M. , in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Weld County Landfill, Inc. , Box 596, Evans, Colorado, requesting approval of site for a sanitary landfill, also known as a solid and/or liquid waste disposal business on the following described property, to-wit: A parcel of land located in the Northeast Quarter (NE 4) of Section 29, Township 1 North, Range 68 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Northeast corner, Section 29, Township 1 North, Range 68 West, thence West along the north line of said Section 1400 feet to a point, thence south 1000 feet and parallel to the east line of said Secti on to a point; thence East 1000 feet parallel to the North line of said Section to a point; thence North 960 feet parallel to the East line of said Section to a point; thence East parallel to the North line of said Section 400 feet to a point on the East line of said Section; thence north 40 feet along the East line to the point of beginning, containing 23. 3 acres, more or less, and WHEREAS, the petitioner was present and represented by Earl Moffat, and WHEREAS, there was some opposition to the request of petitioner for the location of a sanitary landfill at said location, and WHEREAS, the said requested sanitary landfill operation is located in an agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said sanitary landfill operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the application of Weld County Landfill, Inc. to locate a sanitary landfill on the premises indicated above, be, and it hereby is granted under the conditions following: 1. That any sanitary landfill facility to be installed shall be approved by the State Health Department. 2. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. A . A . Communications tower ii. PEARANCE : Don Carlisle DISCUSSION : Mr. Lorenson stated a n communications tower is proposed a pproximate'y 5 miles east of Pierce which will be 1210 ' high . The airport board is opposed to this tower . F. A. A. has been informed that site approval from the County Commissioners is necessary. Mr. Carlisle enumerated the reasons the airport board is opposed to the installation . Stated it is a poor loc- ation for the instrument approach to the airport. It goes against the future planning for the airport . Mr. Carlisle stated he thought the tower - is for the Army . MOTION : By Mr. Watson to inform the F. A . A. that the Weld County Planning Commission is going on record as being opposed to the proposed communications tower. Second by Mr. Anderson . A un- ( animous vote of "Aye" by Anderson , Watson , Nix and Heitman . Motion carried . SUBJECT: Discussion on experimental construction . APPEARANCE : . Duane Bacon DISCUSSION : Mr . Bacon presented samples of prebuilt walls which his company is manufacturing for low cost housing . Construction does not meet the Uniform Building Code . Their company would like permission to build one house. Mr . Elgin stated the main difference is the outside walls . Mr . Connell stated the Plan- ning Commission has no power to grant a variance from the Uniform Building Code . Mr . Lorenson stated a Board of Review would have to be created by resolution by the Board of County Commissioners to vary from the Building Code . The soil map should be used for general planning and does not exclude the need for on site investigations for specific engineering purposes. The Olney, Otero, Kim and Platner soils are all moderately coarse to moderately fine textured, deep, well drained soils. Nelson soils are moderately coarse textured soils with sandstone between 20 and 40 inches. There is either a canal or a main farm lateral along the west edge of the Erie open pit mine. Soils mapped in the NE4 Sec. 29 were X40-B and X40-C, Wiley-Colby soils, 1-3 and 3-5 slope, 67-C, Ulm clay loam, 3-5io slope, and 87ii-DL, Sa•asmi-Shingle complex, slopes greater than 9%. Wiley-Colby soils are deep, moderately fine textured soils and are moderately well drained. Ulm soils are deep, fine textured soils and are moderately well drained. Samsil- Shingle complex is composed of shallow, moderately fine to fine textured soils with shale and interbedded shale and sandstone between 10 and 20 inches. Sone sandstone and shale outcrops are common in any delineated area. Runoff from this area drains into Coal Creek about one mile west. If I can be of any further assistance, please feel free to call.
