Buck, Chair Commissioner Scott K. James, Pro-Tem — Excused Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Angela Snyder The following business was transacted: I hereby certify that pursuant to a Notice dated July 24, 2025, and duly published July 26, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Pelican Shores North Homeowners Association, for Planned Unit Development Change of Zone Amendment, PUDZ25-0001, to Pelican Shores PUD (PZ-1011) to include outdoor storage of boats on Tract B, Block 2. Karin McDougal, Deputy County Attorney, made this a matter of record. Angela Snyder, Department of Planning Services, presented a summary of the request, described the sign posting, displayed images of the whole PUD site. She explained the historical recreational storage use was clearly identified on the original plat, and shared outdoor storage for materials requires a Floodplain Permit. She explained the two North and South HOAs, elaborating on the request to allow boat and trailer storage on Tract B. She described the uses requested on the application, versus what was identified on the original plat for PZ-1011, which depicted a building on the plat which was interpreted differently by Weld staff and the residents. She further stated, in 2020, the recreation and boat ramp areas were extended out on Tract A, Block 1, described the changes to allow boat and trailer storage on Tract B, reiterating a Floodplain Permit is required for the storage area, and relayed the responsibilities of each HOA regarding the river shores. Ms. Snyder reviewed the Code criteria, provided the Board with their options for today's ec.'•pL (tchANfvA/AS/KR0 t/o6/25 2025-2229 PL1678 Hearing Certification (PUDZ25-0001) — Pelican Shores North Homeowners Association and Pelican Shores South Homeowners Association Page 2 request, and explained the reason why the advertised description only depicts Tract B and not Tract A. Seth Holland, President of the Pelican Shores North HOA, reiterated the PUD originated in 2004, and shared its historical use has been in existence since 1984. He stated the use has been an approved Accessory Use with R-1 zoning and shared there is no commercial aspect of the application. Stephen Ceresa, President of the Pelican Shores South HOA, stated the southern residents are in support of the request, as presented in Mr. Holland's testimony. He confirmed the residents have historically used this portion of the property, without incident, since 2010, including, during the 2013, because they moved all boats and any floatable material well before the flood. He pointed out R-1 zoning does allow parking and submitted a copy of the Authorization for the South Shores HOA as a participant in the application (Exhibit C). Commissioner Maxey commended the co -applicant HOAs and staff for bringing this forward as a common-sense clean-up application. Commissioner Ross concurred and shared his appreciation of the two HOAs remaining diligent and working together to find a solution. He noted the information provided documents the historical use, thus he supports establishing the grandfathered use for outdoor storage on both Tracts. Commissioner Maxey agreed and moved to approve the request of Pelican Shores North Homeowners Association, and Pelican Shores South Homeowners Association, for Planned Unit Development Change of Zone Amendment, PUDZ25-0001, to Pelican Shores PUD (PZ-1011) to include outdoor storage of boats on both Tract A, Block 1, and Tract B, Block 2, based on the recommendations of Planning staff and the Planning Commission, along with the finding that the historical use of the outdoor recreational areas is grandfathered, and with the Conditions of Approval, as amended. The motion was seconded by Commissioner Ross. The Board discussed the legal description and Conditions of Approval concerning the historical, grandfathered recreational areas and inclusion of Tract A, Block 1, in addition to Tract B, Block 2, and agreed to all the aforementioned changes. No public testimony was offered regarding changes made to the Conditions of Approval.
