Monday, September 22, 2025
The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, September 22, 2025, at the
hour of 9:00 a.m.
Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Jason S. Maxey
Commissioner Lynette Peppler
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Houstan Aragon
County Attorney, Bruce Barker
Controller, Rusty Williams
Minutes: Commissioner James moved to approve the Minutes of the Board of County
Commissioners meeting from September 3, 2025, as printed. Commissioner Ross
seconded the motion and it carried unanimously. Furthermore, Commissioner Ross
moved to approve the Minutes of the Board of County Commissioners meeting from
September 8, 2025, as printed. Commissioner Peppler seconded the motion and it carried
unanimously.
Certification of Hearings: Commissioner Ross moved to approve the below listed
Hearing Certificate. Commissioner James seconded the motion, which carried
unanimously.
1. ZPAG20-0022 — Erica Walden Trust
Amendments to Agenda: There were no amendments to the Agenda.
Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as
printed. Commissioner James seconded the motion and it carried unanimously.

Warrants:
1. General Warrants: Commissioner James moved to approve the General
Warrants, as printed. Commissioner Ross seconded the motion and upon a roll
call vote of four (4) to one (1), it carried with Commissioner Peppler abstained.
New Business — General:
1. Consider Standard Form for Memorandum of Intergovernmental Agreement
for Conduct of Coordinated Elections Between Clerk and Recorder's Office
and Various Municipalities, and Authorize Chair to Sign any Agreement
Consistent with Said Form: Rudy Santos, Chief Deputy of the Clerk and
Recorder's Office, stated this, and the next two (2) items of business are nearly
identical, but were slightly altered to reflect the need of the different agencies. He
explained this form is for the memorandum of intergovernmental agreement for the
conduct of coordinated elections with the twelve (12) municipalities throughout the
County, and staff recommends approval of the standard form. Commissioner Ross
moved to approve said form and authorize the Chair to sign any agreement
consistent with said form. The motion was seconded by Commissioner Maxey and
it carried unanimously.
2. Consider Standard Form for Memorandum of Intergovernmental Agreement
for Conduct of Coordinated Elections Between Clerk and Recorder's Office
and Various Weld County School Districts, and Authorize Chair to Sign any
Agreement Consistent with Said Form: Mr. Santos stated this form is for the
nine (9) school districts throughout Weld County and staff recommends approval.
Commissioner James moved to approve said form and authorize the Chair to sign
any agreement consistent with said form. The motion was seconded by
Commissioner Ross and it carried unanimously.
3. Consider Standard Form for Memorandum of Intergovernmental Agreement
for Conduct of Coordinated Elections Between Clerk and Recorder's Office
and Various Special Districts, and Authorize Chair to Sign any Agreement
Consistent with Said Form: Mr. Santos stated this form is for two (2) special
districts in Weld County, indicated staff recommends approval, and introduced the
Deputy of the Elections Division, Adam Gonzales. Commissioner Maxey moved to
approve said form and authorize the Chair to sign any agreement consistent with
said form. The motion was seconded by Commissioner James and it carried
unanimously.
4. Consider Contract ID #9932 Agreement for Design and Relocation of Potable
Water Pipeline for County Roads 54 and13 Intersection Roundabout Project
and Authorize Chair to Sign — Little Thompson Water District: Clay Kimmi,
Department of Public Works, stated the agreement is for the relocation of a potable
water main pipeline, and the associated facilities, to be located in the existing
Poudre Valley Rural Electric Association (PVREA) right-of-way easements as part

of the County Roads 54 and 13 Intersection Roundabout construction project. He
stated the cost associated with the agreement is $1,209,110.00.
Commissioner Maxey moved to approve said agreement and authorize the Chair
to sign. Seconded by Commissioner Ross the motion carried unanimously.
Bruce Barker, County Attorney, commended staff efforts in navigating the complex
project.
5. Consider Appointment to Workforce Development Board:
Commissioner Maxey moved to approve said appointment. The motion was
seconded by Commissioner James and it carried unanimously.
6. Consider Cancellation of Board of County Commissioners Meeting
Scheduled for October 22, 2025: Commissioner Ross moved to approve said
cancellation. The motion was seconded by Commissioner Peppier and it carried
unanimously.
New Business — Ordinances:
1. Final Reading of Code Ordinance #2025-12, In the Matter of Repealing and
Reenacting, with Amendments, Chapter 21 Areas and Activities of State
Interest of the Weld County Code (Oil and Gas — Articles V and VI):
Commissioner James moved to read Code Ordinance #2025-12 by title only. The
motion was seconded by Commissioner Ross and it carried unanimously.
Mr. Barker read the title for the record. Brett Cavanaugh, Director of the
Department of Oil and Gas Energy, extended his sincere appreciation for staff,
industry representatives, and public stakeholders for their commitment to
streamlined, cleaner and more responsible oil and gas procedures in Weld County.
Commissioner Maxey commended staff for holding stakeholder meetings,
resulting in a thorough review, and addressing questions and concerns.
Commissioners Ross, James, and Peppier echoed similar sentiments. No public
testimony was offered concerning this matter. Commissioner Ross moved to
approve Code Ordinance #2025-12 on Final Reading, as amended. The motion
was seconded by Commissioner Maxey and it carried unanimously.
Public Comment: No public comment was offered.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 9:13 a.m.
