HomeMy WebLinkAbout20251851.tiffResolution Approve Amendment #1 to Intergovernmental Agreement for Construction of High Plains Boulevard (aka County Road 9.5) Between County Roads 32 and 36, and Authorize Chair to Sign — Town of Mead Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rude Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with Amendment #1 to the Intergovernmental Agreement for Construction of High Plains Boulevard (also known as County Road 9.5) between County Roads 32 and 36, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of Mead, with further terms and conditions being as stated in said amendment, and Whereas, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Amendment #1 to the Intergovernmental Agreement for Construction of High Plains Boulevard (also known as County Road 9.5) between County Roads 32 and 36, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of Mead, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said amendment. Gesick, Clerk to the Board cc: KJ (CH (DW /cP/S8) 07/I o/25 2025-1851 EG0083 conk-kao- nAg on BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: IGA Amendment with Town of Mead for the High Plains Blvd. Project Between WCR 32 & 36 DEPARTMENT: Public Works DATE: 6/10/25 PERSON REQUESTING: Cameron Parrott Brief description of the problem/issue: The Town of Mead wishes to amend an existing IGA with Weld County to allow them to contribute money toward paving the proposed roundabouts in the project between WCR 32 and WCR 34 in concrete pavement instead of hot mix asphalt. It was determined that the difference in cost between these two options was $635,000 with concrete paving being the more expensive option. The attached IGA amendment was reviewed by our legal department and was approved by the Town of Mead at their last council meeting on June 9th. The original IGA had Weld County contribute $3,000,000 toward the segment of the High Plains Blvd. project that is being constructed by a developer between WCR 34 & WCR 36. Mead is asking that a portion of the Weld County contribution toward the segment of the project between WCR 34 and 36 be reassigned to go toward the concrete paving associated with the segment of the project between WCR 32 and WCR 34. Mead is willing to work with the Developer on the segment between WCR 34 and WCR 36 to offset the $635,000 reduction toward that segment of the project. The Town of Mead will be taking over maintenance of the new roadway upon completion and wishes to have the roundabouts paved in concrete instead of asphalt. What options exist for the Board? • Allow the IGA amendment to be placed on the next available BOCC agenda for approval and signature • Deny the IGA amendment and reallocation of funds Consequences: If the IGA amendment is not approved, the project would likely pave the roundabouts in asphalt. All of the roundabouts at the I-25 exits along this corridor are asphalt paved, so this would not be a drastic difference from other roundabouts in the area. Impacts: Maintenance costs associated with life cycle analyses show that concrete pavement requires less cost over time for maintenance and lasts longer than asphalt. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): the county could see a savings to the project of $635,000 by paving the roundabouts in asphalt instead of concrete. Mead is willing to cover the difference to have the roundabouts completed with concrete paving. Recommendation: Staff approving the IGA amendment with the Town of Mead and placing the amendment on the next available BOCC agenda for approval and signature. Ross 77,4 Contract #9688 2025-1851 Ca/30 EC 0Us3 FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR CONSTRUCTION OF HIGH PLAINS BOULEVARD (A.K.A. - WELD COUNTY ROAD 9.5) BETWEEN WELD COUNTY ROAD 32 AND WELD COUNTY ROAD 36 THIS FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT (the "First Amendment") is made and entered into as of the date of the last signature below (the "Effective Date"), and is entered into by and between the Town of Mead, Colorado, a municipal corporation of the State of Colorado, whose address is 441 - 3rd Street, P.O. Box 66, Mead, CO 80542 ("Mead") and the County of Weld, a political subdivision of the State of Colorado, by and through the Board of County Commissioners of the County of Weld, Colorado, whose address is P.O. Box 758, 1150 "O" Street, Greeley, Colorado 80632 ("Weld County"). Mead and Weld County are sometimes referred to individually as a "Party" and collectively as the "Parties." 1. Incorporation of Prior Intergovernmental Agreement. The Parties previously entered into that certain Intergovernmental Agreement for Construction of High Plains Boulevard (a.k.a. — Weld County Road 9.5) between Weld County Road 32 and Weld County Road 36 dated August 7, 2024 (the "Agreement"). Section 5 of the Agreement requires that any amendments to the Agreement be in writing and executed by the Parties. This First Amendment is intended to be attached to and incorporated into the Agreement for the duration of the term of the Agreement. 2. Purpose of First Amendment. As contemplated in Subsection 2(b)v. of the Agreement, Weld County has provided the construction plans for the County Project to Mead for Mead's review and approval. Weld County is currently planning to revise the bid set for the County Project to change the main surface material at both the WCR32/HPB Intersection and the WCR34/HPB Intersection (as those terms are defined in the Agreement) from concrete to asphalt. This design change in the surface material results in a cost reduction of six hundred and thirty-five thousand dollars ($635,000.00). As the ultimate owner of the County Project improvements, the Town desires to remit $635,000.00 to Weld County (the "Town Contribution") if and as necessary in order to ensure that the surface material at both the WCR32/HPB Intersection and the WCR34/HPB Intersection remains concrete. 3. Payment of Town Contribution to Weld County. Following completion of the WCR 32/HPB Intersection and the WCR 34/HPB Intersection, the County will request the Town Contribution in writing, and the County letter requesting the Town Contribution ("County Funding Request") shall be delivered to the Town as required by Section 11 of the Agreement. The Town shall remit the Town Contribution to the County within forty-five (45) calendar days of receipt of the County Funding Request. 4. Effect of Agreement and First Amendment. All provisions of the Agreement shall remain in full force and effect. The only modification of the Agreement intended by this First Amendment is to memorialize the Town Contribution (as defined above) and to establish the timing of Mead's remittance of the Town Contribution to Weld County. 5. Authority. The signatures of those representatives of the Parties below affirm that they are authorized to enter into and execute this Agreement and that all necessary actions, notices, meetings, and/or hearings pursuant to any law required to authorize the execution of this Agreement have been made. 6. Counterparts. The Parties agree that this First Amendment may be executed in one or more counterparts, each of which shall constitute an original and all of which shall constitute one and the same document. In addition, the Parties acknowledge and agree that electronic signatures shall be effective for all purposes, in accordance with the Uniform Electronic Transactions Act, Title 24, Article 71.3 of the Colorado Revised Statutes.
