Re: Notice Of The Fort Lupton Fire Protection District's Establishment
Of Fire Impact Fee And Adoption Of An Impact Fee Schedule
Dear County Commissioners,
As you are aware, in follow up to the notice provided to the County on February 10, 2025, the Fort Lupton
Fire Protection District ("District") Board of Directors approved a Resolution establishing a fire impact fee
and adopting an impact fee schedule pursuant to the authority granted under C.R.S. § 32-1-1002(1)(d.5)(1).
The Resolution was adopted at a. public meeting held on April 14, 2025, and a copy of the Resolution is
enclosed with this letter.
The fire impact fee will be imposed on all new buildings, structures, facilities, or improvements, including
oil or gas wells and related equipment, on previously improved or unimproved real property within the
District's jurisdictional boundaries (collectively, "New Development") for which a completed development
permit application is submitted to the County on or after May 1, 2025; however, the District will not collect
the fire impact fee before the issuance of a building permit by the County in connection with the New
Development.
As provided by C.R.S. § 32-1-1001(1)(d.5)(VI), the County is required to notify the District of the
issuance of a building permit for the construction of New Development within the District's
jurisdictional boundaries at the time of issuance. Please provide all such notices, along with contact
information for the developer, to the District's FIRE MARSHAL at ttamlin@ftluptonfire.com. The
District also would appreciate receiving notice of the filing of any completed development permit
application so that it can connect with the developer regarding the fire impact fee, and avoid any developer
surprise that may result if they are not apprised of the fire impact fee until after the building permit is issued.
The District greatly values its relationship with the County, and appreciates the County's cooperation in
helping the District provide the high quality emergency services that its citizens deserve. If you have any
questions regarding this matter, please contact me at (303) 857-4603. Thant; you.
S incerely,

Resolution No. 25-0002
RESOLUTION
BOARD OF DIRECTORS
FORT LUPTON FIRE PROTECTION DISTRICT
RESOLUTION ESTABLISHING A FIRE IMPACT FEE AND ADOPTING AN IMPACT FEE
SCHEDULE
WHEREAS, the Fort Lupton Fire Protection District ("District") is a political subdivision
of the State of Colorado, organized pursuant to the Special District Act, C.R.S. § 32-1-101, et seq.,
to provide fire protection, fire prevention, public education, rescue, hazardous materials,
ambulance, and emergency medical services to the citizens and property within its jurisdiction,
and to individuals passing through its jurisdiction;
WHEREAS, pursuant to C.R.S. § 32-1-1002(1)(d.5)(I), the District is authorized to
receive and spend an impact fee ("Fire Impact Fee") on the construction of new buildings,
structures, facilities, or improvements, including oil or gas wells and related equipment, on
previously improved or unimproved real property within its jurisdictional boundaries (collectively,
"New Development");
WHEREAS, the District obtained an Impact Fee Study dated December 2024 to evaluate
the nexus between New Development within the District's jurisdictional boundaries and the
projected impact that such New Development has on the District's capital facilities ("Nexus
Study");
WHEREAS, in accordance with C.R.S. § 32-1-1002(1)(d.5)(II), the Nexus Study
quantified the reasonable impacts of both new residential development and new non-residential
development on the District's capital facilities at levels no greater than necessary to defray such
impacts directly related to the New Development within the District's jurisdiction;
WHEREAS, the Board accepted the Impact Fee Study on January 30, 2025; however, the
Board determined that it would best serve the District, the citizens and property within its
jurisdiction, and the new development occurring therein, to establish an impact fee schedule in
2025 at 20% of the amounts supported by the Nexus Study, and thereafter to increase the impact
fees at a rate of 2% per year for a period of 5 years, to reach 30% of the amounts supported by the
Impact Fee Study in 2030. A copy of the proposed Impact Fee Schedule setting forth these amounts
is attached as Attachment A ("Impact Fee Schedule");
WHEREAS, the District's Board of Directors has determined it is in the best interests of
the District and the citizens and property it serves to establish a Fire Impact Fee and approve the
attached Impact Fee Schedule.
NOW THEREFORE, be it resolved by the Board of Directors of the Fort Lupton Fire
Protection District that:
5925 515.1
I. The Impact Fee Schedule attached as Attachment A is hereby adopted and
approved;
2. No developer is required to provide any site -specific dedication or improvement to
meet the same need for capital facilities for which a Fire Impact Fee is imposed pursuant to the
Impact Fee Schedule;
3. The District may waive the Fire Impact Fee on the development of low- or
moderate -income housing or affordable employee housing; and
4. The District and a developer may mutually determine whether an "in -kind"
contribution may be made by the developer in lieu of paying all or portion of a Fire Impact Fee.
ADOPTED this 24th day of April, 2025.
