Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board of County Commissioners of Weld County, State of Colorado, were
presented with a Petition for Abatement or Refund of Taxes for Account
Number -R8970554, and tax year 2023, at a duly and lawfully called regular meeting held
on the 18th day of June, 2025. at which meeting there were present the following
members: Chair Perry L. Buck, and Commissioners Jason S. Maxey, Lynette Peppier,

Water Valley in Windsor. It is a 64,664 -square -foot building located on
approximately 6 acres of land The building is tenant occupied by a charter school
and a fitness center t
The charter school is part of the RE -4 School District and, as a result, the space
occupied by the charter school is automatically exempt from taxation as of
2/1/2023, the day the school took occupancy The charter school occupies 68 3%
of the property
Abatement Request:
The petition for abatement or refund of 2023 taxes was submitted by the owner,
Manna One LLC
The owner is requesting tax exempt status for the remaining 31 7% of the property
that is leased by the Poudre Tech Metropolitan Distnct (the Metro Distnct) and is
occupied by the fitness center, The W Club
Description and Analysis
As of January 1, 2023, the remaining 31.7% of the building was leased by the
Metro Distnct, a tax-exempt entity
C R S 39-3-124 states in part
' the part of real property that is used by the state, a political subdivision, or a
state -supported institution of higher education pursuant to the provisions of any
lease or rental agreement for at least a one-year term, with or without an option to
purchase, and pursuant to which the subject real property is used for purposes of
the state, political subdivision, or institution of higher education, as applicable, shall
be exempt from the levy and collection of property tax '
Therefore, there are two criteria for exemption The lease must be for more than
one year and the use must be for the political subdivision which is the Poudre Tech
Metropolitan District
Upon review of the lease and operating agreement, both criteria have been met
The lease term is for five years, and the operating agreement delineates that all
revenues generated are revenues of the Metro District and are accounted for in the
Metro District budgets
Reconciliation and Summary
This abatement request is for a change in classification, not a change in value
After a review of the W Club lease and operating agreement, I recommend the
31 7% of the property that is leased to the W Club be exempted from taxation
This will result in an abatement of $103,741 16 for tax year 2023
