HomeMy WebLinkAbout20252713.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, October 1, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 1, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey — Excused Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Controller, Rusty Williams Read Ordinances by Audio: Commissioner Ross moved to read the below listed Code Ordinance by audio. The motion was seconded by Commissioner James and it carried unanimously. 1. Emergency Ordinance #261-A Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Peppler seconded the motion and it carried unanimously. Presentations and Proclamations: 1. Recognition of Services, Sheriffs Office — Mary Shannon: Chair Buck read the certificate for the record. Captain Matt Turner, Sheriff's Office, shared several of his experiences working closely with Ms. Shannon when he became the Captain of the Weld County Jail in 2018-2019, and she was the Booking Supervisor and Supply Technician. He described her as a steadfast and dependable employee who is a wealth of institutional knowledge and has left a legacy that has, and will continue, to impact the community she served. He expressed his gratitude for Io�21 2025-2713 BC0016 Page 2 Wednesday, October 1, 2025 www.weld.gov having the privilege of working alongside such a compassionate leader and indicated she will be sorely missed. Co-workers of Ms. Shannon expressed it is an honor and privilege to celebrate her retirement after dedicating so many years serving the citizens of Weld County, and to have done it as a mentor, friend, and the voice of wisdom to help guide, uplift, and inspire those around her to have unwavering commitment to excellence. Ms. Shannon expressed her passionate and heart -felt love for her work that provided her the opportunity to meet many phenomenal people, many of which she now considers family. She shared how difficult it will be leaving but shared she is looking forward to spending time with her family and traveling in her retirement. In turn, each Commissioner extended their appreciation for Ms. Shannon's unwavering leadership and compassion serving the citizens of Weld County, thanked her family for supporting her during her career, and extended their best wishes for her retirement. (Clerk's Note: The group gathered for a photo opportunity.) 2. Long -Term Care Residents' Rights Month — October 2025: Chair Buck read the certificate for the record. Tami Grant, Deputy Director of the Department of Human Services, thanked the Board for the proclamation recognizing the value of the Ombudsman program. She stated the purpose of this month's theme, "Stand with Me," is to highlight the importance of solidarity and support for the rights of residents in long-term care and assisted living facilities. Ms. Grant stated Weld County has eight (8) nursing homes and twenty-four (24) assisted living facilities, which is supported by staff who maintain the highest standards of professionalism with over 500 investigations conducted, and advocate for dignity and compassion of the aging population in Weld County. She introduced the Ombudsman staff who provide consultation to families, faculty staff and community partners. The Commissioners, in turn, expressed their appreciation to the staff who value and advocate for the rights of the citizens who receive assisted care. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1. General Warrants: Commissioner James moved to approve the General Warrants, as printed. Commissioner Ross seconded the motion and, upon a roll call vote of three (3) to zero (0), it carried with Commissioner Maxey excused and Commissioner Peppler abstained. Bids: 1. Approve Bid #B2500023, Owner's Representative Services for Capital Improvement Plan (CIP) Corridor Projects — Department of Public Works: Toby Taylor, Purchasing Department, explained staff conducted a Quality Based Selection (QBS) process to award a consultation team to perform owner's representative services for the County Road (CR) 66 Corridor Project for improvements between U.S. Highway 85 and CR 47, and between CR 13 and State Highway (SH) 257. He stated the committee recommends selecting the 2025-2713 BC0016 Page 3 Wednesday, October 1, 2025 www.weld.gov bidder who had the highest-ranking criteria, Alfred Benesch and Company, for a total amount of $22,500,000.00, which is included in the five (5) year County Improvement Plan (CIP). Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner Peppier and it carried unanimously. New Business — General: 1. Consider First Amended Memorandum of Intergovernmental Agreement for Conduct of Coordinated Elections and Authorize Chair to Sign — Evans Fire Protection District: Rudy Santos, Chief Deputy Clerk and Recorder, stated the property owner list that was received by the Evans Fire Protection District was inaccurate on two (2) occasions, and due to the Election Division's requirement for mail -in ballots to eligible voters who reside outside of the special district, he stated accuracy is critical. Mr. Santos explained it has been determined it is best to have staff compile the property owner list, and the amendment addresses this shift of roles and responsibilities between the County and the special district. Commissioner Ross moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. 2. Consider Contract ID #9951 Notice of Funding Allocation (NFA) Work Plan for Workforce Enterprise Fund (WEF), and Authorize Chair, Department of Human Services, and Workforce Development Board to Sign: Ms. Grant indicated the NFA will allocate monies to the Paving Access to Careers and Employment (PACE) initiative and Workforce Enterprise Fund (WEF) innovation to reflect continuous improvement of employment and training activities, with a term of July 1, 2025, through June 30, 2026. Commissioner James moved to approve said workplan and notice of funding allocation, and authorize the Chair, the Department of Human Services, and the Workforce Development Board to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. (Clerk's Note: Title was corrected to accurately reflect Ms. Grant's clarification on record.) 3. Consider Contract ID #9949 Federal Award Agreement for Housing and Urban Development (HUD) Grant Funds for 2025 Community Development Block Grant (CDBG) Program, and Authorize Chair to Sign: Cynthia Martin, CDBG Analyst, stated the Weld County Community Development Block Grant (CDBG) Program has been awarded funds, in the amount of $1,251,662.00, for the 2025 project year to support qualifying improvements for local municipalities. Commissioner Ross commended Ms. Martin for her navigation of the CDBG funding during a complicated times regarding the federal government, and he moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 2025-2713 BC0016 Page 4 Wednesday, October 1, 2025 www.weld.gov New Business — Ordinances: 1. Emergency Ordinance #261-A, In the Matter of a Supplemental Appropriation for the Year 2025: Jennifer Oftelie, Budget Manager, presented Emergency Ordinance #261-A for supplemental appropriations of funds in 2025. Ms. Oftelie explained the Ordinance obligates dollars the Board had agreed upon prior in the year, provided an overview of the various funds, and detailed various line items within said funds as identified in Exhibits A -E. She indicated staff recommends approval. No public testimony was offered concerning this matter. Commissioner Ross moved to approve Ordinance #261-A, on an emergency basis. The motion was seconded by Commissioner Peppler and it carried unanimously. New Business — Planning: 1. Consider Certification to Weld County Treasurer of County Compliance Violation Penalties as Special Assessment — Jesus Vega (Continued from 4/2/2025): Bruce Barker, County Attorney, alongside Maxwell Nader and Nicole Brick, Department of Planning Services, indicated staff received a Resubdivision application from Mr. Vega on January 31, 2025, and had last met with the property owner on September 22, 2025. He requested another six (6) month continuance, to April 1, 2026, to allow staff and the applicant to navigate the land use process. Commissioner James moved to continue said certification to April 1, 2026, at 9:00 a.m. The motion was seconded by Commissioner Ross and it carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
