meeting which happens monthly. Weld County also meets at least quarterly with
partners one on one.
6. What type of cross -training and how often is Weld County providing them to partners? Cross
training is usually done at least quarterly. NOCOWorks puts some of these on through lunch
and learns that bring local partners together for discussions. If a specific cross -training needs to
be done to improve the workforce services, that is typically provided by the One Stop Operator.
7. Are any of the partners co -located in the ESWC facilities in Ft. Lupton or Greeley? Yes, 2 co -
located in Greeley and one is working on it. One is in process of being co -located in Fort
Lupton and there is also a non -mandatory partner that is co -located.
8. How many staff does Weld County employ for their Employment Services division and what
are their roles? There is estimated 70 FTE. They are focused on traditional workforce initiatives
including WIOA Youth, WIOA Adult, Dislocated Workers, Wagner-Peyser, Business Services
and they expand beyond those traditional roles to TANF, SNAP, Chafee, Child Care and
Veteran Services, etc.
9. Are there currently staff committees in place and what are the staff committees
addressing? There are internal Weld County staff committees, but none that are One Stop
Operator led.
10. Is there a maximum budget number for the Lump Sum Price? The budget is contingent on
available funding from the federal and state government. We do not have a number. Looking
for someone who meets the needs of the County's Workforce Center but is as cost effective as
possible.
11. Who will the individual/company report to? Weld County Workforce Director and Weld
County Workforce Board.

As advertised, this solicitation is for Workforce Innovation and Opportunity Act (WIOA)
One -Stop Operator. The WIOA One -Stop Operator provides and coordinates services for the
Weld American Job Center that are focused on training for and securing employment.
A committee from the Work Force Development Board, who helps oversee the One -Stop
Operator reviewed and scored the single submitted proposal. Then on May 13, 2025, the Work
Force Development Board met and voted unanimously to recommend to this Board that
Employment Services of Weld County proposed the best solution to meet the County's needs.
Therefore, the recommendation is to award the bid to Employment Services of Weld County.
